In short

ISO 37301 certification in Czechia at a glance

Act No. 418/2011 Coll. on the criminal liability of legal entities is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Czechia ask for evidence that you meet it.

Compliance management is one of the few standards in Czechia with a direct line to criminal law. Act No. 418/2011 Coll. relieves a legal entity of liability if it made every effort that could fairly be required to prevent the offence, and a documented compliance management system is the natural way to show effort. Act No. 171/2023 Coll. adds internal reporting systems for public contracting authorities and larger employers, with the Ministry of Justice involved in protection. Regulated businesses juggling cyber, financial, health and food duties, and Czech subsidiaries of foreign groups, use ISO 37301 to organise obligations, training and monitoring in one place. Neither Act names it, so treat the certificate as evidence rather than protection. Accredited bodies certify, not Sterling, and ČIA accredits them. Sterling's Frankfurt office builds the system, with Effivity and Sterling Academy included in the engagement.

The need

Who needs ISO 37301 in Czechia, and what happens without it

In Czechia the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Companies building a compliance management systemThe criminal liability Act rewards documented efforts to prevent offences by managers and staff.
  • Regulated businesses with several overlapping dutiesFinancial, health, food and cyber duties are easier to manage in one structure.
  • Public contracting authorities and larger employersThe whistleblower Act obliges them to run internal reporting systems.
  • Groups with Czech subsidiaries of foreign parentsParent companies roll out group compliance programmes to local entities.

ISO 37301 requirements in Czechia

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.

You know your obligationsObligations from laws, regulators, contracts and voluntary commitments are identified and kept current.
The governing body and management leadThe governing body and top management set the compliance policy and support a culture in which compliance is expected.
A compliance function has authorityA compliance function is resourced, independent enough to act and has direct access to the governing body.
Compliance risks are assessedRisks of failing to meet obligations are assessed, and controls are designed in proportion to them.
Concerns are raised and handledPeople can raise concerns without fear of retaliation, and suspected breaches are investigated and corrected.
You monitor and reportCompliance performance is monitored, reported to leadership, audited and reviewed so the system improves.

In Czechia these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How to get ISO 37301 certified in Czechia

One team from the Frankfurt office carries the work from scoping to certificate. Clients in Czechia are served from Sterling's Frankfurt office, on-site where the work needs it and remotely otherwise.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against ISO 37301 and the Czech requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.

      Time

How long does ISO 37301 certification take in Czechia?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Czechia these are the factors that set the timeline.

      • Compliance obligations register and risk assessment
      • Existing policies, training and monitoring
      • Reporting channel and case-handling arrangements
      • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does ISO 37301 certification cost in Czechia?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Czechia these factors move both.

      • Entities and obligations in scope
      • Policy, training and monitoring remediation
      • Certification body audit fees, quoted separately
      • Integration with other management systems

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

ISO 37301 consultants and certification bodies in Czechia

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Czechia are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37301 in Czechia (3)

          InstrumentHow it treats the standard
Act No. 418/2011 Coll. on the criminal liability of legal entitiesThe instrument itself
A legal entity is relieved of criminal liability if it made every effort that could fairly be required to prevent the offence, which is why documented compliance measures matter.
Act No. 171/2023 Coll. on the protection of whistleblowers (zákon o ochraně oznamovatelů)The instrument itself
The Act obliges public contracting authorities and larger employers to set up an internal reporting system and gives the Ministry of Justice a role in whistleblower protection.
ČIA (Český institut pro akreditaci, o.p.s.) as the Czech national accreditation bodyRecognition
ČIA describes itself as the national accreditation body founded by the Czech government, accrediting laboratories, inspection bodies and certification bodies for management systems, products and persons.

Accreditation, audit language and remote audits in Czechia

Choose a certification body accredited for this standard by ČIA, the Czech national accreditation body, or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. No body is named here. Edition and transition details: ISO 37301 hub →

          Audit language

Czech is the official language and English is commonly used in business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

          Remote and on-site

Audits are normally on-site with some remote review of obligations registers, training and case-handling records.

ISO 37301 in Czechia: questions clients ask

Is ISO 37301 required by Czech law?

Neither Act requires it. The criminal liability Act and the whistleblower Act set duties that a compliance management system can help meet, but neither names the standard. Certification is a voluntary way to evidence organised compliance. Ask counsel how the duties apply to your organisation and which evidence regulators or courts would consider.

What is the role of a compliance system under Act No. 418/2011 Coll.?

The Act relieves a legal entity of criminal liability if it made every effort that could fairly be required to prevent the offence. A compliance management system supplies the obligations register, risk assessment, training, controls and monitoring that show such effort. Whether the effort suffices in a case is decided by the courts, so seek legal advice.

Which employers must run internal reporting channels?

Public contracting authorities, subject to listed exceptions, and employers above a headcount threshold the Act sets, unless they are covered by anti-money-laundering rules. The Ministry of Justice has a role in protection. A compliance system can connect channel, triage, investigation and non-retaliation steps. Confirm applicability with counsel before relying on any exception.

Which accreditation should an ISO 37301 certificate carry?

Accreditation by ČIA or an equivalent body for management system certification. ČIA's own list names seven standards and ISO 37301 is not among them, so scope must be confirmed. Ask the certification body for its accreditation certificate and check that compliance management systems are covered before you sign an agreement.
