Indonesia Personal Data Protection Law compliance in Indonesia at a glance

Undang-undang (UU) Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Indonesia ask for evidence that you meet it.

What does Indonesia's personal data protection law actually expect of a company? Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi, in force since 17 October 2022, applies to individuals, public bodies and international organisations in Indonesia and, where processing has legal effect in Indonesia or on Indonesian data subjects abroad, beyond its borders. Controllers must prepare and apply technical and operational measures to protect personal data, carry out impact assessments for high-risk processing such as automated decisions with legal effects, and appoint a data protection officer where they serve the public, monitor at scale or handle specific data in large volumes. Oversight sits with an agency established by and responsible to the President. There is no certificate for this law; compliance is shown through records of processing, notices, consent and rights handling, breach procedures and security controls. Sterling's Jakarta office builds that evidence and, for clients who want an external benchmark, aligns it with ISO/IEC 27701 certification by an accredited body.

Strip away the vocabulary and Indonesia's PDP Law asks a data controller to comply in six areas of personal data protection.

Every purpose has a legal basisExplicit consent or another basis in the law supports each purpose for which personal data is processed.
Data subjects' rights are honouredIndividuals can access, correct and delete data, withdraw consent and object to decisions based solely on automated processing.

Security failures are notifiedTechnical and operational measures protect data, and failures of protection are notified in writing within the period the law sets.
An officer is appointed where requiredA data protection officer is appointed in the cases the law specifies, such as large-scale processing.
Transfers abroad meet the conditionsTransfers outside Indonesia need adequate protection in the destination, appropriate safeguards or the individual's consent.

In Indonesia these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: Indonesia Personal Data Protection Law explained →

      Time

How long does Indonesia Personal Data Protection Law compliance take in Indonesia?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Indonesia these are the factors that set the timeline.

      • Number of processing activities and systems to map
      • Number of entities and countries involved in transfers
      • Whether impact assessments are needed for high-risk processing

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does Indonesia Personal Data Protection Law compliance cost in Indonesia?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Indonesia these factors move both.

      • Number of legal entities and systems in scope
      • Volume of processing activities and data subjects
      • Security control remediation needed

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

Indonesia Personal Data Protection Law consultants and assessors in Indonesia

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers Indonesia Personal Data Protection Law and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Indonesia are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in Indonesia

Compliance, not certification: UU PDP has no certificate. Evidence is the organisation's records, notices, impact assessments, procedures and security measures. ISO/IEC 27701 certification by an accredited body is an optional external benchmark. Edition and transition details: Indonesia Personal Data Protection Law hub →

          Audit language

Privacy notices should be in the language of the audience they serve, normally Bahasa Indonesia; internal records may be kept in Indonesian or English.

          Remote and on-site

Data mapping workshops can be on-site or remote; the law prescribes no external certification audit.

Indonesia Personal Data Protection Law in Indonesia: questions clients ask

Does UU PDP apply to a company outside Indonesia?

It can. UU PDP applies outside Indonesia where processing has legal effect in Indonesia or on Indonesian data subjects abroad. A foreign company serving Indonesian individuals may therefore be covered. Take advice from your counsel on your own case. Where data subjects are in Indonesia, the question of reach deserves an early, documented answer.

Is there a UU PDP certificate?

No. UU PDP has no certificate, and compliance is evidenced through your records, notices, impact assessments, procedures and security measures. ISO/IEC 27701 certification is optional, and it only serves as an external benchmark. Keep those records current, because they are the proof an inquiry or customer would ask to see.

When must we appoint a data protection officer?

Appoint one where processing is for public service, involves large-scale systematic monitoring, or covers large-scale specific data or criminal records. Article 53 sets those triggers, and your counsel can confirm whether your activities meet them. Record the reasoning behind the decision either way, so that it can be explained later.

          Who oversees UU PDP?

Personal data protection is carried out by an agency that is established by and responsible to the President. The law gives it that role in Article 58. Follow its guidance, and confirm current details with the regulator. Because the arrangements are still developing, check the regulator's current position before relying on this summary.
