In short

ISO 27701 certification in Germany at a glance

Two German instruments bear on ISO/IEC 27701. Not one of them names it. So why do buyers in Germany keep asking for the certificate?

Accountability under the GDPR is easier to demonstrate when privacy controls sit inside a management system the business already runs. In Germany that system has a specific audience: the state data protection authority that supervises the company under § 40 BDSG, and the data protection officer that § 38 BDSG requires once enough staff work permanently on automated processing. ISO/IEC 27701 extends an ISO/IEC 27001 information security management system with controller and processor controls, so records of processing, impact assessments, processor contracts and rights handling are planned, audited and reviewed like any other process. It does not certify GDPR compliance, and no German law names it; its value is external evidence for customers and a structure the DPO can monitor. Cloud and SaaS providers that already hold C5 attestations or ISO 27001 certificates are the most common candidates. Certification is by an accredited certification body. Sterling's Frankfurt office extends the existing ISMS rather than building a parallel privacy programme. Questions follow.

The need

Who needs ISO 27701 in Germany, and what happens without it

In Germany the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Processors serving German controllersControllers must be able to show that processors give sufficient guarantees; a certified PIMS is external evidence.
  • Companies required to appoint a data protection officerThe DPO needs a working privacy management system to monitor.
  • Cloud providers already holding C5 or ISO 27001ISO/IEC 27701 extends the existing ISMS to privacy.

Requirements

ISO 27701 requirements in Germany

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In Germany these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

How Sterling gets a German company certified

Time

How long does ISO 27701 certification take in Germany?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Germany these are the factors that set the timeline.

  • Existing ISO/IEC 27001 ISMS (required base)
  • Number of processing activities and controller/processor roles
  • Processor contract and transfer review

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in Germany?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Germany these factors move both.

  • Scope of the ISMS extended to privacy
  • Number of entities and states in scope
  • Certification body fees quoted separately from consulting

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in Germany

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Germany are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 27701 in Germany (3)

    InstrumentHow it treats the standard
Regulation (EU) 2016/679 (GDPR) with § 40 BDSG supervisionExpected in practice
Accountability and security of processing; ISO/IEC 27701 is not named.
§ 38 BDSG — data protection officers of non-public bodiesExpected in practice
The DPO's monitoring role is easier with a documented privacy management system.
DAkkS accreditation of management-system certification bodies (DIN EN ISO/IEC 17021-1)Market driver
Accredited certification is available through Germany's national accreditation body; no mandate.

"Expected in practice" means the instrument asks for the outcomes ISO/IEC 27701 covers without naming a standard, and ISO/IEC 27701 is what buyers and regulators commonly accept as evidence of them.

Accreditation, audit language and remote audits in Germany

Use a certification body accredited for this standard by DAkkS or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

Audits are held in German or English; agree the audit language and the language of controlled documents with the certification body at application.

    Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 27701 in Germany: questions clients ask

Does ISO 27701 certification prove GDPR compliance?

No. Certification is external evidence that you run a privacy management system; it is not proof of GDPR compliance. The GDPR expects accountability and security of processing and does not name ISO/IEC 27701. Compliance stays your responsibility, and counsel can advise on points of law.

Do we need ISO 27001 first?

In practice, yes, because ISO/IEC 27701 extends an ISO/IEC 27001 ISMS. The privacy requirements are added to an existing information security management system, so if you do not hold that base yet, plan to build it as part of the same project.

How does it help our data protection officer?

Under § 38 BDSG the officer monitors compliance, and a documented privacy management system gives that role something concrete to work with. ISO/IEC 27701 supplies such a system. Whether you must appoint a data protection officer at all is a separate question that § 38 BDSG answers.
