In short

ISO 37301 certification in Ireland at a glance

Two Irish instruments bear on ISO 37301. Not one of them names it. So why do buyers in Ireland keep asking for the certificate?

Compliance in Ireland is a patchwork of sector rules, criminal liability and whistleblowing duties, and ISO 37301 gives it one frame. The Protected Disclosures (Amendment) Act 2022 spells out what internal reporting channels must include: secure channels, written acknowledgement, an impartial designated person and diligent follow-up. The Criminal Justice (Corruption Offences) Act 2018 gives bodies corporate a defence when they took all reasonable steps and exercised all due diligence. Neither names ISO 37301, which is a voluntary standard whose certificate is issued by an accredited certification body. Regulated firms answering to the Central Bank, and medical device and food companies answering to the HPRA and FSAI, can use the system to map their obligations. Sterling's London office supports Irish organisations from obligations register to internal audit and management review, with Effivity and Sterling Academy included in the engagement.

The need

Who needs ISO 37301 in Ireland, and what happens without it

In Ireland the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Employers needing internal reporting channelsThe Protected Disclosures (Amendment) Act 2022 sets out what internal reporting channels and procedures must include.
  • Boards of Irish bodies corporateThe Criminal Justice (Corruption Offences) Act 2018 puts liability on bodies corporate unless they took all reasonable steps and exercised all due diligence.
  • Regulated financial firmsThe Central Bank expects boards to manage operational resilience and conduct risk; a compliance management system structures the work.
  • Suppliers bidding for public contractsExclusion grounds in regulation 57 of S.I. No. 284 of 2016 make compliance history relevant.
  • Healthcare and medtech companiesRegulated product sectors combine several compliance obligations that need one framework.

Requirements

ISO 37301 requirements in Ireland

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.

You know your obligationsObligations from laws, regulators, contracts and voluntary commitments are identified and kept current.
The governing body and management leadThe governing body and top management set the compliance policy and support a culture in which compliance is expected.
A compliance function has authorityA compliance function is resourced, independent enough to act and has direct access to the governing body.
Compliance risks are assessedRisks of failing to meet obligations are assessed, and controls are designed in proportion to them.
Concerns are raised and handledPeople can raise concerns without fear of retaliation, and suspected breaches are investigated and corrected.
You monitor and reportCompliance performance is monitored, reported to leadership, audited and reviewed so the system improves.

In Ireland these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How Sterling gets an Irish company certified

How to get ISO 37301 certified in Ireland

One team from the London office carries the work from scoping to certificate. Clients in Ireland are served from Sterling's London office, on-site where the work needs it and remotely otherwise.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against ISO 37301 and the Irish requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
    3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
    4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
    5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.

      Time

How long does ISO 37301 certification take in Ireland?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Ireland these are the factors that set the timeline.

      • Compliance obligations register and risk assessment
      • Speak-up and investigation procedures
      • Number of regulated activities and sites
      • Top management and board reporting

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does ISO 37301 certification cost in Ireland?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Ireland these factors move both.

      • Number of obligations, entities and sites
      • Depth of controls testing and monitoring
      • Certification body audit fees quoted separately from consulting
      • Integration with ISO 37001 or ISO 9001

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

ISO 37301 consultants and certification bodies in Ireland

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Ireland are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37301 in Ireland (2)

          InstrumentHow it treats the standard
Protected Disclosures (Amendment) Act 2022, section 9 (new section 6A)Does not name the standard
Internal reporting channels must be secure, acknowledge reports in writing, designate an impartial person and provide diligent follow-up.
Criminal Justice (Corruption Offences) Act 2018, section 18Does not name the standard
Defence for a body corporate that took all reasonable steps and exercised all due diligence.

Accreditation, audit language and remote audits in Ireland

Use a certification body accredited for this standard by INAB, the Irish National Accreditation Board, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. INAB's published list of certifiable management systems does not name ISO 37301, so ask the body to show its scope for the standard. Edition and transition details: ISO 37301 hub →

          Audit language

English is the working language of Irish business, so audits and controlled documents are normally in English; agree the language with the certification body at application and follow any requirement in a tender or contract.

          Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 37301 in Ireland: questions clients ask

Does Irish law require ISO 37301?

No. Neither the Protected Disclosures (Amendment) Act 2022 nor the Criminal Justice (Corruption Offences) Act 2018 names ISO 37301. ISO 37301 is a voluntary compliance management system standard certified by an accredited body. It can help evidence that obligations are identified and controlled. Ask your counsel which legal duties apply to your business.

What must Irish internal reporting channels include?

The 2022 Act's new section 6A says internal reporting channels and procedures must be designed and operated securely so the reporter's identity stays confidential, acknowledge receipt in writing, designate an impartial person competent to follow up, and provide diligent follow-up. A compliance management system can document that process. Check the detail of your duties with your counsel.

How is ISO 37301 different from ISO 37001?

ISO 37301 covers compliance management across all of an organisation's obligations, while ISO 37001 deals specifically with bribery. Many organisations use the broader system as the frame and add the anti-bribery requirements where risk justifies it. Both are voluntary and certified by accredited certification bodies, so the choice depends on what customers and boards need.

Who certifies ISO 37301 in Ireland?

Ask for a certification body accredited by INAB or within the international recognition arrangements that covers ISO 37301. INAB's published list does not name the standard, so request the scope document before you commit. Sterling builds the compliance system and does not issue the certificate.
