In short

ISO 27701 certification in Poland at a glance

In Poland, ISO/IEC 27701 is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.

ISO/IEC 27701 turns privacy compliance from a collection of documents into a managed system, and in Poland it sits next to a statutory certification route of its own. The Act of 10 May 2018 makes the President of the UODO the GDPR supervisory authority, provides for GDPR certification under Art. 42 by the President or by certifying bodies accredited by the Polish Centre for Accreditation, and requires designations of data protection officers to be notified to the Office. ISO/IEC 27701 is none of those: it is an ISO management-system certificate issued by an accredited certification body, building on ISO/IEC 27001, and it does not itself prove compliance. Processors such as BPO, shared-service and IT providers are the main audience, because clients want assurance beyond a contract. Sterling's Frankfurt office extends the information security system to cover privacy roles, records, rights handling and transfers, serving Polish clients on-site where needed, with Effivity and Sterling Academy included.

The need

Who needs ISO 27701 in Poland, and what happens without it

In Poland the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Controllers and processors seeking a structured privacy management systemThe GDPR is supervised by the President of the UODO, and a management system gives repeatable evidence.
  • BPO, shared-service and IT providers acting as processorsOverseas and domestic clients ask for processor assurance beyond the contract.
  • Organisations that must designate a data protection officerAn officer needs a documented system to oversee, and the designation is notified to the UODO.
  • Companies that already hold ISO/IEC 27001A privacy extension builds on the existing information security system.

Requirements

ISO 27701 requirements in Poland

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In Poland these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

Time

How long does ISO 27701 certification take in Poland?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Poland these are the factors that set the timeline.

  • Processing activities, systems and entities in scope
  • State of the ISO/IEC 27001 system it extends
  • Processor, joint-controller and transfer arrangements
  • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in Poland?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Poland these factors move both.

  • Number of entities and processing activities
  • Privacy impact assessment and records work
  • Certification body audit fees quoted separately from consulting
  • Integration with ISO/IEC 27001 audits

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in Poland

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Poland are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 27701 in Poland (3)

    InstrumentHow it treats the standard
Regulation (EU) 2016/679 with the Polish Act of 10 May 2018, Art. 34Related
The President of the UODO supervises the GDPR; ISO/IEC 27701 is not named and does not itself prove GDPR compliance.
Polish Act, Art. 12 to 15 (GDPR certification)Related
Art. 42 GDPR certification is carried out by the President of the UODO or by a certifying body accredited by the Polish Centre for Accreditation; this is separate from an ISO/IEC 27701 certificate.
Polskie Centrum Akredytacji (PCA) — national accreditation bodyMarket driver
Accredited management-system certification is available through the national accreditation body; no mandate.

Accreditation, audit language and remote audits in Poland

Use a certification body accredited for ISO/IEC 27701 by the Polish Centre for Accreditation (PCA) or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. ISO/IEC 27701 is not GDPR certification under Art. 42, which has its own route. Audit language

Audits are held in Polish or English; agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a tender or contract.

    Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 27701 in Poland: questions clients ask

Is ISO 27701 the same as GDPR certification in Poland?

No. Under the Polish Act, GDPR certification under Art. 42 is carried out by the President of the UODO or by a certifying body accredited by the Polish Centre for Accreditation. ISO/IEC 27701 is a privacy management-system certificate from an accredited certification body, separate from that route. Ask your counsel which assurance your customers and regulators will accept.

Does ISO 27701 prove compliance with the GDPR?

No. The UODO supervises compliance, and the Polish Act does not mention ISO/IEC 27701. The certificate shows that you run a documented privacy management system, which is useful evidence of how you manage processing, rights and security. It does not decide whether you meet the law, so keep your records of processing, notices and contracts current.

Must we notify the UODO when we designate a data protection officer?

Yes, under the Polish Act the designating entity informs the President of the Office, supplying the officer's name plus an e-mail address or telephone number, and publishes contact details so people can reach the officer. A privacy management system is a natural home for the officer's role, reporting line and records. Check the notification channel on the UODO's website.

Who accredits ISO 27701 certification bodies in Poland?

The Polskie Centrum Akredytacji (PCA), the national accreditation body for Poland, which says it is a full signatory to the EA and Global ACI arrangements. Accreditation is granted per scope, so ask the certification body to show that ISO/IEC 27701 is inside its PCA scope, and check how it audits the ISO/IEC 27001 base.
