ISO 37301 certification in Switzerland at a glance

Two Swiss instruments bear on ISO 37301. Not one of them names it. So why do buyers in Switzerland keep asking for the certificate?

A Swiss company can be held responsible for what its organisation failed to prevent. The Criminal Code penalises an undertaking where it failed to take all the reasonable organisational measures required to prevent listed offences, and FINMA Circular 2023/1 sets governance expectations for operational risk in banks. The Public Procurement Act has authorities act against conflicts of interest and unlawful agreements affecting competition, while the revised FADP adds a detailed set of data duties. ISO 37301 is not named in these texts, yet it gives the organisation a management system for identifying compliance obligations, assigning owners, monitoring and improving. The certificate is voluntary and is issued by a certification body, preferably one accredited by the Swiss Accreditation Service, not by Sterling. Sterling's Frankfurt office helps Swiss organisations build the obligations register, controls, monitoring and speak-up processes, drawing on 20+ years of experience, with Effivity software and Sterling Academy training included with the engagement.

The need

Who needs ISO 37301 in Switzerland, and what happens without it

In Switzerland the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Swiss undertakings exposed to criminal organisational liabilityThe Criminal Code expects all reasonable organisational measures to prevent listed offences.
  • Banks, insurers and other regulated firmsFINMA Circular 2023/1 sets governance expectations on operational risk for banks, and the Information Security Act brings reporting duties for banks, insurers and others.
  • Suppliers to public buyersContracting authorities must act against conflicts of interest and unlawful agreements affecting competition.
  • Organisations handling personal dataThe FADP's duties, from records of processing to breach notification, are compliance obligations that a management system can track.

ISO 37301 requirements in Switzerland

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.

You know your obligationsObligations from laws, regulators, contracts and voluntary commitments are identified and kept current.
The governing body and management leadThe governing body and top management set the compliance policy and support a culture in which compliance is expected.
A compliance function has authorityA compliance function is resourced, independent enough to act and has direct access to the governing body.
Compliance risks are assessedRisks of failing to meet obligations are assessed, and controls are designed in proportion to them.
Concerns are raised and handledPeople can raise concerns without fear of retaliation, and suspected breaches are investigated and corrected.
You monitor and reportCompliance performance is monitored, reported to leadership, audited and reviewed so the system improves.

In Switzerland these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How Sterling gets a Swiss company certified

How to get ISO 37301 certified in Switzerland

One team from the Frankfurt office carries the work from scoping to certificate. Clients across Switzerland are served from Sterling's Frankfurt office, on-site where the work needs it and remotely otherwise.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against ISO 37301 and the Swiss requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
    3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
    4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
    5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.

      Time

How long does ISO 37301 certification take in Switzerland?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Switzerland these are the factors that set the timeline.

      • Number of legal entities, jurisdictions and regimes in scope
      • Maturity of the compliance obligations register
      • Monitoring, audit and issue-management evidence
      • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does ISO 37301 certification cost in Switzerland?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Switzerland these factors move both.

      • Breadth of regulatory regimes covered
      • Effort to build controls and monitoring
      • Certification body fees quoted separately from consulting
      • Training across management and exposed roles

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

ISO 37301 consultants and certification bodies in Switzerland

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Switzerland are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in Switzerland

Use a certification body accredited for this standard by the Swiss Accreditation Service (SAS) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37301 hub →

          Audit language

German, French, Italian and English are all used in Swiss business; agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a tender, a regulator's correspondence or a customer contract.

          Remote and on-site

Obligations register and policy reviews can be remote at the certification body's discretion; interviews with management and compliance functions are often held on-site.

ISO 37301 in Switzerland: questions clients ask

Is ISO 37301 required for Swiss companies?

No. The Criminal Code asks undertakings to take all reasonable organisational measures against listed offences, and it does not name ISO 37301. The standard is a recognised way to organise a compliance management system. Whether it suffices in a given case is for a court and your counsel to judge.

Does ISO 37301 meet FINMA's expectations for banks?

FINMA Circular 2023/1 does not name it. The circular sets governance expectations for operational risk, and a compliance management system may support evidence against some of them. FINMA's view of any particular institution is for FINMA to give, so engage with it or your external adviser.

Can ISO 37301 help with public tenders in Switzerland?

It may help where a tender values compliance. The Public Procurement Act requires authorities to act against conflicts of interest, unlawful agreements affecting competition and corruption, and tenders set their own criteria. A certified system is not a stated condition, so check the tender documents.

What is the difference between ISO 37301 and ISO 37001 for a Swiss firm?

ISO 37301 covers compliance obligations of any kind, from data protection to product rules, while ISO 37001 focuses on bribery. Swiss firms with corruption exposure often choose both or start with the one that matches the risk. The certification bodies assess them separately, each with its own scope.
