In short

ISO 42001 certification in Mauritius at a glance

Data Protection Act 2017 (Act 20/2017) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Mauritius ask for evidence that you meet it.

AI governance in Mauritius is currently shaped less by a dedicated AI statute than by data protection. The Data Protection Act 2017 gives people a right not to be subject to decisions based solely on automated processing, including profiling, with legal or significant effects, requires impact assessments for profiling-based evaluation and large-scale special category processing, and makes it a function of the Commissioner to examine proposals for automated decision making. Regulations on data protection officers come into operation on 1 January 2027. ISO/IEC 42001 gives lenders, fintech firms, BPO and software providers a voluntary, certifiable way to govern models, data and monitoring, and customers abroad increasingly ask for it. The certificate comes from an accredited body, not Sterling. Sterling's Johannesburg office builds the management system with Effivity and Sterling Academy included and 20+ years of practice behind the method.

The need

Who needs ISO 42001 in Mauritius, and what happens without it

In Mauritius the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Organisations making decisions about people by automated meansThe Data Protection Act 2017 gives data subjects a right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or significantly affects them.
  • Lenders, insurers and fintech firms using scoring or profilingThe Act requires an impact assessment before systematic and extensive evaluation based on automated processing on which decisions are based.
  • BPO, ICT and software providers building AI into servicesCustomers ask providers how models are governed, tested and monitored, and the Commissioner is required to examine proposals for automated decision making.
  • Groups using AI on health or other special categories of dataProcessing special categories on a large scale triggers an impact assessment, and automated evaluation must not be based on special categories.

ISO 42001 requirements in Mauritius

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.

You know where AI is usedThe AI systems you develop, provide or use are identified, together with the role your organisation plays for each.
Leadership sets the rules for AITop management sets an AI policy and objectives, assigns accountability and provides resources for responsible use.
You assessed AI risks and impactsRisks from AI systems, and their impacts on individuals, groups and society, are assessed before and during use and then treated.
Each AI system is managed through its lifeDesign, data, testing, deployment, monitoring and retirement follow defined processes with records you can show.
Data and third parties are under controlThe quality and origin of data, and suppliers of models or components, are managed against your own requirements.
You monitor, audit and improveAI systems and the management system are monitored, audited internally and reviewed by management, with problems corrected.

In Mauritius these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

Time

How long does ISO 42001 certification take in Mauritius?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Mauritius these are the factors that set the timeline.

  • Number of AI systems, models and use cases in scope
  • Maturity of AI risk and impact assessment and data governance
  • Involvement of suppliers and third-party models
  • Certification body availability for the standard

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 42001 certification cost in Mauritius?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Mauritius these factors move both.

  • Number of AI systems and teams in scope
  • Testing, monitoring and documentation tooling
  • Certification body audit fees quoted separately from consulting
  • Remediation of governance gaps

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 42001 consultants and certification bodies in Mauritius

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Mauritius are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 42001 in Mauritius (3)

InstrumentHow it treats the standard
Data Protection Act 2017 (Act 20/2017)The instrument itself
Section 38 gives a right not to be subject to solely automated decisions with legal or significant effects, subject to exceptions for contract, authorising law and explicit consent, with safeguards and information duties; the Act cites no ISO standard.
Data Protection Act 2017 (Act 20/2017)The instrument itself
Section 34 requires a data protection impact assessment for systematic and extensive profiling-based evaluation and for large-scale processing of special categories, and section 5 makes it a function of the Commissioner to examine proposals for automated decision making or data linkage.
Data Protection (Designation, Tasks and Position of Data Protection Officers) Regulations 2026 (GN No. 117 of 2026)Does not name the standard
A designated data protection officer advises on impact assessments and monitors compliance, which includes automated decision making; the regulations come into operation on 1 January 2027.

Accreditation, audit language and remote audits in Mauritius

Choose a certification body accredited for this standard by the Mauritius Accreditation Service (MAURITAS) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. ISO/IEC 42001 is a newer standard, so ask each body to show an accreditation scope that includes it, and note that no Mauritian law cited here requires or recognises an AI management system certificate. Audit language

English is the usual language of business records, standards and tenders in Mauritius, with French widely used alongside it, and interviews with staff or suppliers can run in French or another local language. Agree the audit language, any interpreter and the language of controlled documents with the certification body at application.

Remote and on-site

Stage audits review the AI management system, impact assessments, data and model governance, and monitoring records; document review can be remote at the certification body's discretion, while operations and development teams are interviewed.

ISO 42001 in Mauritius: questions clients ask

Does Mauritius have an AI law that requires ISO 42001?

No law cited here requires it. The Data Protection Act 2017 is the main Mauritian rule that reaches AI uses, through its right not to be subject to solely automated decisions with legal or significant effects. ISO 42001 is a voluntary management system standard. Confirm whether any sector rule applies to your AI use with the regulator or your counsel.

What does the Data Protection Act say about decisions made only by automated means?

Every data subject has a right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or significantly affects them. Exceptions cover contract necessity, authorising law with safeguards, and explicit consent, and automated evaluation must not rely on special categories. Controllers must tell people about it and add safeguards. Check your case with your counsel.

When is an impact assessment needed for profiling or AI?

Before processing that is likely to result in high risk, including systematic and extensive evaluation of personal aspects by automated processing on which significant decisions are based, large-scale processing of special categories, or systematic monitoring of a public area on a large scale. The Commissioner is also required to examine proposals for automated decision making or data linkage. Ask your counsel to review your use case.

Who issues an ISO 42001 certificate?

An accredited certification body issues it, not Sterling. Because the standard is newer, ask each body whether its accreditation scope already includes it, from MAURITAS or from a body within the international recognition arrangements, and whether your customers accept that scope. The certificate is voluntary and does not replace obligations under the Data Protection Act.
