In short

ISO 42001 certification in Belgium at a glance

Law of 3 December 2017 establishing the Data Protection Authority (Wet tot oprichting van de Gegevensbeschermingsautoriteit) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Belgium ask for evidence that you meet it.

Customers do not ask Belgian AI teams for a certificate because the law says so; they ask because they need to trust how models are built, tested and monitored. Where AI processes personal data, the GDPR applies under the supervision of the Gegevensbeschermingsautoriteit, and financial and health-sector buyers extend their third-party risk questions to AI suppliers. ISO/IEC 42001 gives an auditable management system for that: an inventory of AI systems, impact assessment, data and model controls, human oversight and monitoring. Certification is issued by a body whose accreditation scope covers the standard, which for a recent standard deserves a careful check against BELAC's listings. Sterling prepares the system from Enschede alongside ISO/IEC 27001 and ISO/IEC 27701 work. The questions Belgian teams ask most about legal status, GDPR links and the audit follow below.

The need

Who needs ISO 42001 in Belgium, and what happens without it

In Belgium the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Software and AI product companiesEnterprise customers ask how AI systems are governed, tested and monitored.
  • Organisations using AI on personal dataAI use that involves personal data sits under the GDPR, supervised by the Gegevensbeschermingsautoriteit.
  • Financial and health-sector suppliersRegulated customers extend third-party risk questions to AI providers.

Requirements

ISO 42001 requirements in Belgium

Strip away the vocabulary and ISO/IEC 42001 requires a company to prove six things about how it governs the AI it builds or uses.

You know where AI is usedThe AI systems you develop, provide or use are identified, together with the role your organisation plays for each.
Leadership sets the rules for AITop management sets an AI policy and objectives, assigns accountability and provides resources for responsible use.
You assessed AI risks and impactsRisks from AI systems, and their impacts on individuals, groups and society, are assessed before and during use and then treated.
Each AI system is managed through its lifeDesign, data, testing, deployment, monitoring and retirement follow defined processes with records you can show.
Data and third parties are under controlThe quality and origin of data, and suppliers of models or components, are managed against your own requirements.
You monitor, audit and improveAI systems and the management system are monitored, audited internally and reviewed by management, with problems corrected.

In Belgium these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO/IEC 42001 explained →

How Sterling gets a Belgian company certified

How to get ISO 42001 certified in Belgium

One team from the Enschede office carries the work from scoping to certificate. Clients in Belgium are served from Sterling's Enschede office, on-site where the work needs it and remotely otherwise.

  1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
  2. Gap assessment against ISO/IEC 42001 and the Belgian requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
  3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
  4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
  5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.

Time

How long does ISO 42001 certification take in Belgium?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Belgium these are the factors that set the timeline.

  • Inventory of AI systems and use cases
  • Existing risk, data governance and model-testing practices
  • Supplier and third-party model dependencies
  • Certification body scheduling around the summer holiday period

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 42001 certification cost in Belgium?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Belgium these factors move both.

  • Number of AI systems and teams in scope
  • Depth of impact assessment and testing evidence
  • Certification body audit fees quoted separately from consulting
  • Integration with ISO/IEC 27001 and ISO/IEC 27701

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 42001 consultants and certification bodies in Belgium

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 42001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Belgium are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 42001 in Belgium (3)

InstrumentHow it treats the standard
Regulation (EU) 2016/679 (GDPR)The regulation itself
Applied in Belgium with the Gegevensbeschermingsautoriteit as the competent supervisory authority.
Law of 3 December 2017 establishing the Data Protection Authority (Wet tot oprichting van de Gegevensbeschermingsautoriteit)The instrument itself
Article 4 makes the Authority the competent supervisory authority unless another law provides otherwise; published 10 January 2018, in force 25 May 2018.
Royal Decree of 31 January 2006 creating the BELAC system for accreditation of conformity assessment bodiesThe system itself
It sets the national accreditation framework that certification bodies work within; the decree does not name any ISO management system standard.

Accreditation, audit language and remote audits in Belgium

Use a certification body accredited for this standard by BELAC, the national accreditation body, or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that its accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO/IEC 42001 hub →

Audit language

Dutch, French and German are the official languages and English is common in business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

Remote and on-site

Audits combine remote document review with on-site interviews and sampling, at the certification body's discretion.

ISO 42001 in Belgium: questions clients ask

Is ISO/IEC 42001 required in Belgium?

No Belgian rule cited here requires it. It is a voluntary management-system standard for organisations that develop or use AI, and demand comes from customers and boards. Legal duties on AI, including those from EU law, apply whether or not you certify, so seek advice from your counsel.

How does AI governance connect to the GDPR in Belgium?

When an AI system processes personal data, the GDPR applies, and the Gegevensbeschermingsautoriteit is the supervisory authority under the law of 3 December 2017. An AI management system helps document purpose, data sources, testing and oversight, which are the facts a regulator or customer will ask about. It does not settle any legal question.

What does an ISO/IEC 42001 audit examine?

Whether you know which AI systems you run, how risks and impacts were assessed, how data and models are tested and monitored, and who is accountable. The certification body samples records and interviews staff. Sterling prepares the inventory, policies and evidence in advance, but the independent audit decides.

Who certifies ISO/IEC 42001?

A certification body accredited for the standard, not Sterling. BELAC is the Belgian accreditation route, but this standard is new, so check carefully that the body's accreditation scope or transition status actually covers it. Ask for the written scope, and compare it with the customers who will rely on the certificate.
