ISO 37001 certification in Portugal at a glance
Decreto-Lei n.º 109-E/2021, de 9 de dezembro (regime geral de prevenção da corrupção, RGPC) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Portugal ask for evidence that you meet it.
Anti-bribery obligations in Portugal are statutory before they are voluntary. Decreto-Lei n.º 109-E/2021 created the Mecanismo Nacional Anticorrupção and requires entities with 50 or more workers to adopt a compliance programme with a corruption-risk prevention plan, a code of conduct, training and a whistleblowing channel under a compliance officer, while Lei n.º 93/2021 sets the whistleblower regime. Neither names ISO 37001, yet the standard gives exporters, suppliers and bidders an audited anti-bribery management system that foreign customers recognise. Certificates are issued by bodies accredited by IPAC, never by Sterling, and they do not prove legal compliance. Sterling's Enschede office assesses bribery risk, builds due diligence and controls, and rehearses the audit with the client, with Effivity and Sterling Academy included with the engagement.
Who needs ISO 37001 in Portugal, and what happens without it
In Portugal the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Companies with 50 or more workers subject to the corruption-prevention regimeDecreto-Lei n.º 109-E/2021 requires a compliance programme with a risk prevention plan, code of conduct, training and a whistleblowing channel.
- Public and state-owned bodies with 50 or more workersThe regime also covers public administration and the state business sector.
- Exporters and suppliers answering foreign customers' integrity questionnairesThe standard gives an audited anti-bribery system that customers recognise abroad.
- Firms bidding for public contractsTender documents set their own criteria, and integrity evidence can strengthen a bid.

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.
In Portugal these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

How long does ISO 37001 certification take in Portugal?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Portugal these are the factors that set the timeline.
- Bribery risk profile by country, sector and business partner
- Maturity of the existing compliance programme required by the national regime
- Number of entities, sites and intermediaries in scope
- Certification body scheduling around the Portuguese summer holiday period
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 37001 certification cost in Portugal?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Portugal these factors move both.
- Scope, number of entities and business partners to screen
- Due diligence and control remediation
- Certification body audit fees, quoted separately from consulting
- Training and investigation procedure effort
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 37001 consultants and certification bodies in Portugal
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Portugal are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 37001 in Portugal (4)
| Instrument | How it treats the standard |
|---|---|
| Decreto-Lei n.º 109-E/2021, de 9 de dezembro (regime geral de prevenção da corrupção, RGPC) | The instrument itself It applies to entities with 50 or more workers and requires a compliance programme with a corruption-risk prevention plan, a code of conduct, a training programme and a whistleblowing channel under a compliance officer; it does not name ISO 37001 or ISO 37301. |
| Lei n.º 93/2021, de 20 de dezembro (protection of whistleblowers) | The instrument itself It transposes Directive (EU) 2019/1937 and obliges entities with 50 or more workers to run internal reporting channels; it does not name a management system standard. |
| IPAC (Instituto Português de Acreditação, I.P.) as Portugal's national accreditation body | Recognition IPAC's general regulation describes it as the national accreditation body under Regulation (EC) No 765/2008, covering testing and calibration laboratories, clinical laboratories, inspection, certification, validation and verification bodies. |

Accreditation, audit language and remote audits in Portugal
Choose a certification body accredited for ISO 37001 by IPAC, Portugal's national accreditation body, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Check that the body's accreditation scope covers the standard and your sector. The Portuguese anti-corruption regime does not name the standard, so a certificate shows a managed system rather than legal compliance. No body is named here. Audit language
Portuguese is the official language and English is widely used in international business. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a contract or a regulator's procedure.
Remote and on-site
Stage 1 and stage 2 audits are normally on site, with interviews at head office and selected business units; remote review is at the certification body's discretion.
ISO 37001 in Portugal: questions clients ask
Does Portuguese law require ISO 37001 certification?
No. Decreto-Lei n.º 109-E/2021 requires entities with 50 or more workers to adopt and implement a compliance programme, but it does not name ISO 37001 or any certificate. The standard is a voluntary way to run an anti-bribery system. Whether your programme meets the legal requirements is for MENAC or your counsel.
What must the Portuguese anti-corruption compliance programme contain?
At least a plan for preventing corruption risks, a code of conduct, a training programme and a whistleblowing channel, under a compliance officer who sits in senior management. The risk plan must cover the whole organisation. ISO 37001 can organise the same content as a managed system, though it adds requirements of its own.
Who has to run a whistleblowing channel in Portugal?
Under Lei n.º 93/2021, legal persons with 50 or more workers, including public bodies, and entities within the scope of the EU acts listed in the directive's annex. Local authorities with fewer than 10,000 inhabitants are excused, and smaller private entities may share resources. Ask your counsel which category you fall in.
What role does MENAC play?
MENAC, the Mecanismo Nacional Anticorrupção, is an independent administrative entity created by Decreto-Lei n.º 109-E/2021 with powers of initiative, control and sanction. It promotes transparency and integrity in public action and oversees the prevention regime. It does not certify management systems, so ISO 37001 certificates come from accredited certification bodies only.
