In short

PCI DSS compliance in the US at a glance

Nevada Revised Statutes Chapter 603A (NRS 603A.215) requires PCI DSS for the organisations it covers. Most US buyers ask for it anyway.

Nevada is one of the few places where PCI DSS is written into statute: a data collector doing business in the state that accepts payment cards must comply with the current version of the standard for those transactions. Elsewhere the obligation is contractual, flowing from the card brands through acquiring banks to merchants and service providers. Either way, PCI DSS is a compliance standard, not a certificate. Compliance is validated by a Qualified Security Assessor, an independent security organisation qualified by the PCI Security Standards Council, or by a self-assessment questionnaire, depending on what the payment brands and the acquirer require for the merchant level or service-provider role. For payment processors, e-commerce platforms, contact centres taking card payments and fintechs, the work is scoping the cardholder data environment, segmenting it and producing evidence. Sterling brings 20+ years of compliance practice to that work, from scoping and gap assessment to QSA-ready evidence. The route and common questions are set out below.

PCI DSS requirements in the US

Strip away the vocabulary and PCI DSS asks any business that stores, processes or transmits card data to comply in six areas.

You know where card data livesThe cardholder data environment is scoped, data flows are mapped and the environment is segmented where possible.
Networks are protectedNetwork security controls restrict traffic to and from systems that handle card data, and configurations are hardened.
Stored data is minimised and protectedOnly the card data you need is kept, sensitive authentication data is not retained after authorisation except under issuer rules, and the rest is protected.
Access is restricted and authenticatedAccess to card data is limited to people who need it, with unique IDs and multi-factor authentication where required.
Systems are logged and testedActivity is logged and reviewed, vulnerabilities are scanned and patched, and penetration testing is carried out.
Policies and people keep it runningSecurity policies, staff awareness, vendor management and incident response keep controls working between assessments.

In the US these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: PCI DSS explained →

Time

How long does PCI DSS compliance take in the US?

There is no standard duration: it depends on your scope and on how much of the system already runs. In the US these are the factors that set the timeline.

  • Size of the cardholder data environment and segmentation
  • Merchant level or service-provider role set by the brands and acquirer
  • Number of third-party service providers in scope
  • Evidence of vulnerability scans and penetration testing

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does PCI DSS compliance cost in the US?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In the US these factors move both.

  • Scope of the cardholder data environment
  • QSA fees quoted separately from consulting
  • Technical remediation (encryption, logging, segmentation)
  • Number of locations and payment channels

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

PCI DSS consultants and assessors in the US

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers PCI DSS and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in the US are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

PCI DSS in the US: questions clients ask

Is PCI DSS required by law in the US?

Only in part. Nevada's statute, NRS 603A.215, requires a data collector doing business in Nevada that accepts a payment card to comply with the current version of PCI DSS for those transactions. Elsewhere in the US the duty is contractual, passing through the card brands and acquirers. Check with your counsel and your acquirer.

Is there a PCI DSS certificate?

No. PCI DSS has no certificate. Compliance is validated either by a Qualified Security Assessor, whose Report on Compliance records the result, or by self-assessment. QSA companies are qualified by the PCI Security Standards Council to validate an entity's adherence.

Who decides whether we need a QSA?

The payment brands and your acquirer decide, based on your merchant level or, for a service provider, your role. Ask your acquirer which validation route applies before you plan an assessment, because some entities may self-assess while others need a QSA.
