In short

ISO 37001 certification in Brazil at a glance

Law No. 12,846 of 1 August 2013 and Decree No. 11,129 of 11 July 2022 refers to ISO 37001, yet none of the Brazilian instruments checked makes it compulsory. Buyers in Brazil ask for it anyway.

Companies that sell to Brazilian public bodies, or depend on permits and inspections, work under the Anti-Corruption Law, which holds legal entities liable for acts against the public administration and weighs internal integrity, audit and whistleblowing mechanisms when sanctions are set. Decree No. 11,129 describes what an integrity programme is, and the tenders law requires one from the winners of very large contracts. None of these texts names ISO 37001, so the standard works as a recognisable framework rather than a legal safe harbour. Cgcre, Inmetro's accreditation coordination, runs a programme for anti-bribery certification bodies and is a Global ACI Full Member. Sterling's New York office helps build the risk assessment, due diligence, controls and reporting channels, and prepares internal audits, with Effivity and Sterling Academy included with the engagement.

The need

Who needs ISO 37001 in Brazil, and what happens without it

In Brazil the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Contractors and suppliers dealing with public bodiesLaw No. 12,846 makes companies liable for acts against the public administration and weighs integrity mechanisms when sanctions are set.
  • Bidders for very large public contractsThe tenders law requires the winner to implement an integrity programme, and having one counts as a tie-break and penalty factor.
  • Infrastructure, energy and construction groupsTheir work depends on permits, inspections and public contracts, where bribery risk concentrates.
  • Subsidiaries of multinationalsGroup anti-bribery policies need a certified local system to be credible.
  • Companies using agents, distributors and customs brokersThird-party intermediaries are a common route for improper payments.

Requirements

ISO 37001 requirements in Brazil

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In Brazil these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in Brazil?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Brazil these are the factors that set the timeline.

  • Number of countries, units and intermediaries in scope
  • Maturity of due diligence, gifts and conflict-of-interest controls
  • Investigation and whistleblowing evidence
  • Certification body availability

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in Brazil?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Brazil these factors move both.

  • Number of sites and third parties in scope
  • Due diligence tools and training
  • Certification body audit fees, quoted separately from consulting
  • Independent reviews of high-risk areas

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in Brazil

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Brazil are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37001 in Brazil (3)

    InstrumentHow it treats the standard
Law No. 12,846 of 1 August 2013 and Decree No. 11,129 of 11 July 2022Refers to / expects
The Law lists the existence of internal integrity, audit and whistleblowing mechanisms and the effective application of codes of ethics among the sanction factors, and the Decree defines an integrity programme; neither names ISO 37001.
Lei nº 14.133 of 1 April 2021 (new law on public tenders and administrative contracts)Refers to / expects
For very large contracts the notice must require the winning bidder to implement an integrity programme, and an integrity programme is a tie-break criterion and a factor in setting penalties; the Law does not name ISO 37001.
Cgcre (Inmetro) and its Global ACI recognitionMarket driver
Global ACI lists ISO 37001 (ABMS), with ISO/IEC TS 17021-9, among the management systems scopes recognised for Cgcre, and Inmetro lists a programme for anti-bribery management system certification bodies.

Accreditation, audit language and remote audits in Brazil

Use a certification body accredited for ISO 37001 by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Brazil's national accreditation body is the Coordenação-Geral de Acreditação (Cgcre) of Inmetro, which Global ACI lists as a Full Member and MRA signatory. Global ACI's entry for Cgcre lists ISO 37001 among its recognised scopes. Ask each body for its accreditation certificate and check that the scope covers the standard and your sector. The accredited certification body decides, not Sterling. Edition and transition details: ISO 37001 hub →

    Audit language

Portuguese is the usual language of regulators, contracts and audit records, while English is common inside multinationals; agree the audit language, any interpreter and the language of controlled documents with the certification body at application.

    Remote and on-site

Anti-bribery audits review policies, due diligence and records, partly remote, and interview staff and managers on site, with attention to high-risk locations and intermediaries.

ISO 37001 in Brazil: questions clients ask

Does the Anti-Corruption Law require an integrity programme?

Not as a general duty. The Law makes companies strictly liable for acts against the public administration, and it lists internal integrity, audit and whistleblowing mechanisms and the effective application of codes of conduct among the factors considered when sanctions are applied. Decree No. 11,129 defines the programme. Confirm your obligations with counsel.

When does a public tender require an integrity programme?

For contracts of very large value, the notice must require the winning bidder to implement a programme after signing. Separately, having one is a tie-break criterion and a factor when penalties are set. The Law refers to the guidance of control bodies, not to ISO 37001, so use the standard as a framework, not as proof.

Is an ISO 37001 certificate accepted as an integrity programme?

Neither the Anti-Corruption Law nor the tenders law names it, so acceptance depends on the control body or contracting authority. The standard covers many elements the Decree describes, such as risk assessment, due diligence, controls and reporting. Ask the authority or counsel what evidence it expects, and treat the certificate as supporting evidence.

Which Brazilian body accredits ISO 37001 certification?

Cgcre, Inmetro's accreditation coordination, runs a programme for anti-bribery management system certification bodies, and Global ACI lists ISO 37001 among its recognised scopes. A foreign body accredited at home may also certify you. Ask any candidate to show its accreditation certificate and scope before you sign.
