Why clients choose SterlingWhat it is
What is the PIPL and what is it used for?
The Personal Information Protection Law of the People's Republic of China, known as the PIPL, is the national statute on handling personal information. It sets when processing is lawful, gives individuals rights, places duties on the organisations that decide how information is handled (personal information processors), adds stricter rules for sensitive categories and controls provision of personal information outside China.
It reaches beyond China's borders. Processing inside mainland China is covered, and so is processing abroad where the purpose is to offer products or services to people in China or to analyse or assess their behaviour, and in other cases set by law or administrative regulation. The Cyberspace Administration of China (CAC) coordinates protection work and supervision nationally, with other State Council departments acting within their own remit.
Current text. The PIPL was adopted on 20 August 2021 at the thirtieth session of the Standing Committee of the thirteenth National People's Congress and has applied since 1 November 2021, in 8 chapters and 74 articles. CAC measures on compliance audits apply from 1 May 2025, and CAC and State Administration for Market Regulation measures on certification for outbound transfers apply from 1 January 2026.
Who it is for
Who needs PIPL compliance?
Any organisation handling personal information in mainland China falls within the law, whatever its size, and so can a company abroad that sells into China. Clients usually come to Sterling for one of four reasons:
- A customer or partner sends a data protection questionnaire. Buyers, platforms and banks ask how Chinese personal information is protected and transferred, and expect records, not just a policy.
- A tender or partnership requires evidence of compliance. Joint ventures and outsourcing bids now carry PIPL clauses, audit rights and transfer terms.
- The regulator's rules now touch your operations. Compliance audits, standard contract filings and the transfer certification route turn principles into dated tasks.
- Group companies share personal information across borders. Regional HR systems, global CRMs and offshore support desks each create an outbound flow that needs its route decided.
Compliance is a state you maintain, not a document you obtain.
Requirements
What are the main PIPL requirements?
The law has eight chapters; the obligations an organisation operates sit mainly in the five below, with sensitive information a section of its own. This is a summary at title level; your programme is checked against the text itself, with your legal advisers.
- General provisions: scope, including processing outside China aimed at people in China, and principles of lawfulness, necessity, openness, accuracy and security.
- Processing rules: a legal basis for every activity, from consent to contract, human resources management and legal obligations; informed and separate consent where the law requires it; limits on retention; entrusted processing and sharing under agreed terms.
- Sensitive personal information: biometrics, health, financial accounts, whereabouts, religious belief, specific identity and the information of children under fourteen, processed only for a specific purpose and where sufficiently necessary, with strict protection measures and the individual's separate consent.
- Cross-border provision: one of the recognised routes before information leaves China, which are the CAC security assessment, personal information protection certification or the CAC standard contract, plus local storage where the law requires it.
- Individuals' rights: to know and decide, access and copy, transfer to another processor where CAC conditions are met, correct, delete, have processing rules explained and, for next of kin, certain rights after death, with a mechanism for handling requests.
- Processor obligations: internal rules, classification, encryption and access control, training, incident plans, a person in charge and a representative in China where required, regular compliance audits, impact assessments and breach notification.
What does useful PIPL evidence look like?
A processing inventory that names systems, purposes and legal bases; consent records that show what people agreed to and when; impact assessment reports kept for the three years the law requires; a register of outbound flows with the route chosen for each; entrusted-processing agreements; the request log; incident records; and the latest compliance audit with its corrective actions. We build them from real processing and keep them in Effivity.
Compliance route
How do you achieve PIPL compliance?
There is no certificate at the end of a PIPL programme. The outcome is an organisation that can demonstrate compliance: to the CAC or another competent department, to the auditors who conduct its compliance audits and to its own customers.
- 01Establish scope and roles.Identify the entities, systems and data subjects involved, whether Article 3 reaches you from outside China, and whether a representative in China or a person in charge is needed.
- 02Gap analysis: compare current practice with the law.Inventory processing and outbound flows, test notices, consents, contracts and security controls against each chapter, and agree actions with owners and dates.
- 03Implement controls and choose transfer routes.Settle legal bases, rewrite notices, complete impact assessments, prepare the security assessment filing, standard contract or certification each flow requires, and train the people involved.
- 04Conduct the compliance audit. An internal audit, or one by a professional institution you commission, tests processing against the law; findings are corrected with evidence and reported to management.
- 05Maintain and respond.Keep the inventory and routes current as systems change, answer requests and incidents on record, repeat audits on the required cycle and meet regulator or customer reviews from existing evidence.
Check the route before you sign. If you choose the certification route, confirm that the certification institution has filed with the CAC, which publishes the institutions that have completed filing, and verify its qualification directly. Treat any offer of a "PIPL compliance certificate" issued in days with suspicion: no such certificate exists for compliance with the law as a whole. The certification buyer's checklist
Cost
How much does PIPL compliance cost?
Cost depends on how personal information moves through your organisation more than on headcount. A subsidiary with local systems needs less effort than a group running Chinese data on global platforms. A Sterling proposal lists every element and states everything that is included.
| Cost component | What affects it |
|---|---|
| Consulting and implementation | Processing activities, systems, outbound flows, sensitive categories, entities in scope and how much work your team takes on (Design™ or Drive™) |
| Transfer routes and external reviews | Which route each flow needs, and fees of any certification or audit institution you commission, shown separately |
| Internal resources and legal | System-owner time, IT changes, training hours and your legal advisers' review |
| Software and learning | Included in a Sterling engagement: Effivity for the programme and Sterling Academy access for your people, with users, courses and access period confirmed in the proposal |
| Continued support | Recurring compliance audits, impact assessments for new projects, route reviews and regulatory watch under Sustain™ |
What moves the price
- Volume and sensitivity of the personal information that leaves China
- Number of entities, systems and overseas recipients
- Whether a data inventory and an ISO/IEC 27001 system already exist
- Languages, with Chinese documentation normally required
- Deadlines set by a customer, an audit cycle or a regulator
What a Sterling proposal always shows
- Scope, deliverables, responsibilities and exclusions in writing
- Third-party institution fees identified separately from Sterling's fee
- Effivity, training and Academy access itemised at no additional cost
- Milestones tied to deliverables rather than dates alone
- One all-inclusive proposal, agreed before work begins
Timeline
How long does PIPL compliance take?
Most organisations need four to nine months to reach a programme they can defend, a working estimate rather than a regulatory figure. Many outbound flows, sensitive categories and route filings push it longer; decisions and authority procedures take more time than documents.
| Phase | What determines the pace |
|---|---|
| Scope and gap analysis | Access to system owners, contracts and group data flows, and how quickly the inventory can be completed |
| Build and implementation | Decisions on legal bases and retention, notice and consent changes, impact assessments and IT work on security and localisation |
| Transfer routes | Preparation of assessment or filing documents, negotiation with overseas recipients and the timetable of the authority or certification institution |
| Audit and review | Controls operating long enough to leave records, then the compliance audit, corrections and management review |
Share any fixed customer or audit date at the start, and we will say plainly what is achievable.

Effivity · privacy programme software, included in every engagement
How Effivity helps you fulfil, automate and simplify the requirements of the PIPL.
Every Sterling PIPL engagement includes Effivity, the ISO and GRC automation platform built by the Sterling group and used in 50+ countries. Your consultant sets up the workspace within the agreed scope, so the processing inventory, impact assessments, outbound flow register, rights requests, incidents, audits, corrective actions and training records sit in one system that your teams use every day. Sterling consulting clients get their Effivity subscription included with the engagement, at no additional cost.

Scope, entities and principles
The entities, systems and people in scope recorded once, with the reasoning on whether the law reaches operations outside China, reviewed whenever the business changes.
Processing inventory and legal bases
Each activity with its purpose, legal basis, retention period and system owner, so consent records and notices can be traced to the processing they cover.
Sensitive categories and separate consent
Biometric, health, financial and location data flagged in the inventory, with the specific purpose, protection measures and consent evidence attached.
Outbound flow register and routes
Every flow leaving China logged with recipient, categories, volume and the route chosen, with filing documents and renewal dates tracked to completion.
Requests from individuals
Access, correction, deletion and explanation requests received, verified, answered and closed on record, with response times visible to management.
Impact assessments and incidents
Impact assessment reports stored for the retention period the law sets, and incidents handled through a workflow that records remedial action and notifications.
Compliance audits and corrective action
Audit programmes, checklists, findings and corrective actions in one place, ready for the next cycle or for an audit an authority requests.
Your own forms, workflows and reports
Fields, approvals and reports configured to your organisation without code, with PIPL obligations linked to the processes and systems they affect.
What this means at the audit
A compliance auditor or a customer asks for the inventory, the impact assessments, the transfer routes, the request log and the last audit report. In Effivity each is a screen with owners, dates and evidence, not a set of files collected in a hurry. Sustain™ works in the same workspace, so the next audit cycle picks up where the last one ended.

The Sterling Promise
What our PIPL success guarantee means
We stay with you until your agreed PIPL programme outcome is achieved, supporting implementation, preparation and the resolution of audit findings. Clear explanations, practical delivery, included software and employee learning turn the investment into lasting capability rather than a file of policies.
The engagement identifies the law, scope, outcome and responsibilities. Your organisation supplies accurate information and puts the agreed controls into use. The authorities, certification institutions and your customers form their own conclusions. Our commitment concerns the agreed compliance support, not a promise of every future contract award or regulatory outcome.
FAQs
Frequently asked questions about the PIPL
Does the PIPL apply to companies outside China?
Yes, in some cases. Article 3 extends the law to processing outside China that aims to offer products or services to people in China or to analyse or assess their behaviour, and Article 53 requires such processors to set up a dedicated body or appoint a representative in China.
How is the PIPL different from the GDPR?
The two laws share principles, but their mechanics differ. The PIPL lists no legitimate-interests basis, requires separate consent for sensitive information, sharing with other processors and transfers abroad, and ties outbound transfers to CAC routes. A GDPR programme helps but does not substitute.
Which organisations must carry out PIPL compliance audits?
All processors must audit their compliance regularly under Article 54. The CAC measures in force since 1 May 2025 require processors handling the personal information of more than 10 million individuals to audit at least once every two years, internally or through a professional institution, and allow authorities to order an audit where risks arise.
Do we need a security assessment to send personal information abroad?
Not always. The route depends on whether you operate critical information infrastructure and on the volume and sensitivity of what leaves China. Some flows need the CAC security assessment; others may use the standard contract or certification, and certain flows are exempt under the CAC's 2024 provisions on cross-border data flows.
Can Sterling give us a PIPL certificate?
No. Sterling does not certify. Certification for outbound transfers is carried out by professional institutions that have filed with the CAC, and compliance with the law as a whole has no certificate.
