ISO 37301 certification in Portugal at a glance
Decreto-Lei n.º 109-E/2021, de 9 de dezembro (regime geral de prevenção da corrupção, RGPC) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Portugal ask for evidence that you meet it.
Portuguese compliance officers have a statutory profile. Decreto-Lei n.º 109-E/2021 requires entities with 50 or more workers to appoint a compliance officer from senior management, working independently and permanently with decision-making autonomy, and to run a programme with a prevention plan, code of conduct, training and whistleblowing channel, while Lei n.º 93/2021 adds reporting-channel duties. ISO 37301 is not named in either text, but it organises obligations, risks, controls, monitoring and improvement into a single auditable system, which suits groups and regulated firms that already juggle several regimes. Certificates come from bodies accredited by IPAC, never from Sterling, and do not prove legal compliance. Sterling's Enschede office maps obligations, builds the risk assessment and controls and rehearses the audit, with Effivity and Sterling Academy included with the engagement.
Who needs ISO 37301 in Portugal, and what happens without it
In Portugal the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Entities that must appoint a compliance officer under the national regimeDecreto-Lei n.º 109-E/2021 requires a compliance officer in senior management who acts independently with decision-making autonomy.
- Groups with several Portuguese entities sharing one compliance functionThe regime allows a single compliance officer for entities in a group relationship.
- Regulated firms running compliance across several lawsA management system joins obligations under data protection, cybersecurity and anti-corruption rules into one structure.
- Organisations running whistleblowing channelsLei n.º 93/2021 requires internal channels, which need governance, follow-up and records.

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.
In Portugal these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How long does ISO 37301 certification take in Portugal?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Portugal these are the factors that set the timeline.
- Compliance obligations register across laws and contracts
- Maturity of the compliance programme the national regime already requires
- Number of entities, sites and reporting channels
- Certification body scheduling around the Portuguese summer holiday period
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 37301 certification cost in Portugal?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Portugal these factors move both.
- Scope and number of compliance obligations to map
- Remediation of risk assessment, monitoring and reporting
- Certification body audit fees, quoted separately from consulting
- Culture, training and speak-up effort
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 37301 consultants and certification bodies in Portugal
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Portugal are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 37301 in Portugal (4)
| Instrument | How it treats the standard |
|---|---|
| Decreto-Lei n.º 109-E/2021, de 9 de dezembro (regime geral de prevenção da corrupção, RGPC) | The instrument itself It applies to entities with 50 or more workers and requires a compliance programme with a corruption-risk prevention plan, a code of conduct, a training programme and a whistleblowing channel under a compliance officer; it does not name ISO 37001 or ISO 37301. |
| Lei n.º 93/2021, de 20 de dezembro (protection of whistleblowers) | The instrument itself It transposes Directive (EU) 2019/1937 and obliges entities with 50 or more workers to run internal reporting channels; it does not name a management system standard. |
| IPAC (Instituto Português de Acreditação, I.P.) as Portugal's national accreditation body | Recognition IPAC's general regulation describes it as the national accreditation body under Regulation (EC) No 765/2008, covering testing and calibration laboratories, clinical laboratories, inspection, certification, validation and verification bodies. |
| EA directory entry for IPAC | Recognition The European co-operation for Accreditation lists IPAC as an MLA signatory with scopes that include management system certification, product certification, certification of persons, inspection, calibration, testing and validation and verification. |
Accreditation, audit language and remote audits in Portugal
Choose a certification body accredited for ISO 37301 by IPAC, Portugal's national accreditation body, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. The Portuguese regime does not name the standard, so a certificate shows a managed compliance system rather than legal compliance. No body is named here. Audit language
Portuguese is the official language and English is widely used in international business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.
Remote and on-site
Stage 1 and stage 2 audits are normally on site, with interviews of the compliance function and business owners; remote review is at the certification body's discretion.
ISO 37301 in Portugal: questions clients ask
What must a compliance officer be able to do under Portuguese law?
Decreto-Lei n.º 109-E/2021 requires the officer to belong to senior management and to work independently, permanently and with decision-making autonomy, with the information, people and technical means needed. In a group, one officer may serve several entities. A management system can document the role, but the legal appointment duty stays with the entity.
Is ISO 37301 required by the Portuguese regime?
No. The regime requires a compliance programme with a prevention plan, code of conduct, training and a whistleblowing channel, and it does not name ISO 37301. The standard is a voluntary framework that can structure those elements and others. Ask MENAC or your counsel whether your current programme meets the law.
How do whistleblowing channels fit into a compliance system?
Lei n.º 93/2021 obliges entities with 50 or more workers to run internal channels that allow secure reporting and follow-up. In a compliance management system those channels feed investigation, corrective action and management review. The Act sets the legal duties and ISO 37301 is only a way of organising the response.
Who certifies compliance management systems in Portugal?
A certification body accredited by IPAC, the national accreditation body, or by an equivalent body. Neither IPAC nor MENAC issues the certificate, and Sterling does not either. Check the body's IPAC scope for compliance management and ask what the certificate says, since it does not prove legal compliance.
