ISO 42001 certification in Spain at a glance
One Spanish instrument bears on ISO/IEC 42001. It does not name the standard. So why do buyers in Spain keep asking for the certificate?
Spain has a dedicated AI supervisor, the Agencia Española de Supervisión de Inteligencia Artificial, seated in A Coruña, whose statute in Real Decreto 729/2023 gives it supervision, advice, awareness and training roles, with inspection and sanction functions under European rules. The EU AI Act it will apply requires providers of high-risk systems to establish a risk management system and a documented quality management system. Neither text names ISO/IEC 42001, which is the management system standard for AI: policy, roles, risk and impact assessment, data and lifecycle controls and supplier management. It is not an AI Act conformity assessment. Certification comes from a body accredited by ENAC or another body within the international recognition arrangements, not from Sterling. Sterling's Enschede office inventories AI use, runs impact assessments and integrates controls with existing ISO/IEC 27001 and privacy work for Spanish clients.
Who needs ISO 42001 in Spain, and what happens without it
In Spain the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Providers of high-risk AI systemsThe AI Act requires a risk management system and a quality management system, documented in policies, procedures and instructions.
- Spanish software and data companies building AI into productsCustomers and regulators ask how AI risks are governed and who is accountable.
- Organisations deploying AI in HR, finance or customer processesDeployers carry AI Act obligations and GDPR duties supervised by the AEPD.

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.
In Spain these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

How long does ISO 42001 certification take in Spain?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Spain these are the factors that set the timeline.
- Number of AI systems and use cases in scope
- Maturity of the AI inventory and impact assessments
- Supplier and model provider controls
- Time to show internal audit and management review
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 42001 certification cost in Spain?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Spain these factors move both.
- Number of AI systems and business units
- Depth of impact assessments
- Integration with ISO/IEC 27001 and ISO/IEC 27701
- Certification body fees quoted separately from consulting
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 42001 consultants and certification bodies in Spain
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Spain are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 42001 in Spain (3)
| Instrument | How it treats the standard |
|---|---|
| EU Artificial Intelligence Act (Regulation (EU) 2024/1689) | Expected in practice Providers of high-risk AI systems must establish a risk management system and put a documented quality management system in place; ISO/IEC 42001 is not named in the text. |
| AESIA — Agencia Española de Supervisión de Inteligencia Artificial (Real Decreto 729/2023) | Regulator Carries out supervision, advice, awareness and training for public and private entities on the use and development of AI systems, with inspection and sanction functions under European rules; seated in A Coruña; ISO/IEC 42001 is not named. |
| ENAC — national accreditation body for certification bodies | Market driver Accredited certification is available through ENAC, designated by Real Decreto 1715/2010 as Spain's national accreditation body; no mandate. |
"Expected in practice" means the instrument asks for the outcomes ISO/IEC 42001 covers without naming a standard, and ISO/IEC 42001 is what buyers and regulators commonly accept as evidence of them.
Accreditation, audit language and remote audits in Spain
Use a certification body accredited for this standard by ENAC (Entidad Nacional de Acreditación, Spain's national accreditation body) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. Audit language
Audits run in Spanish or English by agreement with the certification body; confirm the language of the audit, the certificate and controlled documents at application, and follow any tender or contract clause.
Remote and on-site
Remote audit elements are at the certification body's discretion; model development, data handling and human oversight processes are reviewed in context.
ISO 42001 in Spain: questions clients ask
Does ISO 42001 make an AI system compliant with the AI Act?
No. The AI Act does not name ISO/IEC 42001, and certification to a management system standard is not a conformity assessment under the Act. The Act requires providers of high-risk systems to have a risk management system and a quality management system. The standard can structure that work. Ask your counsel what applies to your system.
Which Spanish authority supervises AI?
The Agencia Española de Supervisión de Inteligencia Artificial (AESIA), seated in A Coruña under Real Decreto 729/2023. Its statute gives it supervision, advice, awareness and training tasks for public and private entities, plus inspection and sanction functions under European rules, without prejudice to the health ministry, AEMPS and labour inspectorate in their areas.
What does the AI Act require of a provider's quality management system?
Article 17 says providers of high-risk AI systems shall put a quality management system in place that ensures compliance, documented in written policies, procedures and instructions, covering at least a strategy for regulatory compliance and techniques for design, design control and design verification. Article 9 separately requires a risk management system. Confirm your classification with counsel.
Which accreditation should an ISO 42001 certification body hold in Spain?
Accreditation from ENAC, Spain's national accreditation body under Real Decreto 1715/2010, or from another body within the international recognition arrangements. Accreditation is granted by scope, so ask the certification body to show that AI management systems are within its scope before you commit.
