ISO 37001 certification in New Zealand at a glance
One New Zealand instrument bears on ISO 37001. It does not name the standard. So why do buyers in New Zealand keep asking for the certificate?
The legal risk of bribery in New Zealand business is less about local officials than about agents and intermediaries abroad. The Serious Fraud Office names the Crimes Act 1961 and the Secret Commissions Act 1910 as sources of the offences it usually prosecutes, and the Ministry of Justice guide for businesses explains that an organisation can be liable for foreign bribery by an employee if it failed to take reasonable steps to prevent it. That guide asks for proportionate procedures and does not name ISO 37001, so certification is voluntary evidence, issued by a certification body, ideally one accredited by JASANZ. Exporters, contractors working with state-owned buyers overseas and suppliers who must meet the Supplier Code of Conduct are the usual enquirers. Sterling's Sydney office helps New Zealand firms build the risk assessment, due diligence and controls, with Effivity and Sterling Academy included.
Who needs ISO 37001 in New Zealand, and what happens without it
In New Zealand the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- New Zealand exporters dealing with overseas agents and officialsThe Ministry of Justice guide explains that an organisation can be liable for foreign bribery by an employee if it failed to take reasonable steps to prevent the offence, including conduct by foreign intermediaries.
- Businesses working with state-owned buyers abroadThe Ministry of Justice guide gives the example of a foreign agent bribing the procurement manager of a state-owned plant to win an order.
- Private-sector firms with commissions and gifts riskThe Secret Commissions Act 1910 contains bribery-style offences relevant to the private sector, as the Ministry of Justice guide describes.
- Suppliers to government agenciesThe Supplier Code of Conduct sets expectations for suppliers and agencies may ask for evidence of compliance.

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.
In New Zealand these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

How long does ISO 37001 certification take in New Zealand?
There is no standard duration: it depends on your scope and on how much of the system already runs. In New Zealand these are the factors that set the timeline.
- Countries, intermediaries and public-official touchpoints in scope
- Bribery risk assessment and due-diligence procedures to build
- Gift, hospitality and facilitation policies to formalise
- Certification body scheduling around public holidays
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 37001 certification cost in New Zealand?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In New Zealand these factors move both.
- Number of sites, countries and business associates in scope
- Due diligence on agents and suppliers
- Certification body audit fees quoted separately from consulting
- Integration with ISO 37301 or ISO 9001 work
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 37001 consultants and certification bodies in New Zealand
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in New Zealand are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in New Zealand
Use a certification body accredited for this standard by JASANZ, the joint Australia–New Zealand accreditation body, or by an accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37001 hub →
Audit language
English is the usual working language of audits; Māori and New Zealand Sign Language are official languages. Agree the audit language and the language of controlled documents with the certification body at application, and follow any language requirement in a tender or customer contract.
Remote and on-site
Remote audit elements are at the certification body's discretion under its accreditation rules; sites and operations in scope are normally visited on-site.
ISO 37001 in New Zealand: questions clients ask
Does New Zealand law require ISO 37001 certification?
No. The SFO names the Crimes Act 1961 and the Secret Commissions Act 1910 as sources of the offences it prosecutes, and the Ministry of Justice guide recommends proportionate anti-corruption procedures without naming ISO 37001. A certified system can evidence reasonable steps, but the courts decide that question on the facts.
Can an organisation in New Zealand be liable for foreign bribery by an employee?
The Ministry of Justice guide says an organisation can be held liable if an employee, acting within authority, commits the offence at least partly to benefit it and the organisation failed to take reasonable steps to prevent it. Agents and directors are included. Take legal advice on your exposure.
What counts as 'reasonable steps' to prevent bribery?
The guide treats it as a question for the courts on the circumstances of each case, and says effective anti-corruption compliance procedures will be relevant. It stresses that procedures should be proportionate to risk and that no programme eliminates corrupt conduct entirely. An ISO 37001 system is one structured way to build and evidence such procedures.
Will government buyers in New Zealand ask for anti-bribery certification?
Not as a rule. The Supplier Code of Conduct sets expectations and lets agencies ask for evidence, and suppliers may offer certifications among other proof. The code does not name ISO 37001. Check each tender for its requirement, as some opportunities will not mention it at all.
