In short

ISO 27701 certification in Kenya at a glance

In Kenya, ISO/IEC 27701 is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.

ISO/IEC 27701 gives Kenyan organisations a management system for personal data, and the Data Protection Act, 2019 supplies the reasons to want one: principles, data subject rights, registration with the Office of the Data Protection Commissioner, impact assessments, processor contracts and breach notification. The Act does not name the standard, and section 74 allows certification standards, seals and marks while stating that certification does not alter responsibility. Accreditation needs a closer look, because the AFRAC certificate held by KENAS lists ISO/IEC 27001 but no privacy standard. Controllers, processors and existing ISO/IEC 27001 holders tend to apply. The certificate is issued by an accredited certification body, not Sterling, whose Nairobi office supports the work from 20+ years of practice, with Effivity and Sterling Academy included.

The need

Who needs ISO 27701 in Kenya, and what happens without it

In Kenya the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Data controllers registered or registering with the ODPCThe Data Protection Act, 2019 asks controllers to keep principled, documented processing, and a privacy information management system gives that a structure.
  • Processors such as cloud, BPO and payroll providersThe Act requires written contracts with processors, and customers ask processors to evidence their controls.
  • Health, education, financial and telecom organisationsThe ODPC FAQ lists these among the purposes for which even small organisations must register.
  • Firms already certified to ISO/IEC 27001They can extend an existing system to cover personal data processing.

Requirements

ISO 27701 requirements in Kenya

Strip away the vocabulary and ISO/IEC 27701 requires a company to prove six things about how it handles personal data.

You know whose data you hold and whyYou know what personal data you process, for which purposes and on what basis, and whether you act as controller, processor or both.
Privacy has an ownerManagement assigns responsibility for privacy and sets objectives, so everyone who handles personal data knows their role.
You assessed the privacy risksRisks to the people whose data you process are assessed and treated, including when new products and processes are designed.
People can exercise their rightsRequests to access, correct or delete data, and other individual rights, run through a defined and timely process.
Sharing and suppliers are controlledDisclosures, transfers and processors are governed by agreements and checks, so data is used only as agreed.
You can demonstrate itRecords of processing, notices and decisions are kept, and the privacy system is audited and reviewed like any management system.

In Kenya these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 27701 explained →

How Sterling gets a Kenyan company certified

One team from the Nairobi office carries the work from scoping to certificate. Clients across Kenya are served from Sterling's Nairobi office, on-site where the work needs it and remotely otherwise.

  1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
  2. Gap assessment against ISO/IEC 27701 and the Kenyan requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.

  4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
  5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.

Time

How long does ISO 27701 certification take in Kenya?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Kenya these are the factors that set the timeline.

  • Personal data inventory, processing purposes and systems in scope
  • Existing ISO/IEC 27001 certification and its scope
  • Controller and processor roles and contracts
  • Certification body scheduling and your customers' requirements

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 27701 certification cost in Kenya?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Kenya these factors move both.

  • Number of systems, processing activities and staff in scope
  • Privacy tooling for consent, requests and retention
  • Certification body audit fees quoted separately from consulting
  • Contract and records remediation

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 27701 consultants and certification bodies in Kenya

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 27701 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Kenya are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 27701 in Kenya (4)

    InstrumentHow it treats the standard
Data Protection Act, 2019 (Act No. 24 of 2019)Does not name ISO/IEC 27701
Sets principles, rights, registration, impact assessments, processor duties, breach notification and transfer rules, and section 74 lets the ODPC recognise certification standards, seals and marks without changing a controller's responsibility.
Data Protection (General) Regulations, 2021Does not name ISO/IEC 27701
Supplement the Act on matters such as automated decisions and localisation.
    ODPC guidance notes and codesContext
The ODPC publishes guidance notes on impact assessments, consent, biometrics, children, health and other topics.
    KENAS accreditation of certification bodiesContext
ISO/IEC 27701 is not among the sub-scopes on KENAS's AFRAC certificate, which lists information security management (ISO/IEC 27001) from 19 December 2024.

Accreditation, audit language and remote audits in Kenya

Choose a certification body accredited for this standard by the Kenya Accreditation Service (KENAS) or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. The AFRAC certificate lists ISO/IEC 27001 for information security management but not ISO/IEC 27701, so ask each body which accreditation backs its privacy certificates. Under section 74 of the Data Protection Act, 2019 a certification does not change who is responsible for the data, and it does not replace registration with the ODPC. Edition and transition details: ISO/IEC 27701 hub →

    Audit language

Kiswahili and English are the official languages and English is the usual language of business records, standards and tenders; interviews on the shop floor or with suppliers may run in Kiswahili or another local language. Agree the audit language, any interpreter and the language of controlled documents with the certification body at application.

    Remote and on-site

Audits review privacy records, contracts and system controls; document review and interviews can be remote at the certification body's discretion.

ISO 27701 in Kenya: questions clients ask

Does ISO/IEC 27701 make a Kenyan organisation compliant with the Data Protection Act?

No. The Act does not name ISO/IEC 27701, and section 74 states that a certification does not alter the responsibility of the controller or processor. The standard gives a management system that supports compliance, but registration, rights handling and breach notification remain legal duties. Confirm your position with counsel or the ODPC.

Does a certificate replace ODPC registration?

No. Registration with the ODPC is a legal step for controllers and processors that meet the thresholds the Commissioner sets, and the ODPC FAQ lists the purposes that trigger it. A privacy certificate is voluntary evidence from a certification body. Check the ODPC's current registration guidance.

    Is ISO/IEC 27701 listed in KENAS's AFRAC sub-scopes?

No. The AFRAC certificate lists information security management under ISO/IEC 27001 but not ISO/IEC 27701. Ask each certification body which accreditation backs its privacy certificates, and confirm that your customers or regulator accept it before you commit to an audit.

What affects the timeline for ISO/IEC 27701 in Kenya?

The personal data inventory and systems in scope matter most. An existing ISO/IEC 27001 certificate shortens the groundwork, and clear controller and processor roles and contracts help. Certification body scheduling and customer requirements then set the dates, so map your processing before you apply.
