ISO 27701 certification in Spain at a glance
In Spain, ISO/IEC 27701 is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.
Spain's data protection law does not name ISO/IEC 27701, yet organisations still use it, because the standard turns GDPR duties into a documented, auditable system. The Agencia Española de Protección de Datos supervises the GDPR under Ley Orgánica 3/2018, which also lists the entities, from credit institutions to health centres, that must always appoint a data protection officer. Separately, the AEPD and ENAC have published a convenio on accrediting bodies that certify under Article 42 of the GDPR, a different mechanism from ISO/IEC 27701. Certification to the standard comes from a certification body accredited by ENAC or another body within the international recognition arrangements, not from Sterling, and it does not prove legal compliance. Sterling's Enschede office extends existing ISO/IEC 27001 systems with the privacy controls, builds records and procedures, and prepares for the audit, with Effivity and Sterling Academy included with the engagement.
Who needs ISO 27701 in Spain, and what happens without it
In Spain the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Controllers and processors that must show structured privacy managementThe AEPD supervises the GDPR under Ley Orgánica 3/2018, and a privacy information management system gives a documented method for meeting it.
- Entities that must appoint a data protection officerCredit institutions, insurers, health centres and the other listed entities need a working programme for the officer to oversee.
- SaaS and outsourcing processors serving Spanish controllersControllers ask processors for evidence of how personal data are managed on their behalf.
- Organisations that already hold ISO/IEC 27001The privacy standard extends an existing information security system rather than starting again.

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.
In Spain these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

How long does ISO 27701 certification take in Spain?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Spain these are the factors that set the timeline.
- Number of processing activities and systems in scope
- Existing ISO/IEC 27001 system and its maturity
- Processor and transfer arrangements to document
- Time to show internal audit and management review
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 27701 certification cost in Spain?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Spain these factors move both.
- Scope of entities and data flows
- Privacy documentation and rights-handling procedures to build
- Integration with the security system
- Certification body fees quoted separately from consulting
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 27701 consultants and certification bodies in Spain
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Spain are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Audit language
Audits run in Spanish or English by agreement with the certification body; confirm the language of the audit, the certificate and controlled documents at application, and follow any tender or contract clause.
Remote and on-site
Remote audit elements are at the certification body's discretion; sites handling personal data are normally visited and processes observed.
ISO 27701 in Spain: questions clients ask
Does ISO 27701 certification prove GDPR compliance in Spain?
No. The GDPR and Ley Orgánica 3/2018 set the legal duties, the AEPD supervises them, and neither names ISO/IEC 27701. A certificate shows that an accredited body audited your privacy information management system against the standard. It can support your evidence but does not settle compliance, so confirm your position with counsel or the AEPD.
Is ISO 27701 the same as GDPR Article 42 certification?
No. The AEPD and ENAC published a convenio on accrediting bodies that certify under Article 42 of the GDPR, which is a mechanism set up by the Regulation itself. ISO/IEC 27701 is an international management system standard certified by accredited certification bodies. They are different routes, and whether either suits you is a matter for your counsel.
Which Spanish authority supervises privacy compliance?
The Agencia Española de Protección de Datos, an independent administrative authority at State level under Ley Orgánica 3/2018. Regional authorities may act for the public sector of their autonomous community. A certification body assesses your management system against the standard, but it is not a supervisor and does not replace the AEPD.
Which accreditation should an ISO 27701 certification body hold?
Accreditation from ENAC, designated by Real Decreto 1715/2010 as Spain's national accreditation body, or from another body within the international mutual recognition arrangements. Ask the certification body to show that its scope covers privacy information management, because accreditation is granted scope by scope.
