HIPAA compliance in India at a glance
45 CFR 160.103 is the instrument itself: it applies to the organisations within its scope, and buyers and partners in India ask for evidence that you meet it.
An Indian medical-billing, coding or claims-processing firm working for a US hospital or health plan is a business associate under HIPAA: the US regulations at 45 CFR 160.103 define a business associate as a person who creates, receives, maintains or transmits protected health information on behalf of a covered entity, naming claims processing, data analysis and billing among the functions. HIPAA is a US law, not an ISO certification, and there is no official HIPAA certificate. Obligations reach the Indian firm through the business associate agreement and are evidenced through risk analysis, administrative, physical and technical safeguards, policies and workforce training. The same records also sit under India's Digital Personal Data Protection Act, 2023, so one privacy and security programme should answer both. Sterling, with 8,100+ client engagements in 60+ countries, prepares that programme from its Navi Mumbai office and, where a US client wants independent assurance, readies the firm for a SOC 2 examination by a CPA firm. Local questions follow.
Who needs HIPAA in India, and what happens without it
These are the organisations in India that most often need to show HIPAA.
- Medical billing, coding and claims-processing BPOs serving US providers and plansThey create, receive, maintain or transmit PHI on behalf of covered entities — business associates.
- Health-tech and software exporters hosting US patient dataHosting or analysing PHI for a covered entity makes them business associates.
- Indian firms processing that data in IndiaThe DPDP framework also applies to digital personal data processed in India.
Not sure which of these applies to you?Answer a short set of questions and your readiness report arrives by e-mail.
Take the HIPAA readiness checkHIPAA requirements in India
Strip away the vocabulary and HIPAA requires covered entities and business associates to comply in six areas protecting health information.
In India these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: HIPAA explained →

How long does HIPAA compliance take in India?
There is no standard duration: it depends on your scope and on how much of the system already runs. In India these are the factors that set the timeline.
- Number of US client contracts and business associate agreements
- Risk analysis and safeguards documentation
- Workforce training across delivery centres
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does HIPAA compliance cost in India?
The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In India these factors move both.
- Number of delivery centres and systems holding PHI
- Security control remediation needed
- External assessment or attestation if a client asks for one
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
HIPAA consultants and assessors in India
Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers HIPAA and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in India are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Documentation and client evidence are in English.

Assessments can be remote with system access; delivery-centre walkthroughs are on-site.
HIPAA in India: questions clients ask
Is there a HIPAA certification?
No. HIPAA is a US law with no official certificate. You show compliance through your business associate agreement, risk analysis, safeguards, policies and training records. Some US clients ask for an independent assessment or a SOC 2 report as supporting evidence.
Does HIPAA apply to an Indian BPO?
Through contract and function. HIPAA reaches an Indian BPO when it creates, receives, maintains or transmits protected health information for a US covered entity, such as in claims processing, data analysis or billing, and the business associate agreement records the obligations. Confirm scope with your US counsel.
Does the DPDP Act also apply?
Yes, it can apply alongside. The Indian framework covers digital personal data processed in India, and it sits next to the contractual HIPAA duties you accept in client agreements. The DPDP Act contains exemptions, so check them with your counsel before assuming either way.
