Taiwan Personal Data Protection Act (PDPA) compliance in Taiwan at a glance
Personal Data Protection Act (Laws & Regulations Database, English version) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Taiwan ask for evidence that you meet it.
A customer list, an HR file or a loyalty app is enough to bring a Taiwanese business under the Personal Data Protection Act, which regulates how personal data is collected, processed and used and gives people the right to inquire, obtain copies, correct, stop use and erase. The Act names the Personal Data Protection Commission as competent authority, and the commission's Preparatory Office publishes the announcements and draft regulations that will fill in breach reporting and security detail. Sensitive categories such as medical, genetic and criminal records carry tighter rules, and the competent authority may restrict cross-border transfers on listed grounds. There is no PDPA certificate; ISO/IEC 27701 certification by an accredited body is an optional benchmark. Sterling maps data flows, drafts notices and rules, and builds the evidence from its Tokyo office, with Effivity and Sterling Academy included with the engagement.

How long does Taiwan Personal Data Protection Act (PDPA) compliance take in Taiwan?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Taiwan these are the factors that set the timeline.
- Number of systems, files and processing activities to map
- Vendors and cross-border transfers to review
- Status of the draft regulations that will set breach reporting and security detail
- Existing ISO/IEC 27001 or ISO/IEC 27701 documentation that can be reused
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does Taiwan Personal Data Protection Act (PDPA) compliance cost in Taiwan?
The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Taiwan these factors move both.
- Legal entities, business units and data sets in scope
- Volume of vendors and overseas transfers
- Security control remediation needed
- Training for staff who handle personal data
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
Taiwan Personal Data Protection Act (PDPA) consultants and assessors in Taiwan
Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers Taiwan Personal Data Protection Act (PDPA) and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Taiwan are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in Taiwan
Compliance, not certification: the Act names no certificate. Evidence is the business's own records, notices, security measures and oversight of anyone it entrusts with data. ISO/IEC 27701 certification by an accredited certification body is a voluntary benchmark, and TAF lists a CNS 27701 certification scheme. Audit language
Privacy notices, consent wording and internal rules are normally kept in Chinese for data subjects and staff; English versions support group or overseas review. The Chinese text of the Act prevails over the English version.
Remote and on-site
Data-mapping workshops and policy drafting can be done remotely; visits to sites that hold paper or device-based records are arranged where the scope needs them.
Taiwan Personal Data Protection Act (PDPA) in Taiwan: questions clients ask
Is there a PDPA certificate in Taiwan?
No. The Act names no certificate, and compliance is shown through your own records, notices, security measures and oversight of anyone you entrust with data. ISO/IEC 27701 certification from an accredited certification body is voluntary, and TAF lists a CNS 27701 scheme. It supports customer assurance but never replaces meeting the Act itself.
Can personal data be transferred outside Taiwan?
Generally yes, unless the competent authority restricts the transfer. It may do so where major national interests are involved, where an international treaty says so, where the receiving country lacks proper personal data regulation and data subjects may be harmed, or where the transfer is meant to get around the Act. List each overseas transfer and review it against those grounds.
Which personal data needs extra care?
Data about medical records, healthcare, genetics, sex life, physical examination and criminal records. The Act restricts collecting, processing or using it unless a listed basis applies, such as an express legal requirement or the data subject's written consent. Identify these categories in your data map first, because they carry the tightest rules. Your counsel can confirm which basis fits.
