In short

ISO 27701 certification in Austria at a glance

Datenschutzgesetz (DSG), BGBl. I Nr. 165/1999 is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Austria ask for evidence that you meet it.

Austrian privacy practice offers two different certificates that are easily confused. GDPR certification follows criteria that the Datenschutzbehörde publishes under the Datenschutzgesetz, with the same authority acting as the single accreditation body for GDPR certification bodies. ISO/IEC 27701 is something else: a privacy extension to an information security system, certified by an ISO certification body accredited by Akkreditierung Austria or an equivalent accreditation body, never by Sterling. Processors, SaaS providers and groups that already hold ISO/IEC 27001 use it to give controllers and customers recorded evidence of privacy controls, without claiming that it settles GDPR compliance. Sterling's Frankfurt office builds the privacy controls, records of processing, processor arrangements and internal audit, with Effivity and Sterling Academy included with the engagement. Austrian questions follow.

The need

Who needs ISO 27701 in Austria, and what happens without it

In Austria the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Processors and SaaS providers handling personal data for Austrian controllersCustomers need processor contracts and security evidence, and the Datenschutzbehörde can inspect processing and related documents.
  • Controllers wanting a structured privacy management systemISO/IEC 27701 extends an information security system with privacy controls and gives records to show regulators and customers.
  • Organisations weighing GDPR certification against an ISO routeGDPR certification follows criteria the Datenschutzbehörde publishes, while ISO/IEC 27701 is certified by an accredited ISO certification body.
  • Groups that already hold ISO/IEC 27001They can add the privacy extension to an existing system instead of building a second one.

Requirements

ISO 27701 requirements in Austria

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In Austria these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

  4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.

Time

How long does ISO 27701 certification take in Austria?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Austria these are the factors that set the timeline.

  • Existing ISO/IEC 27001 system and its scope
  • Records of processing and data-subject request handling
  • Processor and transfer arrangements
  • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in Austria?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Austria these factors move both.

  • Scope and number of processing activities
  • Remediation of privacy controls and contracts
  • Certification body audit fees, quoted separately
  • Alignment with the ISO/IEC 27001 audit cycle

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in Austria

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Austria are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 27701 in Austria (4)

    InstrumentHow it treats the standard
Regulation (EU) 2016/679 (GDPR)The regulation itself
It allows approved certification mechanisms to be used as an element for demonstrating compliance, and is applied in Austria with the Datenschutzbehörde as supervisory authority.
Datenschutzgesetz (DSG), BGBl. I Nr. 165/1999The instrument itself
It sets up the Datenschutzbehörde as the national supervisory authority under Article 51 GDPR and supplements the regulation.
Datenschutzbehörde as accreditation body for GDPR certificationThe instrument itself
The DSG has the Datenschutzbehörde publish the criteria for certification by ordinance and act as the single national accreditation body under Article 43(1)(a) GDPR.
Akkreditierung Austria as the Austrian national accreditation bodyRegulator page
The Federal Minister for Economy set up Akkreditierung Austria as a department of the ministry; it accredits conformity assessment bodies established in Austria.

Accreditation, audit language and remote audits in Austria

ISO/IEC 27701 certification is issued by an accredited certification body, not by Sterling, and it is not the GDPR certification the Datenschutzbehörde accredits. Choose a body accredited for the standard by Akkreditierung Austria or another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA), and check its scope. No body is named here. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

German is the official language of Austria and English is common in international groups and technology firms. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

    Remote and on-site

Audits are normally on-site with remote sampling at the certification body's discretion, and are usually combined with the ISO/IEC 27001 audit.

ISO 27701 in Austria: questions clients ask

Is ISO/IEC 27701 the same as GDPR certification in Austria?

No. GDPR certification is a regulated scheme: the Datenschutzgesetz has the Datenschutzbehörde publish the criteria and act as accreditation body. ISO/IEC 27701 is a management-system standard certified by an ISO certification body. Either can be evidence, though neither replaces the controller's own duties. Ask the authority or your counsel which fits your purpose.

Does the Datenschutzbehörde recognise ISO/IEC 27701 certificates?

The Datenschutzgesetz does not mention it. The Act sets up the authority as supervisor and gives it inspection powers, so what counts is whether your processing complies, with certificates as supporting material at most. For a formal view on any certificate, put the question to the authority or your counsel.

Who certifies ISO/IEC 27701 in Austria?

An accredited certification body, never Sterling. Look for accreditation covering the standard from Akkreditierung Austria or an equivalent body, then read the scope. Sterling prepares the privacy information management system from the Frankfurt office, on-site where needed, with Effivity and Sterling Academy included.

Can we add ISO/IEC 27701 to an existing ISO/IEC 27001 certificate?

Usually, yes, and combining the audits keeps effort down. The privacy standard extends the security system, so the work is privacy controls, records of processing and processor arrangements on top of what exists. Confirm with your certification body how it schedules the extension and what it needs to see.
