What it is

What is Taiwan's Personal Data Protection Act and what is it used for?

The Personal Data Protection Act (PDPA) is Taiwan's general law on personal data. It regulates how personal data is collected, processed and used, requires people to be told what is collected and why, and gives them the right to inquire, obtain copies, correct, stop use and erase. Sensitive categories such as medical, genetic and criminal record data carry tighter rules, and transfers abroad can be restricted on listed grounds.

The Act names the Personal Data Protection Commission as competent authority, and the Commission's Preparatory Office publishes the announcements and draft regulations that fill in detail such as incident reporting and security. A customer list, an HR file or a loyalty app is enough to bring a business under the Act. The practical test: for any personal data you hold, could you show its purpose, who was told, how it is protected and where it goes?

Current law. The Laws & Regulations Database shows the Personal Data Protection Act as last amended on 11 November 2025, and the Chinese text prevails over the English version. Some detail depends on rules from the competent authority, so confirm which provisions and rules apply now with your legal advisers.

Who it is for

Who needs to comply with the Taiwan PDPA?

The Act applies to businesses and organisations in Taiwan whatever their size, including employers holding staff records. Organisations usually come to Sterling for a structured programme from one of four directions:

  • A customer's due diligence asks how you protect their data. Buyers in Taiwan and abroad send privacy questionnaires and expect notices, request handling, security measures and an incident process you can describe on request.
  • You hold sensitive data. Healthcare, insurance and wellness providers handle medical, physical examination or genetic data, which the Act allows only on specific bases.
  • Personal data goes to affiliates or processors abroad. The competent authority may restrict cross-border transfers on listed grounds, so groups need each transfer recorded and reviewed.
  • Marketing and e-commerce use customer data. A person who objects to marketing use must have it stopped, and the first marketing contact must show how to object.

The aim is handling of personal information that you control and can evidence. Compliance depends on how the rules are applied every day, not on a policy document alone.

Requirements

What are the main Taiwan PDPA requirements?

Strip away the vocabulary and Taiwan's Personal Data Protection Act requires a business to comply in six areas of personal data handling. The list below puts each one in business terms; the Act and the regulator's guidance give the full wording and exceptions.

  • Data is collected for specific, lawful purposes: personal data is collected and used in good faith, within the necessary scope of a specific purpose, and only on one of the lawful bases the Act lists.
  • People are told what is collected: individuals are told who is collecting their data, why, which categories, how it will be used, and what rights and consequences apply.
  • Individuals can exercise their rights: requests to inquire, obtain a copy, correct, stop use or erase personal data are received and answered within the time limits the Act sets.
  • Sensitive data gets tighter rules: medical, healthcare, genetic, sex life, health examination and criminal record data is handled only on the specific bases the Act allows.
  • Data is secured and incidents are handled: security and maintenance measures protect personal data files, and theft, loss or leakage is notified to data subjects and, within the specified scope, reported to the authority.
  • Transfers abroad stay under review: cross-border transfers are checked, since the competent authority can restrict them on grounds such as national interest, a treaty, weak protection abroad or evasion of the Act.

What does useful Taiwan PDPA evidence look like?

An inventory of the personal data you hold with the purpose and lawful basis for each use, the notices given at collection, a log of requests to inquire, copy, correct, stop use or erase with response dates, the bases recorded for sensitive data, the security and maintenance measures that protect personal data files, an incident register with notification decisions, and a list of transfers abroad with their review. We build these records into Effivity so they stay current rather than being assembled after a complaint.

Compliance route

How do you achieve Taiwan PDPA compliance?

There is no certificate at the end of this route. Compliance is something your organisation demonstrates, to the competent authority if a complaint or incident arises, and to customers who ask. Sterling helps you build and run the programme; interpretation of the law in contested cases remains with your legal advisers and, ultimately, the regulator and the courts.

  1. 01
Map the personal information you handle.Customers, members, patients, staff and suppliers: what is collected, for which purpose, on which basis, where it is stored, who receives it and whether it leaves Taiwan.
  2. 02
Gap analysis: compare current practice with the Act.Each area of the Act reviewed against what actually happens, with actions, owners and dates agreed.
  3. 03
Put the controls and routines in place.Assign responsibility, update notices and consent wording, set rules for sensitive data, put security and maintenance measures in place, oversee anyone you entrust with data and agree an incident response procedure.
  4. 04
Test the programme and review the results.Internal review of samples, a simulated incident or data-subject request, and a management review that closes findings with evidence.
  5. 05
Operate, demonstrate and keep it current.Answer requests within the time limits, record incidents, review transfers abroad, refresh training and follow the competent authority's new rules as they are issued.

Check the route before you sign. No one can certify compliance with the Taiwan PDPA, so treat any offer of a "PDPA certificate" with suspicion. If a customer wants independent assurance, ISO/IEC 27701 is certifiable by an accredited certification body, and TAF lists a CNS 27701 certification scheme; confirm the body's accreditation directly with the accreditation body concerned.

Cost

How much does Taiwan PDPA compliance cost?

The cost of a Taiwan PDPA programme is driven by how much personal information you hold, how many systems and suppliers touch it, and how much already works. Your proposal shows each component, with what is included and what remains for your legal advisers.

Cost componentWhat affects it
Consulting and implementationVolume and sensitivity of personal data, number of systems, entities, vendors and overseas transfers, and whether you choose Design™ or Drive™
Legal reviewAny advice you take from your own legal advisers on contested interpretations or contract wording, arranged separately
Internal resourcesTime from the privacy officer, system owners and managers, plus any security or process changes the gap analysis identifies
Software and learningIncluded in a Sterling engagement: Effivity for registers and evidence and Sterling Academy access for your people, confirmed in the proposal
Continued supportPeriodic reviews, refresher training, incident exercises and updates when the law or your systems change, under Sustain™

What changes the scope

  • How many groups of individuals and data sets are involved
  • Sensitive categories such as medical or genetic data
  • Vendors, overseas affiliates and transfers abroad
  • Whether another programme, such as GDPR or ISO/IEC 27701, already exists
  • Deadlines set by a customer, contract or incident

What every Sterling proposal states

  • Deliverables, assumptions, exclusions and who does what
  • What remains for your legal advisers, stated plainly
  • Effivity, training and Academy access itemised at no additional cost
  • Payments linked to delivered milestones
  • Every component shown, so nothing is added later

Timeline

How long does Taiwan PDPA compliance take?

Timing depends on how scattered your personal information is, how quickly system owners respond and how much has to change. Your proposal sets out the phases for your scope, long enough to map the information, fix the gaps and show that requests and incidents are handled the way the procedures say.

PhaseWhat sets the pace
Mapping and gap analysisAccess to system owners, supplier contracts and existing notices and policies
ImplementationNotice rewrites, supplier contract updates, security changes and approvals
Testing and reviewTime for requests and incidents to run through the new routines, then internal review and management review
Ongoing operationRefresher training, vendor changes and new rules from the competent authority

If a customer or contract has set a date, tell us at the outset and we will say plainly what can be in place by then and what should follow.

  • Effivity ISO & GRC software

Registers, requests and incidents managed in Effivity, included with the engagement at no additional cost.

  • Training for everyone

Internal auditor training for your review team, as applicable to your standard, and preferential Sterling Academy access, including complimentary awareness training for your people as part of the engagement.

  • Internal review and management review

Sterling OS™ sets how we deliver. Design™ is guided support, where your team builds the programme with our consultants' direction; Drive™ is managed support, where our consultants do most of the work with your input. You choose one of the two, not both in sequence. Once the programme is operating, Sustain™ keeps reviews, training and updates on schedule, and Automate™ is Effivity, where the records live.

The Act names the Personal Data Protection Commission as competent authority.

What this means when someone asks

When a customer's due diligence team, a data subject or the competent authority asks how you handled something, the answer is a record: the request and its response date, the incident and the decisions taken, the notice that applied. Sustain™ runs in the same workspace, so the programme keeps producing that evidence year after year.

FAQs

Frequently asked questions about the Taiwan PDPA

Is there a PDPA certificate in Taiwan?

No. The Act names no certificate, and compliance is shown through your own records, notices, security measures and oversight of anyone you entrust with data. ISO/IEC 27701 certification from an accredited certification body is voluntary, and TAF lists a CNS 27701 scheme. It supports customer assurance but never replaces meeting the Act itself.

Must a data leak be reported under the Act?

The Act's text says yes. A non-government agency that learns personal data has been stolen, altered, damaged, lost or leaked must notify the data subject and, where the case falls within a specified scope, report to the competent authority, taking immediate countermeasures and keeping records. Confirm the current scope and timing with your counsel.

Can personal data be transferred outside Taiwan?

Generally yes, unless the competent authority restricts the transfer: where major national interests are involved, where a treaty says so, where the receiving country lacks proper personal data regulation and data subjects may be harmed, or where the transfer is meant to get around the Act. List each overseas transfer and review it against those grounds.

Which personal data needs extra care?

Data about medical records, healthcare, genetics, sex life, physical examination and criminal records. The Act restricts collecting, processing or using it unless a listed basis applies, such as an express legal requirement or the data subject's written consent. Identify these categories in your data map first; your counsel can confirm which basis fits.

Does our GDPR programme cover the Taiwan PDPA?

Partly. Data inventories, security controls and request handling carry across, but the Act has its own notice content, rights, sensitive categories, incident duty and transfer rules, and its Chinese text prevails. A gap analysis against the Act shows what to add rather than rebuilding.
