In short

ISO 45001 certification in Portugal at a glance

Lei n.º 102/2009, de 10 de setembro (regime jurídico da promoção da segurança e saúde no trabalho) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Portugal ask for evidence that you meet it.

ISO 45001 sits on top of a statute rather than replacing one. Lei n.º 102/2009 is Portugal's regime for promoting occupational safety and health, names the Autoridade para as Condições do Trabalho and sets how employers organise safety and health services, yet it does not mention the standard. A certified system therefore proves something different: that hazards, controls, incident learning and worker consultation are run as a managed process. Manufacturers, port and logistics operators and contractors facing customer questionnaires use it for that reason. Certification comes from a body accredited by IPAC, never from Sterling. Sterling's Enschede office builds the hazard register, operational controls, consultation arrangements and internal audit, with Effivity and Sterling Academy included in the engagement. Ask the ACT or your counsel about statutory duties.

The need

Who needs ISO 45001 in Portugal, and what happens without it

In Portugal the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Employers building a management system on top of their statutory dutiesLei n.º 102/2009 sets the legal regime for occupational safety and health, and a management system gives those duties an auditable structure.
  • Manufacturers and industrial sites with machinery and process hazardsPortugal Global presents automotive, aerospace and advanced manufacturing as major industries, where customers may ask about safety performance.
  • Port, logistics and industrial free-zone operatorsOperators at Sines and in Madeira's free trade zone run cargo handling and industrial activity under the same occupational safety regime.
  • Contractors and suppliers answering customer questionnairesGroup customers and tender documents may ask for evidence of a certified safety system, though the Portuguese regime itself does not name the standard.

Requirements

ISO 45001 requirements in Portugal

Strip away the vocabulary and ISO 45001 requires a company to prove six things about keeping its people safe and healthy at work.

Leadership takes responsibility for safetyTop management is accountable for preventing work-related injury and ill health, and sets a policy and objectives to do so.
Workers have a real sayWorkers and their representatives are consulted and take part in decisions on hazards, controls, incidents and the system itself.
You know the hazards and the risksHazards are identified on an ongoing basis, risks are assessed, and health and safety legal requirements are known and met.
Controls follow the right orderRisks are reduced using the hierarchy of controls, from eliminating the hazard down to protective equipment, including for contractors.
You are prepared for emergenciesEmergency situations are identified, response plans are in place, people are trained and drills are carried out.
Incidents lead to learningIncidents and nonconformities are investigated, causes are corrected, and performance is monitored, audited and reviewed.

In Portugal these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 45001 explained →

Time

How long does ISO 45001 certification take in Portugal?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Portugal these are the factors that set the timeline.

  • Hazard profile and number of sites, shifts and contractors
  • Maturity of risk assessment, incident investigation and worker consultation
  • How safety and health services are already organised under Lei n.º 102/2009
  • Certification body scheduling around the Portuguese summer holiday period

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 45001 certification cost in Portugal?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Portugal these factors move both.

  • Size and risk level of the scope
  • Depth of hazard control and documentation remediation
  • Certification body audit fees, quoted separately from consulting
  • Worker consultation and competence development effort

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 45001 consultants and certification bodies in Portugal

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 45001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Portugal are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 45001 in Portugal (3)

InstrumentHow it treats the standard
Lei n.º 102/2009, de 10 de setembro (regime jurídico da promoção da segurança e saúde no trabalho)The instrument itself
It sets the legal regime for occupational safety and health promotion, including how employers organise safety and health services; it does not name ISO 45001.
IPAC (Instituto Português de Acreditação, I.P.) as Portugal's national accreditation bodyRecognition
IPAC's general regulation describes it as the national accreditation body under Regulation (EC) No 765/2008, covering testing and calibration laboratories, clinical laboratories, inspection, certification, validation and verification bodies.
EA directory entry for IPACRecognition
The European co-operation for Accreditation lists IPAC as an MLA signatory with scopes that include management system certification, product certification, certification of persons, inspection, calibration, testing and validation and verification.

Accreditation, audit language and remote audits in Portugal

Choose a certification body accredited for ISO 45001 by IPAC, Portugal's national accreditation body, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. No body is named here. Edition and transition details: ISO 45001 hub →

Audit language

Portuguese is the official language and English is widely used in international business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.

Remote and on-site

Stage 1 and stage 2 audits are normally on site because hazards, controls and worker participation must be observed; document review can be partly remote.

ISO 45001 in Portugal: questions clients ask

Does Portuguese law require ISO 45001 certification?

No. Lei n.º 102/2009 is the statutory regime for promoting occupational safety and health, and it does not name ISO 45001. The standard is a voluntary management system that can sit on top of those duties. Whether a customer or tender asks for a certificate depends on its own documents, and your counsel can confirm the legal duties.

Which authority is named in Portugal's occupational safety law?

The Autoridade para as Condições do Trabalho, known as the ACT. Lei n.º 102/2009 refers to it, including its advisory council on promoting safety and health at work. Ask the ACT, or your counsel, which duties apply to your sector, workforce and contractors, because certification does not decide that.

Does a certificate replace the legal safety and health services?

No. The Act requires employers to organise safety and health services, including authorised external services where that route is used, and a management system certificate does not stand in for them. The two work together: the statutory services do the legal work, and the management system gives it structure and audit evidence.

Who accredits ISO 45001 certification bodies in Portugal?

Accreditation comes from IPAC under Regulation (EC) No 765/2008, and EA lists IPAC among its MLA signatories for management system certification. Accreditation is granted scope by scope, so ask the certification body to show an IPAC scope that names occupational health and safety management and covers your industry, and confirm it before you agree an audit date.
