ISO 37301 certification in Germany at a glance
One German instrument bears on ISO 37301. It does not name the standard. So why do buyers in Germany keep asking for the certificate?
Owners and managers who fail to take the supervisory measures needed to prevent breaches of duty commit an administrative offence under § 130 of the Gesetz über Ordnungswidrigkeiten, where a breach occurs that proper supervision would have prevented or made significantly harder. German law does not say what those measures must look like. ISO 37301 is the international answer: a compliance management system with an obligations register, compliance risk assessment, defined responsibilities, training, monitoring, investigation and management review. It also gives the internal reporting office required by the Hinweisgeberschutzgesetz — for employers that usually have at least 50 employees, and certain financial firms regardless of size — a place in a wider system instead of standing alone. Companies already handling GDPR, NIS-2 or DORA duties use it to coordinate them. Certification is by a certification body accredited by DAkkS or another recognised accreditation body. Sterling's Frankfurt office implements the system with 8,100+ client engagements in 60+ countries behind its method. Questions follow.
Who needs ISO 37301 in Germany, and what happens without it
In Germany the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Management of companies exposed to regulatory breaches§ 130 OWiG ties liability to omitted supervisory measures.
- Employers with at least 50 employees and certain financial firmsHinSchG requires an internal reporting office.
- Regulated sectors juggling several regimes (data protection, NIS-2, DORA)One compliance management system coordinates obligations across regimes.

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.
In Germany these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How long does ISO 37301 certification take in Germany?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Germany these are the factors that set the timeline.
- Breadth of compliance obligations in scope
- Existing compliance organisation and reporting office
- Number of entities and countries
- Certification-body availability
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 37301 certification cost in Germany?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Germany these factors move both.
- Number of entities and obligation areas
- Compliance tooling and training
- Certification body fees quoted separately from consulting
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 37301 consultants and certification bodies in Germany
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Germany are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 37301 in Germany (3)
| Instrument | How it treats the standard |
|---|---|
| Gesetz über Ordnungswidrigkeiten (OWiG) § 130 | Expected in practice Owners must take the supervisory measures required to prevent breaches of duty; no standard named. |
| Hinweisgeberschutzgesetz (HinSchG) § 12 | Related Internal reporting office duty; the threshold applies to employers 'mit jeweils in der Regel mindestens 50 Beschäftigten'. |
| DAkkS accreditation of management-system certification bodies (DIN EN ISO/IEC 17021-1) | Market driver Accredited certification is available through Germany's national accreditation body; no mandate. |
"Expected in practice" means the instrument asks for the outcomes ISO 37301 covers without naming a standard, and ISO 37301 is what buyers and regulators commonly accept as evidence of them.
Accreditation, audit language and remote audits in Germany
Use a certification body accredited for this standard by DAkkS or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37301 hub →
Audit language
Audits are held in German or English; agree the audit language and the language of controlled documents with the certification body at application.
Remote and on-site
Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.
ISO 37301 in Germany: questions clients ask
What does § 130 OWiG mean for compliance management?
It ties management liability to omitted supervision. An owner who leaves out the supervisory measures required to prevent breaches of duty commits an administrative offence under § 130 OWiG where a preventable breach occurs. The section names no standard, so a compliance management system is a way to organise those measures. Take advice on your own exposure.
Does ISO 37301 cover whistleblowing?
Yes, raising concerns is part of the standard. The German legal duty is separate: § 12 HinSchG requires employers with usually at least 50 employees to set up an internal reporting office. ISO 37301 and that duty can be run together, though the statute is what sets the legal minimum. Confirm details with counsel.
Is ISO 37301 certifiable?
Yes. A management system can be certified against ISO 37301 by an accredited certification body, so certification is a normal option and not just a guideline for internal use. Check the body's accreditation scope for this standard when you compare quotations, and confirm which edition of the standard it will audit against.
