In short

ISO 27701 certification in the US at a glance

Two US instruments bear on ISO/IEC 27701. Not one of them names it. So why do buyers in the US keep asking for the certificate?

American privacy obligations arrive as a patchwork: HIPAA for health information, the Gramm-Leach-Bliley Act's Safeguards Rule for financial institutions, the CCPA as amended for businesses handling Californians' personal information, and New York's SHIELD Act for private information about New Yorkers. ISO/IEC 27701 does not replace any of them, and none of them requires it. What it offers is one privacy information management system, working alongside ISO/IEC 27001, that maps controller and processor duties (notices, purposes, rights requests, retention, processor contracts, transfers) to controls a certification body can audit. That makes it attractive to SaaS platforms, health-tech and fintech firms, and data processors that answer privacy questionnaires from customers in several states and abroad. Certification is issued by a certification body accredited within the international mutual recognition arrangements, normally in the same audit cycle as ISO/IEC 27001. Sterling's New York office implements both together, with Effivity and Sterling Academy included. Questions follow.

The need

Who needs ISO 27701 in the US, and what happens without it

In the US the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Businesses subject to the CCPA as amendedConsumer rights and service-provider duties need an operating privacy system.
  • Health-tech firms and business associatesHIPAA safeguards for ePHI.
  • Fintech and non-bank financial firmsFTC Safeguards Rule information security programme.
  • Data processors serving customers in several states and abroadPrivacy questionnaires from customers.

Requirements

ISO 27701 requirements in the US

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In the US these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

How Sterling gets a US company certified

Time

How long does ISO 27701 certification take in the US?

There is no standard duration: it depends on your scope and on how much of the system already runs. In the US these are the factors that set the timeline.

  • Status of ISO/IEC 27001 certification
  • Controller and/or processor role
  • Number of systems and data flows in scope
  • Certification body availability

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in the US?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In the US these factors move both.

  • Data mapping effort
  • Number of systems and jurisdictions in scope
  • Certification body audit fees quoted separately from consulting
  • Integration with ISO/IEC 27001 audits

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in the US

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in the US are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accredited certification for management-system standards is available through a US accreditation body; no mandate.

"Expected in practice" means the instrument asks for the outcomes ISO/IEC 27701 covers without naming a standard, and ISO/IEC 27701 is what buyers and regulators commonly accept as evidence of them.

Accreditation, audit language and remote audits in the US

Use a certification body accredited for this standard by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA), US-based (for example IAS, which accredits management systems certification bodies) or foreign; check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

Audits are conducted in English; agree the audit and document language with the certification body at application.

    Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 27701 in the US: questions clients ask

Does ISO 27701 make us CCPA compliant?

No single certificate proves compliance with the CCPA. ISO/IEC 27701 structures the controls the law expects, which helps you run a working privacy system, but you still have to show compliance against the law itself. Ask your counsel which parts of the CCPA a certificate can help evidence.

Is ISO 27701 required by US law?

No. None of the legal drivers recorded for the US cites ISO/IEC 27701; the CCPA and the New York SHIELD Act set their own obligations without naming it. Demand comes from customers and their privacy questionnaires, so check what your contracts and buyers actually ask for.

Can ISO 27701 be audited with ISO 27001?

Normally yes: the two are usually audited in one cycle with the certification body. ISO/IEC 27701 depends on an ISO/IEC 27001 system, so planning both together avoids duplicated effort. Ask the body which role, controller, processor or both, it will audit you against.
