ISO 42001 certification in Mexico at a glance
Ley Federal de Protección de Datos Personales en Posesión de los Particulares (2025) refers to ISO/IEC 42001, yet none of the Mexican instruments checked makes it compulsory. Buyers in Mexico ask for it anyway.
Mexico's data protection law does not mention artificial intelligence by name, yet it already reaches some AI uses: a person may object when automated processing, without human intervention, produces unwanted legal effects or significantly affects them and is meant to evaluate things like economic situation, reliability or behaviour. Its principles of proportionality, data quality and security also apply to the personal data that trains and feeds models. ISO/IEC 42001 gives organisations a certifiable management system for governing such systems, with inventory, impact assessment, testing, oversight and incident processes. Accreditation deserves a question to every certification body, since the Mexican accreditation entity has no Global ACI listing for this newer standard. Sterling's New York office helps lenders, BPO and software firms and healthcare organisations scope AI systems, document controls and prepare for certification, with Effivity and Sterling Academy included. The certificate comes from the accredited body, not Sterling.
Who needs ISO 42001 in Mexico, and what happens without it
In Mexico the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Companies using automated decisions that affect individualsThe data protection law gives people a right to object to automated processing that produces unwanted legal effects or significantly affects them without human intervention.
- Banks, lenders and fintechs scoring customersCredit and fraud models evaluate financial reliability and behaviour, the kind of automated evaluation the law addresses.
- BPO and software firms building AI features for overseas clientsCustomers ask providers how AI systems are governed, tested and monitored.
- Healthcare and medical device organisations using AIHealth data is sensitive under the law and product claims need controlled development.

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.
In Mexico these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

How long does ISO 42001 certification take in Mexico?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Mexico these are the factors that set the timeline.
- Inventory of AI systems and their intended use
- Impact assessment, data quality and testing evidence
- Oversight, monitoring and incident processes for AI systems
- Certification body scheduling
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 42001 certification cost in Mexico?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Mexico these factors move both.
- Number of AI systems and use cases in scope
- Testing, monitoring and documentation tooling
- Certification body audit fees, quoted separately from consulting
- Training for developers, reviewers and business owners
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 42001 consultants and certification bodies in Mexico
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Mexico are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 42001 in Mexico (3)
| Instrument | How it treats the standard |
|---|---|
| Ley Federal de Protección de Datos Personales en Posesión de los Particulares (2025) — right to object to automated processing | Refers to / expects A person may object where automated processing, without human intervention, produces unwanted legal effects or significantly affects their interests, and is meant to evaluate or predict aspects such as professional performance, economic situation, health, reliability or behaviour; the law does not name ISO/IEC 42001. |
| Ley Federal de Protección de Datos Personales en Posesión de los Particulares (2025) — principles and security | Context Proportionality, quality of data and security measures apply to personal data used to train or run AI systems. |
| Entidad Mexicana de Acreditación (EMA) recognition entries on Global ACI | Accreditation Global ACI's entry for EMA does not list ISO/IEC 42001, a newer standard, among its management-system entries, so ask the certification body which accreditation backs an AI management certificate. |
Accreditation, audit language and remote audits in Mexico
Use a certification body accredited for ISO/IEC 42001 by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Global ACI's entry for the Entidad Mexicana de Acreditación does not list ISO/IEC 42001, so ask each body which accreditation backs the certificate and whether your customer accepts it. The certificate does not show compliance with any law. The certification body decides, not Sterling. Edition and transition details: ISO/IEC 42001 hub →
Audit language
Spanish is the usual language of Mexican law, tenders and regulatory filings, while audits for exporters and multinationals often run in English or in both languages; agree the audit language, any interpreter and the language of controlled documents with the certification body at application.
Remote and on-site
Remote audit elements are at the certification body's discretion; development and operations teams can be interviewed remotely, while model governance records, testing evidence and data handling are reviewed in detail.
ISO 42001 in Mexico: questions clients ask
Does Mexican law regulate artificial intelligence?
The data protection law does not mention AI by name, but it gives people a right to object to automated processing, without human intervention, that produces unwanted legal effects or significantly affects them, and its principles apply to training data. Other Mexican rules may exist or follow; confirm the current position with your counsel before relying on this answer.
Is ISO 42001 certification available in Mexico?
Possibly, through a foreign-accredited route. Global ACI shows nothing for ISO/IEC 42001 under the Entidad Mexicana de Acreditación, being a newer standard. A certification body accredited by another member of the arrangements may offer it. Obtain the accreditation certificate and scope and confirm your customer accepts it.
What does the right to object to automated processing mean for a lender?
If a model, with no human involved, evaluates someone's economic situation or reliability and the result has unwanted legal effects or significantly affects them, the person can object, subject to exceptions such as a legal obligation. Lenders should know where such models are used and how people can reach a human reviewer. Take legal advice on scope.
Should an AI management system sit alongside ISO 27001?
Often yes, because AI systems depend on secure data, access control and change management, which an information security system already covers. Your inventory of AI systems and the testing evidence you hold are the main timeline drivers. Plan one programme with shared controls, and ask the certification body how it would audit both.
