In short

ISO 27701 certification in South Korea at a glance

European Commission adequacy decisions refers to ISO/IEC 27701, yet none of the South Korean instruments checked makes it compulsory. Buyers in South Korea ask for it anyway.

Privacy management in South Korea rests on the Personal Information Protection Act, enforced by the Personal Information Protection Commission under the Prime Minister. The Act sets principles and lawful bases, requires a document and supervision where processing is entrusted, and lists the permitted bases for cross-border transfer. ISMS-P, operated by KISA, is the national integrated certification, and the European Commission's adequacy list includes the Republic of Korea. ISO/IEC 27701 is the international extension that adds privacy controls to ISO/IEC 27001, and the Korea Accreditation Board's scheme list does not show it, so buyers should ask which accreditation backs a certificate. Controllers, processors and exporters of data are typical applicants. Sterling's Tokyo office prepares the privacy information management system, records of processing and transfer evidence, with Effivity and Sterling Academy included with the engagement. Sterling does not certify.

The need

Who needs ISO 27701 in South Korea, and what happens without it

In South Korea the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Controllers handling customer personal informationThe Personal Information Protection Act sets principles and bases for collection and use that a privacy information management system can organise.
  • Processors and outsourced service providersArticle 26 requires a document when processing is entrusted, and the controller educates and supervises the person entrusted.
  • Exporters of data to overseas group companiesArticle 28-8 sets the permitted bases for cross-border transfer, and records of each basis are part of the evidence.
  • Companies exposed to the EU marketThe European Commission's adequacy list includes the Republic of Korea, which shapes how EU partners ask about transfers.

Requirements

ISO 27701 requirements in South Korea

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In South Korea these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

Time

How long does ISO 27701 certification take in South Korea?

There is no standard duration: it depends on your scope and on how much of the system already runs. In South Korea these are the factors that set the timeline.

  • Number of processing activities, systems and sites in scope
  • Existing ISO/IEC 27001 or ISMS-P certification
  • Records of processing and transfer bases
  • Certification body scheduling around the Seollal and Chuseok holiday periods

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in South Korea?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In South Korea these factors move both.

  • Number of processing activities and systems
  • Privacy documentation and training
  • Certification body audit fees quoted separately from consulting
  • Integration with ISO/IEC 27001 work

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in South Korea

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in South Korea are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in South Korea

Use a certification body accredited for ISO/IEC 27701 by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). The Korea Accreditation Board's published scheme list does not show ISO/IEC 27701, so ask the body which accreditation its certificates rest on and check the scope. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

Agree the audit language and the language of privacy notices and records with the certification body at application; Korean is the language of data subject communications.

    Remote and on-site

Remote audit elements are at the certification body's discretion; processing sites in scope are normally visited on-site.

ISO 27701 in South Korea: questions clients ask

Does ISO/IEC 27701 certification show compliance with PIPA?

No. The Personal Information Protection Act is a law enforced by the Personal Information Protection Commission, and ISO/IEC 27701 is a voluntary management-system standard. It can organise the records, roles and controls that support compliance, but only the regulator or a court can say whether the Act is met, so confirm scope with counsel.

    How is ISO/IEC 27701 different from ISMS-P?

ISMS-P is a national integrated certification of personal information and information security management, operated by KISA under policy set by MSIT and the PIPC. ISO/IEC 27701 is an international extension to ISO/IEC 27001. They overlap in content but are separate applications to separate bodies, so choose by what your customers and regulator ask for.

Who accredits certification bodies for ISO/IEC 27701?

KAB's published scheme list carries ISO 27001 yet omits ISO/IEC 27701. A Korean buyer can therefore ask a certification body to name the accreditation covering this extension, then read the scope in that accreditor's directory. For customers overseas, an accreditor inside the international arrangements is the reference worth printing on the certificate.

Does EU adequacy remove the need for transfer records?

Adequacy lets personal data flow from the EU to Korea under the Commission's decision, but Article 28-8 of the Korean Act still sets the bases for sending personal information abroad from Korea. Keep a record of the basis for each outbound transfer, and check the detail with counsel or the regulator.
