In short

ISO 37001 certification in Thailand at a glance

In Thailand, ISO 37001 is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.

Thai companies that deal with public officials, licences and government contracts carry a corporate exposure the National Anti-Corruption Commission has spelled out: an entity with appropriate internal controls to prevent bribery is not held liable under the provision its guidance describes, and the NACC lists eight measures, from leadership commitment and risk assessment to third-party management, reporting channels and regular review. The page does not name ISO 37001, and a certificate is no guarantee, but the standard turns the same ground into an audited management system, which also answers the anti-bribery programmes of multinational customers. Certification comes from an accredited certification body, and the National Standardization Council's recorded scopes do not include ISO 37001, so verify each body's accreditation. Sterling's Manila office builds the risk assessment, due diligence, controls and reporting channel for Thai clients, with Effivity and Sterling Academy included in the engagement. Local questions are answered below.

The need

Who needs ISO 37001 in Thailand, and what happens without it

In Thailand the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Companies that deal with public officials, licences or government contractsThe NACC guidance says an entity with appropriate internal controls against bribery is not held liable under the provision it describes.
  • Groups using agents, distributors and other third partiesThird-party management is one of the NACC's eight measures.
  • Suppliers to multinational customers with anti-bribery supplier programmesOverseas customers ask suppliers for independent evidence of anti-bribery controls.
  • Firms in logistics, construction and energy with frequent official interfaces

Requirements

ISO 37001 requirements in Thailand

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In Thailand these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in Thailand?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Thailand these are the factors that set the timeline.

  • Maturity of the risk assessment for bribery exposure
  • Number of business associates needing due diligence
  • Existence of a working reporting channel

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in Thailand?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Thailand these factors move both.

  • Number of entities, jurisdictions and business associates
  • Controls over gifts, hospitality and donations to build
  • Certification body audit fees quoted separately from consulting

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in Thailand

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Thailand are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Lists eight internal control measures that can protect an entity from liability; the published page does not name ISO 37001.

Accreditation, audit language and remote audits in Thailand

Use a certification body accredited for ISO 37001 by a body within the international mutual recognition arrangements now run by Global ACI (Global Accreditation Cooperation Incorporated). The NSC scopes recorded for management systems do not list ISO 37001, so read the body's accreditation certificate. No body is named here. Edition and transition details: ISO 37001 hub →

    Audit language

Audits can be in English or Thai; the code of conduct and reporting channel should be in the language of those who use them.

    Remote and on-site

Interviews and document review can be partly remote at the certification body's discretion; sites and high-risk functions are sampled on site.

ISO 37001 in Thailand: questions clients ask

Does ISO 37001 protect a company under Thai anti-bribery law?

The NACC page says an entity with appropriate internal controls is not held liable under the provision it describes, and it does not name ISO 37001. A certified system is evidence of such controls but not a guarantee. Take your counsel's advice on how the law applies to you.

What internal control measures does the NACC list?

Eight: leadership commitment, risk assessment, controls over high-risk areas such as gifts, entertainment and donations, third-party management, accounting systems, alignment of HR practice, reporting mechanisms and regular review. ISO 37001 covers the same ground in management system form. Read the NACC's current page for its exact wording.

Which accreditation should an ISO 37001 certification body hold?

Anti-bribery management is outside the scopes recorded for the National Standardization Council, so a certification body's right to certify ISO 37001 depends on its own accreditation. The accreditation certificate should name the standard and come from a body within the international arrangements. Read it before accepting a quotation.

How does ISO 37001 deal with agents and distributors?

It requires due diligence on business associates and controls proportionate to the bribery risk they bring, which matches the NACC's measure on third-party management. For Thai companies using agents, distributors or contractors, that is often the heaviest part of the build. Contractual clauses and monitoring are normally agreed with your counsel.
