In short

ISO 37001 certification in Kenya at a glance

In Kenya, ISO 37001 is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.

Anti-bribery duties in Kenya sit in statute. The Bribery Act, 2016 requires private entities to put in place procedures for preventing bribery, the Bribery Regulations, 2022 add detail, and the Ethics and Anti-Corruption Commission publishes model procedures; none of them names ISO 37001. The Central Bank of Kenya's September 2026 draft guidelines also include anti-bribery items, though they are not yet in force. Tenderers, banks, contractors and group subsidiaries are typical applicants, and any certificate sits alongside the law rather than above it. On accreditation, KENAS's AFRAC certificate carries no anti-bribery entry, so put that question to each body directly. No certificate comes from Sterling. Its Nairobi office builds the system, with Effivity and Sterling Academy included and 20+ years behind the method.

The need

Who needs ISO 37001 in Kenya, and what happens without it

In Kenya the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Companies bidding for public contractsThe Bribery Act, 2016 requires private entities to have procedures for preventing bribery, and tenderers answer to procurement integrity rules.
  • Banks and financial institutionsThe CBK's September 2026 draft guidelines include anti-bribery items among ESG and conduct expectations.
  • Contractors, logistics and infrastructure firms working with governmentThey deal with licences, inspections and tenders where bribery exposure is highest.
  • Subsidiaries of multinational groupsGroup policies expect local anti-bribery controls that can be shown to assessors.

Requirements

ISO 37001 requirements in Kenya

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In Kenya these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in Kenya?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Kenya these are the factors that set the timeline.

  • Scope of entities, countries and business associates
  • Bribery risk assessment, due diligence and gifts controls
  • Reporting channels and investigation arrangements
  • Certification body scheduling and customer requirements

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in Kenya?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Kenya these factors move both.

  • Number of entities, staff and business associates in scope
  • Due diligence and training tooling
  • Certification body audit fees quoted separately from consulting
  • Policy, control and record remediation

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in Kenya

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Kenya are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37001 in Kenya (4)

    InstrumentHow it treats the standard
Bribery Act, 2016 (Act No. 47 of 2016)Does not name ISO 37001
Section 9 requires private entities to put in place procedures for preventing bribery and corruption, and the Ethics and Anti-Corruption Commission issues guidance.
Bribery Regulations, 2022 (Legal Notice No. 88 of 2022)Does not name ISO 37001
Give detail on the procedures entities are expected to adopt.
    EACC model proceduresContext
The Commission publishes model bribery-prevention procedures for entities; they do not name ISO 37001.
CBK draft Risk Management Guidelines (September 2026)Does not name ISO 37001
The draft includes anti-bribery items; it is a draft for comment and not yet in force.

Accreditation, audit language and remote audits in Kenya

Choose a certification body accredited for this standard by the Kenya Accreditation Service (KENAS) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. ISO 37001 is not among the sub-scopes on KENAS's AFRAC certificate, so ask each body which accreditation backs its anti-bribery certificates. A certificate is evidence of a management system, not immunity from the Bribery Act, 2016, and the Commission decides what procedures are adequate. Edition and transition details: ISO 37001 hub →

    Audit language

Kiswahili and English are the official languages and English is the usual language of business records, standards and tenders; interviews on the shop floor or with suppliers may run in Kiswahili or another local language. Agree the audit language, any interpreter and the language of controlled documents with the certification body at application.

    Remote and on-site

Audits rely on interviews, records and sampled transactions; document review and interviews can be remote at the certification body's discretion.

ISO 37001 in Kenya: questions clients ask

Does Kenyan law require ISO 37001?

No. The Bribery Act, 2016 requires private entities to have procedures for preventing bribery, and the Bribery Regulations, 2022 add detail, but neither names ISO 37001. A certified system is one way to evidence procedures. Confirm with counsel or the EACC what it treats as adequate.

Is there Kenyan guidance on bribery prevention procedures?

Yes. The Ethics and Anti-Corruption Commission publishes model procedures for entities to adapt. They are not tied to ISO 37001, but a management system can be built to meet them as well as the standard. Check the Commission's current publications before you finalise policies.

Does ISO 37001 protect a company from prosecution?

No. A certificate shows that a certification body found a management system in place, but the Bribery Act, 2016 remains the law and the Commission decides what procedures are adequate. Treat certification as evidence, not as a defence, and take legal advice on your exposure.

What affects the timeline for ISO 37001 in Kenya?

The entities, countries and business associates in scope matter most. Bribery risk assessment, due diligence and gifts controls must be built, along with reporting and investigation channels. Certification body scheduling and customer requirements then fix the dates, so agree scope before you start.
