In short

ISO 37301 certification in Japan at a glance

Two Japanese instruments bear on ISO 37301. Not one of them names it. So why do buyers in Japan keep asking for the certificate?

Compliance obligations in a Japanese company rarely come from one statute. The APPI governs personal data, the Unfair Competition Prevention Act prohibits bribery of foreign public officials, the Installment Sales Act brings card-number protection duties to merchants, and the Industrial Safety and Health Act sets workplace duties, each with its own regulator. ISO 37301 provides a single management system for identifying those obligations, assessing compliance risk, assigning responsibility, monitoring and reporting, with the board's oversight built in. No Japanese instrument checked names the standard; organisations adopt it to show directors, overseas parents and business partners that compliance is managed systematically rather than law by law. Because ISO 37301 is a requirements standard, certification is available from an accredited certification body after stage 1 and stage 2 audits. Sterling's Tokyo office builds the obligations register and the controls around it, with Effivity and Sterling Academy included in the engagement.

The need

Who needs ISO 37301 in Japan, and what happens without it

In Japan the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Groups managing obligations under several Japanese lawsAPPI, the Installment Sales Act and the Unfair Competition Prevention Act each create compliance obligations.
  • Companies with overseas subsidiariesForeign-bribery and data-transfer rules extend obligations beyond Japan.
  • Organisations wanting one certifiable compliance frameworkISO 37301 offers a requirements standard for compliance management systems.

ISO 37301 requirements in Japan

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.

You know your obligationsObligations from laws, regulators, contracts and voluntary commitments are identified and kept current.
The governing body and management leadThe governing body and top management set the compliance policy and support a culture in which compliance is expected.
A compliance function has authorityA compliance function is resourced, independent enough to act and has direct access to the governing body.
Compliance risks are assessedRisks of failing to meet obligations are assessed, and controls are designed in proportion to them.
Concerns are raised and handledPeople can raise concerns without fear of retaliation, and suspected breaches are investigated and corrected.
You monitor and reportCompliance performance is monitored, reported to leadership, audited and reviewed so the system improves.

In Japan these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How Sterling gets a Japanese company certified

How to get ISO 37301 certified in Japan

One team from the Tokyo office carries the work from scoping to certificate. Nationwide from the Tokyo office, on-site where the scope requires; remote delivery for distributed teams.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against ISO 37301 and the Japanese requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
    3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
    4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.

      Time

How long does ISO 37301 certification take in Japan?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Japan these are the factors that set the timeline.

      • Breadth of the compliance obligations register
      • Number of entities and jurisdictions in scope
      • Evidence of compliance monitoring and reporting before stage 2

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does ISO 37301 certification cost in Japan?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Japan these factors move both.

      • Number of entities and jurisdictions
      • Certification body audit fees quoted separately from consulting
      • Compliance monitoring tooling and training reach

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

ISO 37301 consultants and certification bodies in Japan

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Japan are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37301 in Japan (3)

          InstrumentHow it treats the standard
Unfair Competition Prevention Act (Act No. 47 of 1993)Expected in practice
One of several statutory compliance obligations a compliance management system covers; ISO 37301 not named.
Act on the Protection of Personal Information (Act No. 57 of 2003)Expected in practice
Privacy obligations that sit inside a compliance obligations register; ISO 37301 not named.
Japan Accreditation Board (JAB) — accreditation of management-system certification bodiesMarket driver
Accredited certification for management-system standards is available through a Japanese accreditation body; no mandate.

"Expected in practice" means the instrument asks for the outcomes ISO 37301 covers without naming a standard, and ISO 37301 is what buyers and regulators commonly accept as evidence of them.

Accreditation, audit language and remote audits in Japan

Use a certification body accredited for this standard by JAB or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope in Japan has been verified. Edition and transition details: ISO 37301 hub →

          Audit language

Japanese or English; agree the audit and document language with the certification body at application (JIS Q editions of the standard are available in Japanese).

          Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 37301 in Japan: questions clients ask

Does any Japanese law require ISO 37301?

No. None of the instruments checked names ISO 37301. It is a way to organise obligations such as the APPI and the Unfair Competition Prevention Act inside one compliance management system. Treat it as a voluntary framework, and take legal advice on what those laws require of you.

          Can ISO 37301 be certified?

Yes. ISO 37301 is a requirements standard, so a certification body accredited for it can certify an organisation against it. The accreditation could come from JAB or from another body in the international mutual recognition arrangements. Ask the certification body for its accreditation scope first.

How does ISO 37301 relate to ISO 37001?

ISO 37001 deals with bribery, while ISO 37301 covers all of an organisation's compliance obligations, and the two can be integrated. A company already running an anti-bribery system can fold it into a wider compliance system rather than keep separate ones.
