In short

GDPR compliance in Munich at a glance

Data-protection questions in Munich reach businesses through three routes: the technology firms that process other people's data, the life-science organisations that run clinical studies, and the many smaller companies that simply hold customer records. Bavaria's supervisory office for non-public bodies, the BayLDA, publishes guidance and a checklist aimed at small businesses, and it takes breach notifications. GDPR is an EU regulation rather than a certificate, so compliance means evidence: records of processing, risk and impact assessments, processor contracts, data-subject procedures and a rehearsed breach routine. Sterling helps Munich organisations assemble and test that evidence from its Frankfurt office, with Effivity holding the registers; the national legal detail sits on the Germany page.

Requirements

What GDPR requires

Strip away the vocabulary and the GDPR requires an organisation to comply in six areas covering how it uses personal data.

Every use of data has a lawful basisEach processing purpose is identified and rests on a lawful basis, with data limited to what that purpose needs.
People are informed and their rights respectedClear privacy information is given, and requests to access, correct, erase or object are answered within the regulation's time limits.
Accountability is documentedRecords of processing, policies and, where required, a data protection officer show how you comply.
Privacy is designed in and risks assessedData protection is built into systems by design and by default, with impact assessments for high-risk processing.
Data is secured and breaches handledAppropriate security protects personal data, and breaches are recorded and notified to the authority and individuals where required.
Processors and transfers are controlledProcessors work under compliant contracts, and transfers outside the EEA rely on a recognised transfer mechanism.

GDPR in Munich: questions clients ask

Which authority supervises GDPR for a company based in Munich?

For most private companies in Bavaria it is the BayLDA, the state's data protection supervisory office for non-public bodies. Groups with several German establishments may fall under a different authority through the main-establishment rule, so confirm the competent office with your legal adviser before filing anything.

Is there a GDPR certificate a Munich company can obtain?

There is no general GDPR certificate that proves compliance on its own. Companies show it through documented records, assessments and tested procedures, and many add ISO 27701 or ISO 27001 so that an independent audit examines the privacy and security controls. Check with your counsel which evidence your regulator or customers will accept.
