In short

GDPR compliance in Czechia at a glance

Act No. 110/2019 Coll. on personal data processing (zákon o zpracování osobních údajů) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Czechia ask for evidence that you meet it.

A Czech organisation handling personal data answers to the GDPR and to Act No. 110/2019 Coll., which makes the Úřad pro ochranu osobních údajů the central authority and says it acts independently. The Act also covers processing for criminal-law, defence and security purposes and provides that bodies issuing data protection certificates are accredited through the national accreditation body, ČIA. The whistleblower Act, No. 171/2023 Coll., adds internal reporting channels that themselves hold personal data. There is no general GDPR certificate, so evidence is records of processing, notices, processor contracts and security measures, and ISO/IEC 27701 is an optional benchmark. Sterling does not certify. From Frankfurt, Sterling maps data flows, builds the register and procedures, and supports readiness for an inspection, with Effivity and Sterling Academy included in the engagement. Confirm legal questions with your counsel or the regulator.

The need

Who needs GDPR in Czechia, and what happens without it

  • Czech companies processing customer or employee dataAct No. 110/2019 Coll. sits beside the GDPR and makes the Office for Personal Data Protection the supervisor.
  • Non-EU businesses selling to people in CzechiaThe Regulation reaches organisations that offer goods or services to people in the EU.
  • Processors such as SaaS, payroll and hosting providersControllers pass processor terms and security duties down by contract.
  • Employers running whistleblowing channelsThe whistleblower Act requires internal reporting systems whose data must be handled lawfully.
  • Organisations holding or seeking data protection certificatesThe Act routes accreditation of certification bodies through the national accreditation body.

Requirements

GDPR requirements in Czechia

Strip away the vocabulary and the GDPR requires an organisation to comply in six areas covering how it uses personal data.

Every use of data has a lawful basisEach processing purpose is identified and rests on a lawful basis, with data limited to what that purpose needs.
People are informed and their rights respectedClear privacy information is given, and requests to access, correct, erase or object are answered within the regulation's time limits.
Accountability is documentedRecords of processing, policies and, where required, a data protection officer show how you comply.
Privacy is designed in and risks assessedData protection is built into systems by design and by default, with impact assessments for high-risk processing.
Data is secured and breaches handledAppropriate security protects personal data, and breaches are recorded and notified to the authority and individuals where required.
Processors and transfers are controlledProcessors work under compliant contracts, and transfers outside the EEA rely on a recognised transfer mechanism.

In Czechia these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: GDPR explained →

Time

How long does GDPR compliance take in Czechia?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Czechia these are the factors that set the timeline.

  • Number of processing activities and systems to map
  • Number of legal entities and establishments
  • Processor and international-transfer review
  • Employee data, monitoring and whistleblowing arrangements

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does GDPR compliance cost in Czechia?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Czechia these factors move both.

  • Volume of processing and data subjects
  • Entities in scope
  • Security remediation needed
  • Whether an external data protection officer is appointed

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

GDPR consultants and assessors in Czechia

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers GDPR and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Czechia are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in Czechia

Compliance, not certification: the GDPR has no general certificate. Evidence is the controller's or processor's records of processing, notices, contracts, procedures and security measures. Act No. 110/2019 Coll. provides for accreditation of certification bodies through the national accreditation body, and ISO/IEC 27701 is a separate optional benchmark. Edition and transition details: GDPR hub →

    Audit language

Czech is the official language and English is commonly used in business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

    Remote and on-site

Data-mapping workshops and document reviews can be on-site or remote; no external assessment is prescribed for general compliance.

GDPR in Czechia: questions clients ask

Which Czech law supplements the GDPR?

Act No. 110/2019 Coll. on personal data processing, in force since 24 April 2019. It adapts Czech law to the GDPR, covers processing by authorities for criminal-law, defence and security purposes, and sets the position and powers of the Office for Personal Data Protection. Check the consolidated text on e-Sbírka, or ask your counsel, for the provisions that affect you.

Is there a Czech GDPR certificate?

The GDPR has no mandatory certificate, but the Act provides a route. It says bodies entitled to issue data protection certificates are accredited under the accreditation law, which in Czechia means the entrusted national accreditation body. Whether any such scheme is available for your processing is something the Office or your counsel can confirm.

Does Czech whistleblowing law create GDPR work?

Yes. Act No. 171/2023 Coll. requires public contracting authorities and larger employers to set up an internal reporting system, and those channels hold personal data about reporters and accused persons. Notices, access limits, retention rules and processor contracts all need attention. The Ministry of Justice has a role in whistleblower protection.

Who handles complaints about GDPR breaches in Czechia?

The Office for Personal Data Protection, ÚOOÚ. Under the Act it is the central administrative authority for personal data protection and acts independently, bound only by law and directly applicable EU law. Include its guidance in your procedures, and take advice from counsel before answering a complaint or inspection.
