In short

ISO 37001 certification in France at a glance

Sapin II law, article 17 refers to ISO 37001, yet none of the French instruments checked makes it compulsory. Buyers in France ask for it anyway.

Anti-corruption compliance in France is organised by statute and regulator. Article 17 of the Sapin II law obliges entities within its scope to run a programme built on leadership commitment, risk mapping, a code of conduct, training, integrity assessment of third parties, an internal alert system, accounting and internal controls and a disciplinary regime, and the Agence française anticorruption advises and controls. The AFA document does not make an ISO certificate a requirement, so ISO 37001 is a voluntary, independently audited way to structure and evidence the same ground. It also helps suppliers who face integrity questionnaires from article 17 customers. Certificates come from certification bodies accredited by Cofrac; Sterling does not certify. Sterling's Enschede office builds the anti-bribery management system for clients in France, with Effivity and Sterling Academy included with the engagement.

The need

Who needs ISO 37001 in France, and what happens without it

In France the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Companies and groups subject to the Sapin II programme dutyArticle 17 requires an anti-corruption programme, controlled by the AFA.
  • Suppliers and intermediaries of Sapin II companiesThe programme includes integrity assessment of third parties, so customers question their partners.
  • Exporters and contractors working in higher-risk marketsCustomers and lenders ask for independent evidence of anti-bribery controls.
  • Organisations that already run whistleblowing channelsThe EU directive requires internal reporting channels, which an anti-bribery system builds on.

Requirements

ISO 37001 requirements in France

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In France these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in France?

There is no standard duration: it depends on your scope and on how much of the system already runs. In France these are the factors that set the timeline.

  • Corruption risk exposure by country and sector
  • Maturity of the existing article 17 programme
  • Number of entities and third parties
  • Due-diligence and gifts controls

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in France?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In France these factors move both.

  • Number of entities and high-risk relationships
  • Risk mapping and third-party due diligence
  • Training and communications
  • Certification-body audit effort

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in France

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in France are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in France

ISO 37001 certification is voluntary and comes from a certification body accredited by Cofrac for the standard. It does not replace the AFA's control of an article 17 programme; the AFA, not the certification body, controls Sapin II compliance. Edition and transition details: ISO 37001 hub →

    Audit language

French or English; the AFA works in French, and codes of conduct and alert procedures are normally in French.

    Remote and on-site

Document review can be remote; audits include interviews and sampling of high-risk transactions, mostly on-site.

ISO 37001 in France: questions clients ask

Does the Sapin II law require ISO 37001?

No. Article 17 requires entities within its scope to put in place an anti-corruption programme, and the AFA advises and controls it, but the AFA document does not make an ISO certificate a requirement. ISO 37001 is a voluntary way to structure and evidence that work. Ask your counsel whether article 17 applies to you.

What must an article 17 programme contain?

The AFA's document lists leadership commitment, a map of corruption risks, a code of conduct, training for exposed staff, integrity assessment of clients, suppliers and intermediaries, an internal alert system, internal and accounting controls and a disciplinary regime. ISO 37001 covers much of this ground, but check the AFA's own guidance for what it expects.

Does an ISO 37001 certificate replace an AFA inspection?

No. The AFA is the controlling authority for article 17 programmes, and an ISO certificate from an accredited body does not take its place. The certificate can help you show that your anti-bribery management system has been independently audited, which supports your evidence, but the regulator makes its own assessment.

Will customers ask our business for anti-bribery evidence?

Quite possibly. Companies within article 17 must assess the integrity of clients, suppliers and intermediaries, so their suppliers receive due-diligence questionnaires. A certificate from an accredited body for ISO 37001 can answer many of those questions, though a customer may still ask for its own checks. Treat the questionnaire wording as the requirement.
