What it is

What is Morocco's Law 09-08 and what is it used for?

Law No. 09-08 on the protection of individuals with regard to the processing of personal data is Morocco's personal data protection law. It covers the processing of personal data of individuals by public and private bodies. Processing is either declared to the CNDP or, for the categories the law lists (including sensitive data), authorised in advance by it (Article 12). The CNDP's FAQ states that a body may start a processing only after receiving the declaration receipt or a written authorisation, and the CNDP keeps a public register of notified processing.

The Commission Nationale de contrôle de la protection des Données à caractère Personnel (CNDP) supervises Law 09-08. The practical test: for any personal data you hold, could you show its purpose and basis, who was told, how it is protected and where it goes?

Current law. Law No. 09-08, promulgated by Dahir No. 1-09-15 of 18 February 2009 and published in the Official Bulletin No. 5714 of 5 March 2009. The CNDP's FAQ gives 23 February 2009 as the date it entered into force. Confirm current wording and the authority's guidance with your legal advisers.

Who it is for

Who needs to comply with Morocco's Law 09-08?

The Law reaches organisations of every size that handle personal data in Morocco. Organisations usually come to Sterling for a structured programme from one of four directions:

  • Any company, public body or association processing personal data in Morocco. The law covers the processing of individuals' personal data, and processing is either declared to the CNDP or authorised by it in advance.
  • Banks, insurers, health and education providers handling sensitive data. Sensitive and health data need prior authorisation and extra security controls.
  • Offshoring and call-centre firms serving clients abroad. Moving personal data to another state is allowed only to a state with a sufficient level of protection or under a listed exception, and the CNDP handles transfer requests.
  • Marketers and e-commerce firms. Direct marketing by automated calls, fax or e-mail needs the person's prior consent, and people may object to marketing at no cost.

The aim is handling of personal information that you control and can evidence. Compliance depends on how the rules are applied every day, not on a policy document alone.

Requirements

What are the main Morocco Law 09-08 requirements?

Strip away the vocabulary and Morocco's personal data law requires a business to comply in six areas of personal data handling. The list below puts each one in business terms; the Law and the regulator's guidance give the full wording and exceptions.

  • Declare or seek authorisation first: each processing is declared to the CNDP, or authorised in advance where the law lists it, and starts only after the receipt or written authorisation arrives.
  • Process fairly, lawfully and for set purposes: data is collected for specified, explicit and legitimate purposes, kept accurate and no longer than needed, and handled with the person's clear consent unless an exception applies.
  • Inform people and honour their rights: people are told who collects their data and why, and can access, correct or object to it, including objecting to marketing at no cost.
  • Protect the data and bind processors: controllers apply suitable technical and organisational measures, and processors work only on the controller's instructions under a written contract giving security guarantees.
  • Control transfers abroad: data goes to another state only if it protects privacy sufficiently, or under a listed exception, and the CNDP authorises transfers in the cases it lists.
  • Take extra care with sensitive data: sensitive and health data need prior authorisation and stronger access controls, direct marketing needs prior consent, and automated profiling cannot alone decide a person's legal position.

What does useful Morocco Law 09-08 evidence look like?

Your evidence is your own records: notices, consent, the record of processing, security measures, processor and transfer arrangements, breach handling and requests answered. We build these records into Effivity so they stay current rather than being assembled after a complaint.

Compliance route

How do you achieve Morocco Law 09-08 compliance?

There is no certificate at the end of this route. Compliance is something your organisation demonstrates, to the CNDP if a complaint or incident arises, and to customers who ask. Sterling helps you build and run the programme; interpretation of the law in contested cases remains with your legal advisers and, ultimately, the regulator and the courts.

  1. 01
Map the personal information you handle.Customers, staff, users and suppliers: what is collected, for which purpose, on which basis, where it is stored, who processes it for you and whether it leaves Morocco.
  2. 02
Gap analysis: compare current practice with the Law.Each area of the Law reviewed against what actually happens, with actions, owners and dates agreed.
  3. 03
Put the controls and routines in place.Complete the formalities the Law asks for, rewrite notices and consent wording, put security measures and processor contracts in place, name who is responsible and agree a breach procedure.
  4. 04
Test the programme and review the results.Internal review of samples, a simulated incident or data-subject request, and a management review that closes findings with evidence.
  5. 05
Operate, demonstrate and keep it current.Answer requests, record incidents and report them as the Law requires, keep formalities current, review transfers, refresh training and follow the CNDP's guidance as it is issued.

Check the route before you sign. The Law creates no certificate of compliance, so treat any offer of a "Morocco Law 09-08 certificate" with suspicion. If a customer wants independent assurance, ISO/IEC 27701 or ISO/IEC 27001 is certifiable by an accredited certification body; confirm the body's accreditation scope directly with the accreditation body concerned.

Cost

How much does Morocco Law 09-08 compliance cost?

The cost of a Morocco Law 09-08 programme is driven by how much personal information you hold, how many systems and suppliers touch it, and how much already works. Your proposal shows each component, with what is included and what remains for your legal advisers.

Cost componentWhat affects it
Consulting and implementationNumber of legal entities and business units, volume and sensitivity of the data, and whether you choose Design™ or Drive™
Legal reviewAny advice you take from your own legal advisers on contested interpretations or contract wording, arranged separately
Internal resourcesTime from the privacy officer, system owners and managers, plus any security or process changes the gap analysis identifies
Software and learningIncluded in a Sterling engagement: Effivity for registers and evidence and Sterling Academy access for your people, confirmed in the proposal
Continued supportPeriodic reviews, refresher training, incident exercises and updates when the law or your systems change, under Sustain™

What changes the scope

  • How many processing activities, systems and processors are involved
  • Formalities with the CNDP still to complete
  • Processor contracts and security measures to put in place
  • Transfers outside Morocco and the safeguards behind them
  • Deadlines set by a customer, contract or incident

What every Sterling proposal states

  • Deliverables, assumptions, exclusions and who does what
  • What remains for your legal advisers, stated plainly
  • Effivity, training and Academy access itemised at no additional cost
  • Payments linked to delivered milestones
  • Every component shown, so nothing is added later

Timeline

How long does Morocco Law 09-08 compliance take?

Timing depends on how scattered your personal information is, how quickly system owners respond and how much has to change. Your proposal sets out the phases for your scope, long enough to map the information, fix the gaps and show that requests and incidents are handled the way the procedures say.

PhaseWhat sets the pace
Mapping and gap analysisAccess to system owners, supplier contracts and existing notices and policies
ImplementationNotice rewrites, supplier contract updates, security changes and approvals
Testing and reviewTime for requests and incidents to run through the new routines, then internal review and management review
Ongoing operationRefresher training, processor changes, transfer reviews and new guidance from the CNDP

If a customer or contract has set a date, tell us at the outset and we will say plainly what can be in place by then and what should follow.

Registration and formalities

Declare or seek authorisation first

Each processing is declared to the CNDP, or authorised in advance where the law lists it, and starts only after the receipt or written authorisation arrives.

Lawful processing

Process fairly, lawfully and for set purposes

Data is collected for specified, explicit and legitimate purposes, kept accurate and no longer than needed, and handled with the person's clear consent unless an exception applies.

Data-subject rights

Inform people and honour their rights

People are told who collects their data and why, and can access, correct or object to it, including objecting to marketing at no cost.

Processors

Protect the data and bind processors

Controllers apply suitable technical and organisational measures, and processors work only on the controller's instructions under a written contract giving security guarantees.

Transfers

Control transfers abroad

Data goes to another state only if it protects privacy sufficiently, or under a listed exception, and the CNDP authorises transfers in the cases it lists.

Sensitive data

Take extra care with sensitive data

Sensitive and health data need prior authorisation and stronger access controls, direct marketing needs prior consent, and automated profiling cannot alone decide a person's legal position.

Processors

Suppliers

Processors listed with their contracts and the oversight carried out on each one.

Breaches

Incidents and reports

Incidents recorded with the decision to report and the corrective action, in one trail.

What this means when someone asks

When a customer's due diligence team, a data subject or the CNDP asks how you handled something, the answer is a record: the request and its response date, the incident and the decisions taken, the notice that applied. Sustain™ runs in the same workspace, so the programme keeps producing that evidence year after year.

  • Configured by your Sterling consultant within the agreed scope
  • Existing registers and policies migrated, not retyped

FAQs

Frequently asked questions about Morocco's Law 09-08

Do all personal data processing activities in Morocco need CNDP approval?

Processing must be declared to the CNDP, or authorised beforehand where the law lists the category, such as sensitive data. The CNDP's FAQ says a body may begin only after it receives the declaration receipt or a written authorisation. Which regime applies to your activity is a legal question, so confirm it with the CNDP or counsel.

Can a Moroccan company send customer data to a service provider abroad?

Only under the law's transfer rules. The destination state should give a sufficient level of protection, and otherwise a listed exception such as consent, a contract or CNDP authorisation must apply. The CNDP's page adds that a transfer authorisation follows only a declared or authorised processing. Map your transfers first, then raise the open cases with the Commission.

Does Law 09-08 require a breach notification or a data protection officer?

The law contains neither a breach-notification duty nor a data protection officer duty, unlike several recent laws elsewhere. Security, processor contracts, declarations and individual rights are the core. Because the CNDP may issue deliberations, guides and forms, check its current publications. Keep an incident procedure anyway, since customers and sector regulators may expect one.

Is Law 05-20 on cybersecurity the same as the data protection law?

No. Law 05-20 sets security rules for public entities, vital infrastructure and certain operators, under DGSSI, while Law 09-08 protects individuals whose personal data is processed, under the CNDP. A company can fall under both. Treat security measures as the point where they meet, and ask each authority which texts apply to your category.
