In short

GDPR compliance in Sweden at a glance

Regulation (EU) 2016/679 (GDPR) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Sweden ask for evidence that you meet it.

Sweden handles the GDPR through two short instruments. Lag (2018:218) supplements the Regulation, and Förordning (2018:219) names the Integritetsskyddsmyndigheten (IMY) as the supervisory authority and gives Swedac the task of accrediting certification bodies under Article 43. The Swedish act applies to processing in the activities of Swedish establishments and also reaches controllers and processors established only in third countries when they process data about people in Sweden in connection with offering goods or services. It also protects the confidentiality of data protection officers. No general GDPR certificate exists; compliance is evidenced through records of processing, notices, processor contracts, rights handling, breach procedures and security controls. Sterling's Enschede office builds that evidence and, where clients want an external benchmark, aligns it with ISO/IEC 27701 certification by an accredited body.

The need

Who needs GDPR in Sweden, and what happens without it

These are the organisations in Sweden that most often need to show GDPR.

  • Companies established in Sweden that process personal dataLag (2018:218) applies to processing in the activities of establishments in Sweden, with IMY as supervisor.
  • Non-EU organisations offering goods or services to people in SwedenThe Swedish act also reaches third-country controllers and processors where the processing concerns data subjects in Sweden.
  • SaaS, cloud and outsourcing providers acting as processorsCustomers need processor evidence on security, sub-processors and incident handling.
  • Organisations considering a certification route under Article 43Förordning (2018:219) gives Swedac the task of accrediting GDPR certification bodies.

Requirements

GDPR requirements in Sweden

Strip away the vocabulary and the GDPR requires an organisation to comply in six areas covering how it uses personal data.

Every use of data has a lawful basisEach processing purpose is identified and rests on a lawful basis, with data limited to what that purpose needs.
People are informed and their rights respectedClear privacy information is given, and requests to access, correct, erase or object are answered within the regulation's time limits.
Accountability is documentedRecords of processing, policies and, where required, a data protection officer show how you comply.
Privacy is designed in and risks assessedData protection is built into systems by design and by default, with impact assessments for high-risk processing.
Data is secured and breaches handledAppropriate security protects personal data, and breaches are recorded and notified to the authority and individuals where required.
Processors and transfers are controlledProcessors work under compliant contracts, and transfers outside the EEA rely on a recognised transfer mechanism.

In Sweden these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: GDPR explained →

Time

How long does GDPR compliance take in Sweden?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Sweden these are the factors that set the timeline.

  • Number of processing activities and systems to map
  • Processors, sub-processors and international transfers to review
  • Number of legal entities in the group
  • Security remediation and breach readiness

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does GDPR compliance cost in Sweden?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Sweden these factors move both.

  • Volume of processing activities and data subjects
  • Number of entities and systems in scope
  • Security remediation needed
  • External data protection officer arrangements

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

GDPR consultants and assessors in Sweden

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers GDPR and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Sweden are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive GDPR in Sweden (4)

    InstrumentHow it treats the standard
Regulation (EU) 2016/679 (GDPR)The instrument itself
Applied in Sweden with the supplementing Lag (2018:218) and Förordning (2018:219).
Lag (2018:218) med kompletterande bestämmelser till EU:s dataskyddsförordningThe instrument itself
National supplement; it sets the territorial scope and includes a duty of professional secrecy for data protection officers (1 kap. 8 §).
Förordning (2018:219) med kompletterande bestämmelser till EU:s dataskyddsförordningThe instrument itself
3 § names IMY as supervisory authority, and 4 § has Swedac accredit certification bodies under Article 43.
    Integritetsskyddsmyndigheten (IMY)Regulator
Sweden's data protection authority; it provides guidance, supervises compliance and publishes decisions.

Accreditation, audit language and remote audits in Sweden

Compliance, not certification: the GDPR has no general certificate. Evidence is the controller's or processor's records of processing, notices, contracts, procedures and security measures. Förordning (2018:219) assigns accreditation of GDPR certification bodies under Article 43 to Swedac, and ISO/IEC 27701 certification by an accredited body is an optional external benchmark. Edition and transition details: GDPR hub →

    Audit language

IMY works in Swedish and also publishes English-language guidance; privacy notices must suit the people they address, and internal records can be kept in Swedish or English.

    Remote and on-site

Data-mapping workshops can be on-site or remote; no external assessment is prescribed for general compliance.

GDPR in Sweden: questions clients ask

Which authority supervises the GDPR in Sweden?

Integritetsskyddsmyndigheten (IMY). Förordning (2018:219) states in 3 § that IMY is the supervisory authority under the GDPR and under Lag (2018:218). IMY says its mission is to protect people's fundamental rights and freedoms when their personal data is processed, and it also gives guidance to organisations.

What is the Swedish law that supplements the GDPR?

Lag (2018:218) med kompletterande bestämmelser till EU:s dataskyddsförordning, with the matching Förordning (2018:219). The act applies to processing in the activities of establishments in Sweden and to third-country controllers or processors whose processing concerns people in Sweden in connection with offering goods or services. Ask counsel how it applies to you.

Is there a GDPR certificate in Sweden?

There is no general GDPR certificate that proves compliance. Compliance is shown through records, notices, contracts, procedures and security measures. Förordning (2018:219) does give Swedac the job of accrediting certification bodies under Article 43, so certification mechanisms can exist, and ISO/IEC 27701 remains an optional benchmark.

Do data protection officers in Sweden have a duty of secrecy?

Yes. Lag (2018:218) provides that a person performing the data protection officer's tasks under Article 37 must not improperly disclose what they learn in doing so, and in public activities the Offentlighets- och sekretesslagen (2009:400) applies instead. Draft the officer's role and reporting lines with that duty in mind, and take advice from counsel.
