In short

ISO 42001 certification in Austria at a glance

Datenschutzgesetz (DSG), BGBl. I Nr. 165/1999 is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Austria ask for evidence that you meet it.

Austrian AI governance now has two layers. The EU AI Act sets obligations by role and risk class, and the Rundfunk und Telekom Regulierungs-GmbH runs an AI Service Desk as an information hub that supports its implementation. Alongside, the Datenschutzgesetz and the GDPR keep applying wherever AI systems process personal data. ISO/IEC 42001 does not replace either; it gives providers and deployers a certified management system for inventory, risk assessment, controls, testing and review, which enterprise customers increasingly ask to see, particularly in software and deep tech. The certificate comes from a body accredited by Akkreditierung Austria or an equivalent accreditation body, never from Sterling. Sterling's Frankfurt office builds the inventory, risk assessment, controls and internal audit, with Effivity and Sterling Academy included with the engagement. Austrian-specific questions are answered below.

The need

Who needs ISO 42001 in Austria, and what happens without it

In Austria the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Providers of AI systems and AI-enabled productsThe EU AI Act applies in Austria, and the RTR AI Service Desk supports its implementation.
  • Deployers using AI in HR, finance or customer decisionsThey need governance, human oversight and records that an AI management system organises.
  • Software and deep-tech firms selling to enterprisesAustria's investment agency lists artificial intelligence under deep tech, and enterprise customers ask for AI governance evidence.
  • Organisations processing personal data in AI systemsThe GDPR and the Datenschutzgesetz continue to apply to training and use of personal data.

Requirements

ISO 42001 requirements in Austria

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.

You know where AI is usedThe AI systems you develop, provide or use are identified, together with the role your organisation plays for each.
Leadership sets the rules for AITop management sets an AI policy and objectives, assigns accountability and provides resources for responsible use.
You assessed AI risks and impactsRisks from AI systems, and their impacts on individuals, groups and society, are assessed before and during use and then treated.
Each AI system is managed through its lifeDesign, data, testing, deployment, monitoring and retirement follow defined processes with records you can show.
Data and third parties are under controlThe quality and origin of data, and suppliers of models or components, are managed against your own requirements.
You monitor, audit and improveAI systems and the management system are monitored, audited internally and reviewed by management, with problems corrected.

In Austria these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

How Sterling gets an Austrian company certified

How to get ISO 42001 certified in Austria

One team from the Frankfurt office carries the work from scoping to certificate. Clients in Austria are served from Sterling's Frankfurt office, on-site where the work needs it and remotely otherwise.

  1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
  2. Gap assessment against ISO/IEC 42001 and the Austrian requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
  3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
  4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
  5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.
Included in every engagement

The Sterling Promise: 100% on-time completion, 100% success, 8,100+ client engagements.Sterling does not certify. Certification decisions stay with independent bodies.

Time

How long does ISO 42001 certification take in Austria?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Austria these are the factors that set the timeline.

  • Inventory and risk classification of AI systems
  • Maturity of data governance and model lifecycle controls
  • Supplier and third-party model dependencies
  • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 42001 certification cost in Austria?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Austria these factors move both.

  • Number of AI systems and use cases in scope
  • Remediation of governance, testing and documentation
  • Certification body audit fees, quoted separately
  • Alignment with ISO/IEC 27001 and GDPR work

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 42001 consultants and certification bodies in Austria

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Austria are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 42001 in Austria (4)

InstrumentHow it treats the standard
Regulation (EU) 2024/1689 (EU AI Act)The regulation itself
EU rules on artificial intelligence that apply in Austria alongside national support structures.
RTR AI Service DeskRegulator page
The Rundfunk und Telekom Regulierungs-GmbH runs an AI Service Desk as a point of contact and information hub on AI that supports implementation of the AI Act; its legal basis is Section 20c KOG and Section 194a TKG.
Datenschutzgesetz (DSG), BGBl. I Nr. 165/1999The instrument itself
It sets up the Datenschutzbehörde as the national supervisory authority under Article 51 GDPR and supplements the regulation.
Akkreditierung Austria as the Austrian national accreditation bodyRegulator page
The Federal Minister for Economy set up Akkreditierung Austria as a department of the ministry; it accredits conformity assessment bodies established in Austria.

Accreditation, audit language and remote audits in Austria

Choose a certification body accredited for this standard by Akkreditierung Austria, Austria's national accreditation body, or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. No body is named here. Edition and transition details: ISO/IEC 42001 hub →

Audit language

German is the official language of Austria and English is common in international groups and technology firms. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

Remote and on-site

Audits combine on-site and remote work; the certification body decides how much can be sampled remotely.

ISO 42001 in Austria: questions clients ask

Does ISO/IEC 42001 make an organisation compliant with the EU AI Act?

No. The AI Act is a regulation with its own obligations by role and risk class, and a management-system certificate does not discharge them. ISO/IEC 42001 can organise governance, risk assessment and documentation that support compliance work. Check your classification and duties with counsel.

Is there an Austrian point of contact for AI Act questions?

Yes, for information. The RTR runs an AI Service Desk as a point of contact and information hub on AI, supporting implementation of the AI Act, with Section 20c KOG and Section 194a TKG as its legal basis. The RTR page does not name ISO/IEC 42001, and it is not a certification body.

Does the GDPR still apply when we use AI in Austria?

Yes. The Datenschutzgesetz supplements the GDPR and makes the Datenschutzbehörde the supervisory authority, with powers to inspect processing and documents. AI systems that handle personal data stay within that regime alongside the AI Act. Treat data protection assessments as part of AI governance and confirm specifics with counsel.

Who certifies ISO/IEC 42001 in Austria?

An accredited certification body, never Sterling. Because the standard is new, confirm that the body holds accreditation covering it from Akkreditierung Austria or an equivalent body. Sterling prepares the AI management system from the Frankfurt office: inventory, risk assessment, controls, testing and internal audit, with Effivity and Sterling Academy included.
