In short

ISO 37001 certification in Germany at a glance

Two German instruments bear on ISO 37001. Not one of them names it. So why do buyers in Germany keep asking for the certificate?

Commercial bribery is a criminal offence under § 299 of the German Criminal Code, which covers employees and agents who demand or accept advantages for unfair preference in purchasing, and those who offer them. Alongside it, § 130 of the Administrative Offences Act makes it an offence for a business owner to omit the supervisory measures needed to prevent such breaches, including the careful selection and monitoring of supervisory staff. Neither provision mentions a management standard, but both reward a company that can show what it did to prevent bribery. ISO 37001 gives that showing a structure: a bribery risk assessment, due diligence on business associates, gift and hospitality controls, financial and non-financial controls, and a way to raise concerns — which, for employers with at least 50 staff, can use the internal reporting office the Hinweisgeberschutzgesetz already requires. Certification is by an accredited certification body. Sterling's consultants work from Frankfurt and include Effivity and Sterling Academy. Questions follow.

The need

Who needs ISO 37001 in Germany, and what happens without it

In Germany the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Companies selling to public and private buyers through intermediariesCommercial bribery by employees or agents is a criminal offence under § 299 StGB.
  • Owners and management of companies of any size§ 130 OWiG makes omitted supervisory measures an administrative offence where a breach follows.
  • Employers with an internal reporting officeHinSchG reporting channels feed the anti-bribery system's concern-raising process.

ISO 37001 requirements in Germany

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In Germany these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in Germany?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Germany these are the factors that set the timeline.

  • Bribery risk assessment across markets and intermediaries
  • Due diligence on business associates
  • Existing compliance and whistleblowing arrangements
  • Certification-body availability

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in Germany?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Germany these factors move both.

  • Number of entities, markets and intermediaries in scope
  • Due-diligence volume
  • Certification body fees quoted separately from consulting

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in Germany

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Germany are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37001 in Germany (3)

    InstrumentHow it treats the standard
Strafgesetzbuch (StGB) § 299 — Bestechlichkeit und Bestechung im geschäftlichen VerkehrExpected in practice
The offence applies to employees and agents of companies; no management standard named.
Gesetz über Ordnungswidrigkeiten (OWiG) § 130Expected in practice
Supervisory measures, including selection and monitoring of supervisory persons; an anti-bribery management system documents them; no standard named.
    Hinweisgeberschutzgesetz (HinSchG) § 12Related
Internal reporting office duty for employers with 'in der Regel mindestens 50 Beschäftigten'.

"Expected in practice" means the instrument asks for the outcomes ISO 37001 covers without naming a standard, and ISO 37001 is what buyers and regulators commonly accept as evidence of them.

Accreditation, audit language and remote audits in Germany

Use a certification body accredited for this standard by DAkkS or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37001 hub →

    Audit language

Audits are held in German or English; agree the audit language and the language of controlled documents with the certification body at application.

    Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 37001 in Germany: questions clients ask

Is ISO 37001 required by German law?

No German law requires it. § 299 StGB makes bribery and corruption in commercial practice by employees or agents of a company a criminal offence, and § 130 OWiG expects supervisory measures, but neither names a management standard. They create an expectation rather than a mandate. Confirm your exposure with counsel.

How does ISO 37001 relate to § 130 OWiG?

§ 130 OWiG makes it an administrative offence for an owner to omit the supervisory measures needed to prevent breaches, including the selection and monitoring of supervisory persons, where proper supervision would have prevented the breach. An anti-bribery management system documents those measures. The section itself names no standard.

Can our HinSchG reporting office be used for bribery concerns?

Probably, subject to how you set it up. § 12 HinSchG requires an internal reporting office from employers with usually at least 50 employees, and the anti-bribery system's concern-raising process can use that channel. Whether bribery concerns may go through the same office is for your counsel to confirm.
