In short

Nepal Privacy Act, 2075 (2018) compliance in Nepal at a glance

Privacy Act, 2075 (2018) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Nepal ask for evidence that you meet it.

Consent sits at the centre of Nepal's privacy law. The Privacy Act, 2075 (2018), in force with the Individual Privacy Regulations, 2077, requires consent when personal or family data is collected, confines bodies corporate to the purpose of collection, and forbids passing on health, income, employment, family, biometric, signature, political or transaction details without the person's agreement. The Regulations add security for electronic records, notice before collection and a permission regime for CCTV at business premises run by the District Administration Office. No data protection authority exists; people complain to the District Court and the Government of Nepal prosecutes listed offences. Sterling's Mumbai office maps personal data, rewrites notices and consent flows, sets security and CCTV controls, and trains staff, with Effivity keeping evidence current and Sterling Academy included with the engagement.

      Time

How long does Nepal Privacy Act, 2075 (2018) compliance take in Nepal?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Nepal these are the factors that set the timeline.

      • Number of processing activities, systems and locations to map
      • CCTV installations needing permission or signage
      • Consent and notice redesign across channels
      • Staff training across sites

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does Nepal Privacy Act, 2075 (2018) compliance cost in Nepal?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Nepal these factors move both.

      • Number of legal entities and business units in scope
      • Volume and sensitivity of personal data held
      • Security control remediation for electronic records
      • Legal review of notices and contracts

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

Nepal Privacy Act, 2075 (2018) consultants and assessors in Nepal

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers Nepal Privacy Act, 2075 (2018) and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Nepal are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Consent for use of electronic personal information, confidential and secure storage, notice before collection, purpose limits, and CCTV permission from the District Administration Office with secure footage handling.

Accreditation, audit language and remote audits in Nepal

Compliance, not certification: the Privacy Act, 2075 (2018) and the Individual Privacy Regulations, 2077 create no certificate. Evidence is consent records, notices given before collection, purpose controls, restrictions on disclosing listed details, security for electronic records and CCTV permissions from the District Administration Office. ISO/IEC 27701 certification by an accredited body is an optional way to evidence a privacy information management system. Edition and transition details: Nepal Privacy Act, 2075 (2018) hub →

          Audit language

Most Nepali laws and official notices are issued in Nepali, and the Nepal Law Commission publishes English translations of many Acts, including the Privacy Act. Agree the audit language, any interpreter and the language of controlled documents with the certification body at application.

          Remote and on-site

Data mapping, notice reviews and training can be on-site or remote; CCTV and records checks are best done at the premises. The Act prescribes no external assessment.

Nepal Privacy Act, 2075 (2018) in Nepal: questions clients ask

Does Nepal have a privacy regulator?

No separate authority is set up by the Privacy Act, 2075 (2018). A person may complain to the concerned District Court and seek compensation, the Government of Nepal is plaintiff for the offences the Act lists, and public bodies must protect information they hold. Ask your counsel how enforcement would work for your sector.

Do we need consent to collect customer data in Nepal?

Yes, as a rule. The Act requires consent when collecting personal or family data and limits a body corporate to using it for the purpose of collection, and the 2077 Regulations require people to be told how their data will be used before it is gathered. Exceptions exist for investigations and court orders, so have counsel review your notices.

Does a shop or hotel need permission to install CCTV?

Business premises do. Under the 2077 Regulations, banks, financial institutions, shopping malls, hotels, industries and similar places apply to the District Administration Office for permission, keep footage confidential and secure, and must not publish it or use it commercially. Cameras are never allowed in toilets, bathrooms or changing rooms. Confirm local practice with the Office.

Is there a certificate that proves Privacy Act compliance?

No. The Act and Regulations create no certification. Compliance is shown by consent records, notices, purpose controls, security measures and CCTV permissions. ISO/IEC 27701 certification by an accredited body is an optional way to evidence a privacy information management system that supports those duties.
