In short

PCI DSS compliance in Spain at a glance

In Spain, PCI DSS is asked for by buyers and schemes rather than required by law. The drivers below show where the pressure comes from.

No Spanish regulator audits PCI DSS compliance. The PCI Security Standards Council says that enforcement of its standards, and any penalties for non-compliance, rest with the payment brands and acquiring banks, while the Council itself writes the standards and qualifies the assessors who validate compliance. For a merchant, payment provider or outsourcer in Spain, the starting point is therefore the acquirer: which level of validation applies, whether a Qualified Security Assessor or a self-assessment, and over which systems. Call centres and BPO operations handling card data for overseas clients often face the same request from the client's own contract. Sterling does not validate. Sterling's Enschede office scopes the cardholder data environment, helps reduce it through segmentation, closes the technical and policy gaps and prepares evidence for the assessor, with Effivity and Sterling Academy included with the engagement.

The need

Who needs PCI DSS in Spain, and what happens without it

These are the organisations in Spain that most often need to show PCI DSS.

  • Merchants and e-commerce businesses that accept payment cardsPayment brands and acquiring banks, not the PCI Council, enforce compliance and decide what validation each merchant must show.
  • Payment service providers, hosting firms and outsourcers that store, process or transmit card dataCustomers and acquirers ask service providers for validated compliance before they send card data.
  • Contact centres and BPO operations handling card data for overseas clientsClients abroad often require proof of PCI DSS compliance as a condition of the service contract.

Requirements

PCI DSS requirements in Spain

Strip away the vocabulary and PCI DSS asks any business that stores, processes or transmits card data to comply in six areas.

You know where card data livesThe cardholder data environment is scoped, data flows are mapped and the environment is segmented where possible.
Networks are protectedNetwork security controls restrict traffic to and from systems that handle card data, and configurations are hardened.
Stored data is minimised and protectedOnly the card data you need is kept, sensitive authentication data is not retained after authorisation except under issuer rules, and the rest is protected.
Access is restricted and authenticatedAccess to card data is limited to people who need it, with unique IDs and multi-factor authentication where required.
Systems are logged and testedActivity is logged and reviewed, vulnerabilities are scanned and patched, and penetration testing is carried out.
Policies and people keep it runningSecurity policies, staff awareness, vendor management and incident response keep controls working between assessments.

In Spain these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: PCI DSS explained →

Time

How long does PCI DSS compliance take in Spain?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Spain these are the factors that set the timeline.

  • Size of the cardholder data environment
  • Segmentation of networks from card systems
  • Number of service providers and payment channels
  • Evidence of testing, logging and policy operation

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does PCI DSS compliance cost in Spain?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Spain these factors move both.

  • Scope and complexity of the environment
  • Technical remediation and segmentation
  • Assessor fees agreed directly with the assessor
  • Tooling for logging, scanning and access control

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

PCI DSS consultants and assessors in Spain

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers PCI DSS and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Spain are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive PCI DSS in Spain (2)

    InstrumentHow it treats the standard
PCI Security Standards Council — role in compliance and assessmentScheme rule
The Council develops the standards and qualifies assessors who validate compliance; enforcement and any penalties are carried out by the payment brands and acquiring banks, not by the Council.
PCI Security Standards Council — standards and qualified professionalsScheme rule
Publishes PCI DSS and lists PCI qualified professionals, including assessors; no Spanish law requires PCI DSS, so the requirement arises from contracts with brands, acquirers and customers.

Accreditation, audit language and remote audits in Spain

Compliance, not certification: PCI DSS compliance is validated either by a Qualified Security Assessor or by a self-assessment, depending on what the payment brands and your acquirer require. Sterling prepares you; it does not validate. Use an assessor listed by the PCI Security Standards Council and ask your acquirer which validation level applies. Edition and transition details: PCI DSS hub →

    Audit language

Agree the language of the compliance report and of the evidence with the assessor and your acquirer.

    Remote and on-site

Interviews and system walk-throughs can be remote; reviews of data centres and card-handling premises are normally on-site.

PCI DSS in Spain: questions clients ask

Does any Spanish law require PCI DSS?

The PCI Security Standards Council publishes the standard, and the Council states that enforcement and any penalties are for the payment brands and acquiring banks, not for itself. The requirement therefore arises from your contracts with brands, acquirers and customers rather than from a national statute. Ask your acquirer what validation it needs from you.

Do we need a Qualified Security Assessor or can we self-assess?

That depends on the payment brands and your acquiring bank. Compliance is validated either by a Qualified Security Assessor or by a self-assessment, according to what they require of your merchant or service provider level. Your acquirer can tell you which applies. Sterling prepares your environment and evidence but does not validate.

    Who enforces PCI DSS compliance?

The payment brands and acquiring banks. The PCI Security Standards Council says enforcement of compliance and the setting of any non-compliance penalties are carried out by the individual brands, and that the Council itself develops the standards and qualifies and lists assessors. A Spanish regulator does not run the programme, so your acquirer is your first contact.

Is a PCI DSS compliance report the same as ISO 27001 certification?

No. PCI DSS compliance is validated by an assessor or by self-assessment against the Council's standard for the cardholder data environment, and the payment brands and acquirers decide what they accept. ISO/IEC 27001 certification is issued by an accredited certification body for an information security management system. They overlap in controls but answer different requests.
