ISO 42001 certification in the US at a glance

Colorado SB24-205 Consumer Protections for Artificial Intelligence refers to ISO/IEC 42001, yet none of the US instruments checked makes it compulsory. Buyers in the US ask for it anyway.

Colorado's Consumer Protections for Artificial Intelligence act gives developers and deployers an affirmative defence where they comply with a nationally or internationally recognised AI risk management framework designated by the act or the attorney general, one sign of where American AI governance is heading. At federal level, NIST's AI Risk Management Framework is intended for voluntary use. ISO/IEC 42001 is the certifiable management-system standard in this space: it sets requirements for an AI management system covering policy, risk and impact assessment, data and lifecycle controls, and supplier oversight. Software companies building AI features, healthcare and financial firms deploying models in decisions about people, and vendors answering enterprise AI questionnaires are the main adopters. Certification comes from a certification body accredited for ISO/IEC 42001 within the international mutual recognition arrangements. Sterling sets up the AIMS alongside existing ISO/IEC 27001 controls where they exist, with Effivity and Sterling Academy included. The local route and questions follow.

The need

Who needs ISO 42001 in the US, and what happens without it

In the US the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Developers and deployers of high-risk AI systems in ColoradoSB24-205 provides an affirmative defence for compliance with a recognised AI risk management framework.
  • Software companies building AI featuresEnterprise buyers send AI governance questionnaires.
  • Organisations using the NIST AI RMFThe voluntary NIST framework is a common reference; ISO/IEC 42001 provides a certifiable system.
  • Healthcare and financial firms using models in decisions about peoplePrivacy and security obligations apply to the data the models use.

ISO 42001 requirements in the US

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.

You know where AI is usedThe AI systems you develop, provide or use are identified, together with the role your organisation plays for each.
Leadership sets the rules for AITop management sets an AI policy and objectives, assigns accountability and provides resources for responsible use.
You assessed AI risks and impactsRisks from AI systems, and their impacts on individuals, groups and society, are assessed before and during use and then treated.
Each AI system is managed through its lifeDesign, data, testing, deployment, monitoring and retirement follow defined processes with records you can show.
Data and third parties are under controlThe quality and origin of data, and suppliers of models or components, are managed against your own requirements.
You monitor, audit and improveAI systems and the management system are monitored, audited internally and reviewed by management, with problems corrected.

In the US these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

Time

How long does ISO 42001 certification take in the US?

There is no standard duration: it depends on your scope and on how much of the system already runs. In the US these are the factors that set the timeline.

  • Number of AI systems and use cases in scope
  • Existing ISO/IEC 27001 or privacy controls that can be reused
  • Completion of AI risk and impact assessments
  • Certification body availability for this newer standard

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 42001 certification cost in the US?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In the US these factors move both.

  • Number of AI systems, models and suppliers in scope
  • Certification body audit fees quoted separately from consulting
  • Integration with ISO/IEC 27001 and ISO/IEC 27701
  • Technical documentation and data governance work

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 42001 consultants and certification bodies in the US

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in the US are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in the US

Use a certification body accredited for this standard by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA), US-based (for example IAS, which accredits management systems certification bodies) or foreign; check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO/IEC 42001 hub →

Audit language

Audits are conducted in English; agree the audit and document language with the certification body at application.

Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 42001 in the US: questions clients ask

Is ISO 42001 required by US law?

No. No US law requires ISO/IEC 42001. Colorado's SB24-205 gives an affirmative defence to those who comply with a recognised AI risk management framework that the act or the attorney general designates, and the bill summary does not name ISO/IEC 42001. The NIST AI RMF is voluntary. Confirm what applies with your counsel.

How does ISO 42001 relate to the NIST AI RMF?

The NIST AI Risk Management Framework, released on 26 January 2023, is voluntary guidance, whereas ISO/IEC 42001 is a management system you can have certified. Some organisations use the NIST framework as a reference and add ISO/IEC 42001 where a buyer wants independent certification.

Who certifies ISO 42001?

An accredited certification body, chosen with extra care because the standard is newer and body availability can be limited. Look for accreditation within the international recognition arrangements, through a US body such as the International Accreditation Service or a foreign one, and check the scope explicitly covers ISO/IEC 42001.
