In short

ISO 45001 certification in Taiwan at a glance

Occupational Safety and Health Act, Article 23 requires ISO 45001 for the organisations it covers. Most Taiwanese buyers ask for it anyway.

Employers above a certain size in Taiwan have a legal reason to run a safety management system, and ISO 45001 is one recognised way to structure it. The Occupational Safety and Health Act requires employers reaching the scale set by the central authority, or operating the workplaces it lists, to establish an occupational safety and health management system, without naming a standard. The Ministry of Labor also runs its own voluntary scheme, TOSHMS, and the Taiwan Accreditation Foundation accredits certification bodies for both TOSHMS and ISO 45001. Certificates come from those accredited bodies, never from Sterling. Choosing between the two, or holding both, depends on what your customers and authorities ask for. Sterling builds the system for Taiwanese manufacturers, contractors and service operators from its Tokyo office, with 20+ years and 8,100+ client engagements in 60+ countries behind it and Effivity and Sterling Academy included with the engagement.

The need

Who needs ISO 45001 in Taiwan, and what happens without it

For some organisations in Taiwan it is a legal requirement. For most, the question comes from a buyer, a regulator or a partner that wants proof before it signs. These are the organisations that get asked.

  • Employers whose business reaches the scale set by the Ministry of LaborThe Occupational Safety and Health Act requires them to establish an occupational safety and health management system.
  • Employers with workplaces of the kind listed in Article 15 of the ActThey are also named as needing a management system.
  • Contractors on industrial and construction sitesSite owners and principal contractors ask for evidence of safety management before awarding work.
  • Exporters supplying global customersBuyers abroad look for ISO 45001 where Taiwan's own TOSHMS scheme is unfamiliar.

ISO 45001 requirements in Taiwan

Strip away the vocabulary and ISO 45001 requires a company to prove six things about keeping its people safe and healthy at work.

Leadership takes responsibility for safetyTop management is accountable for preventing work-related injury and ill health, and sets a policy and objectives to do so.
Workers have a real sayWorkers and their representatives are consulted and take part in decisions on hazards, controls, incidents and the system itself.
You know the hazards and the risksHazards are identified on an ongoing basis, risks are assessed, and health and safety legal requirements are known and met.
Controls follow the right orderRisks are reduced using the hierarchy of controls, from eliminating the hazard down to protective equipment, including for contractors.
You are prepared for emergenciesEmergency situations are identified, response plans are in place, people are trained and drills are carried out.
Incidents lead to learningIncidents and nonconformities are investigated, causes are corrected, and performance is monitored, audited and reviewed.

In Taiwan these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 45001 explained →

Time

How long does ISO 45001 certification take in Taiwan?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Taiwan these are the factors that set the timeline.

  • Number of sites, hazardous activities and shifts in scope
  • Incident and legal compliance history
  • Contractor and visitor controls
  • Choice between ISO 45001 and TOSHMS, or both

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 45001 certification cost in Taiwan?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Taiwan these factors move both.

  • Number of workers and sites in scope
  • Hazard profile and contractor numbers
  • Certification body audit fees quoted separately from consulting
  • Equipment and monitoring upgrades found by the risk assessment

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 45001 consultants and certification bodies in Taiwan

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 45001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Taiwan are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Developed by the Occupational Safety and Health Administration of the Ministry of Labor as a voluntary system, with TAF accrediting TOSHMS certification bodies under a joint programme.
TAF accreditation scheme for occupational safety and health certification bodiesAccreditation
TAF lists both ISO 45001 and TOSHMS certification among its management system schemes.

Accreditation, audit language and remote audits in Taiwan

Use a certification body accredited for this standard by the Taiwan Accreditation Foundation (TAF) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. TAF's published scheme for management system certification bodies names this standard. TAF also accredits certification bodies for the Ministry of Labor's TOSHMS scheme, so confirm which scheme your customer or authority expects. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 45001 hub →

Audit language

Mandarin Chinese is the working language of most organisations in Taiwan and the Chinese text of a statute prevails over its English version; agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a tender or customer contract.

Remote and on-site

Document review and some interviews can run remotely at the certification body's discretion; production floors, laboratories and service sites in scope are normally visited on-site.

ISO 45001 in Taiwan: questions clients ask

Does Taiwan law require an occupational safety and health management system?

For employers at a certain scale, yes. The Occupational Safety and Health Act requires employers whose business reaches the scale set by the central competent authority, or that have workplaces of the kind listed in the Act, to establish an occupational safety and health management system. It does not name ISO 45001. Confirm whether your business is covered with your counsel or the Ministry of Labor.

What is TOSHMS and how does it differ from ISO 45001?

TOSHMS is Taiwan's own occupational safety and health management system, developed by the Ministry of Labor's Occupational Safety and Health Administration as a voluntary scheme, while ISO 45001 is the international standard. TAF accredits certification bodies for both. Ask your customer or authority which it expects, and whether a certification body can cover both.

Who accredits ISO 45001 certification bodies in Taiwan?

The Taiwan Accreditation Foundation lists ISO 45001 certification among the schemes it accredits, alongside TOSHMS. A body accredited by another accreditation body within the international mutual recognition arrangements is also an option. Check the written accreditation scope covers ISO 45001 and your industry, since hazardous sectors are often assessed by auditors with matching experience.

Is an ISO 45001 certificate evidence of legal compliance?

Not on its own. A certificate shows that a certification body found your management system meets the standard, whereas the Occupational Safety and Health Act sets legal duties that the Ministry of Labor and its inspectors enforce. Keep a legal register alongside the system, and ask your counsel to confirm the duties that apply to your workplaces.
