In short

ISO 27701 certification in Portugal at a glance

Lei n.º 58/2019, de 8 de agosto, and the CNPD is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Portugal ask for evidence that you meet it.

Privacy assurance is a commercial currency for Portuguese service providers. The Comissão Nacional de Proteção de Dados supervises the GDPR under Lei n.º 58/2019, and shared-services centres that Portugal Global describes handle data for group companies and clients abroad. ISO/IEC 27701 extends an ISO/IEC 27001 system with privacy controls for controllers and processors, giving customers a recognisable structure. It is not the GDPR certification route that Lei n.º 58/2019 sets through IPAC-accredited bodies, and no certificate reduces responsibility before the CNPD. An ISO/IEC 27701 certificate comes from a certification body accredited by IPAC, never from Sterling. Sterling's Enschede office extends the security system, builds records of processing and rights handling, and rehearses the audit, with Effivity and Sterling Academy included.

The need

Who needs ISO 27701 in Portugal, and what happens without it

In Portugal the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Processors and shared-services centres handling personal data for group companies abroadPortugal Global names finance, HR, customer service and IT among the work centres do, and each brings processor duties under the GDPR.
  • Controllers wanting a managed privacy programme on top of ISO/IEC 27001The CNPD supervises the GDPR under Lei n.º 58/2019, and an auditable system helps show accountability.
  • Organisations deciding between ISO/IEC 27701 and a GDPR certification routeLei n.º 58/2019 sets a separate route through IPAC-accredited bodies for certification, seals and marks.
  • Digital and software firms selling privacy assurance to enterprise customersA certified privacy information management system gives a standard answer to due diligence.

Requirements

ISO 27701 requirements in Portugal

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In Portugal these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

How Sterling gets a Portuguese company certified

One team from the Enschede office carries the work from scoping to certificate. Clients in Portugal are served from Sterling's Enschede office, on-site where the work needs it and remotely otherwise.

  1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
  2. Gap assessment against ISO/IEC 27701 and the Portuguese requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
  3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
  4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
  5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.

Time

How long does ISO 27701 certification take in Portugal?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Portugal these are the factors that set the timeline.

  • Whether an ISO/IEC 27001 system already exists
  • Number of processing activities, controller or processor roles
  • Maturity of records of processing, assessments and rights handling
  • Certification body scheduling around the Portuguese summer holiday period

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in Portugal?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Portugal these factors move both.

  • Size of the privacy scope and number of systems
  • Remediation of notices, contracts and retention rules
  • Certification body audit fees, quoted separately from consulting
  • Extension work on an existing ISO/IEC 27001 system

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in Portugal

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Portugal are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 27701 in Portugal (4)

    InstrumentHow it treats the standard
Lei n.º 58/2019, de 8 de agosto, and the CNPDThe instrument itself
It makes the CNPD the national supervisory authority for the GDPR and the Act and sets who accredits data protection certification bodies.
Regulation (EU) 2016/679 (GDPR), applicable from 25 May 2018The regulation itself
It encourages data protection certification mechanisms, seals and marks as a way to demonstrate compliance; they do not remove the controller's responsibility.
IPAC (Instituto Português de Acreditação, I.P.) as Portugal's national accreditation bodyRecognition
IPAC's general regulation describes it as the national accreditation body under Regulation (EC) No 765/2008, covering testing and calibration laboratories, clinical laboratories, inspection, certification, validation and verification bodies.
    EA directory entry for IPACRecognition
The European co-operation for Accreditation lists IPAC as an MLA signatory with scopes that include management system certification, product certification, certification of persons, inspection, calibration, testing and validation and verification.

Accreditation, audit language and remote audits in Portugal

Choose a certification body accredited for ISO/IEC 27701 by IPAC, Portugal's national accreditation body, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. It is a management system standard extending ISO/IEC 27001; it is not the same as a GDPR certification under Lei n.º 58/2019. No body is named here. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

Portuguese is the official language and English is widely used in international business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

    Remote and on-site

Stage 1 and stage 2 audits are normally on site, with remote review of records and processing documentation at the certification body's discretion.

ISO 27701 in Portugal: questions clients ask

Is ISO/IEC 27701 the same as GDPR certification in Portugal?

No. Under Lei n.º 58/2019 data protection certification, seals and marks are issued by bodies that IPAC accredits for that purpose, taking the CNPD's requirements into account. ISO/IEC 27701 is a separate management system standard. Whether any certificate helps demonstrate GDPR compliance is for the CNPD or your counsel to say.

Which Portuguese authority supervises privacy compliance?

The CNPD, which Lei n.º 58/2019 designates as the national supervisory authority for the GDPR and the Act. A certificate under ISO/IEC 27701 does not change that supervision. It can help organise records, roles and controls so that you can answer the CNPD, customers and data subjects consistently.

Who certifies ISO/IEC 27701 in Portugal?

A certification body, never Sterling. Choose one accredited by IPAC, whose management system certification scope the EA directory lists, and check that the scope includes privacy information management. The body normally audits the extension together with ISO/IEC 27001, so agree the combined audit plan early.

    Does ISO/IEC 27701 need an ISO/IEC 27001 system first?

In practice yes: the standard extends ISO/IEC 27001 with privacy controls and guidance for controllers and processors, so most organisations build or hold the security system first. If one already exists, the extension adds privacy risk, processing records and rights handling. Without it, plan both together.
