PIPEDA compliance in Canada at a glance

Personal Information Protection and Electronic Documents Act (S.C. 2000, c. 5) is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Canada ask for evidence that you meet it.

Commercial activity is the trigger. The Personal Information Protection and Electronic Documents Act applies to private-sector organisations that collect, use or disclose personal information in the course of a commercial activity, and to every federally regulated organisation regardless of province, including its employees' information. Quebec, Alberta and British Columbia have laws deemed substantially similar, so a business operating only within one of those provinces generally follows the provincial act, while information crossing provincial or national borders stays under PIPEDA. Its obligations are practical: safeguards appropriate to the sensitivity of the information, and reporting to the Privacy Commissioner, with notice to individuals, of breaches that create a real risk of significant harm. There is no PIPEDA certificate; compliance is shown through policies, consent and access records, safeguards and breach logs. Sterling's Toronto office builds that evidence and, where clients want an external benchmark, aligns it with ISO/IEC 27701 certification by an accredited body. Scope questions are covered below.

Requirements

PIPEDA requirements in Canada

Strip away the vocabulary and PIPEDA asks a private-sector organisation to comply in six areas built on its fair information principles.

Someone is accountableA designated person is accountable for compliance, including for information passed to service providers.
Purposes are explained and consent obtainedPurposes are identified at or before collection, and meaningful consent is obtained in a form that suits the information's sensitivity.
Collection, use and retention are limitedOnly necessary information is collected, used for the stated purposes and kept no longer than needed.
Information is accurate and safeguardedData is kept accurate for its purpose, and security safeguards match how sensitive it is.
People can access and challengeIndividuals can access and correct their information and challenge your compliance.
Safeguard breaches are reportedBreaches posing a real risk of significant harm are reported to the Privacy Commissioner, notified to individuals and recorded.

In Canada these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: PIPEDA explained →

How Sterling gets a Canadian company compliant with PIPEDA

How to achieve PIPEDA compliance in Canada

One team from the Toronto office carries the work from scoping to sign-off. Delivered from the Toronto office: on-site in Ontario and by arrangement in other provinces; remote delivery for distributed teams.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against PIPEDA and the Canadian requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
    3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
    4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before any external review.
    5. Reviews by regulators, customers and auditorsSterling supports the reviews your regulators, customers and auditors run.

      Time

How long does PIPEDA compliance take in Canada?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Canada these are the factors that set the timeline.

      • Number of processing activities and systems to map
      • Provinces in which the organisation operates (PIPEDA, Quebec, Alberta, British Columbia)
      • Vendor and cross-border transfer review

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does PIPEDA compliance cost in Canada?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In Canada these factors move both.

      • Number of legal entities and regimes in scope
      • Volume of processing activities and data subjects
      • Security safeguard remediation needed

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

PIPEDA consultants and assessors in Canada

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers PIPEDA and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Canada are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in Canada

Compliance, not certification: PIPEDA has no certificate. Evidence is the organisation's accountability programme, notices, consent records, safeguards and breach records. ISO/IEC 27701 certification by an accredited body is an optional external benchmark. Edition and transition details: PIPEDA hub →

          Audit language

Privacy notices are written for their audience — in English, French or both; in Quebec check the French-language requirements that apply.

          Remote and on-site

Data-mapping workshops can be on-site or remote; the law prescribes no external assessment.

PIPEDA in Canada: questions clients ask

Does PIPEDA apply in Quebec, Alberta or British Columbia?

Provincial law applies to in-province activity where it is deemed substantially similar: Quebec's private-sector Act, overseen by the Commission d'accès à l'information du Québec, and the Personal Information Protection Acts of Alberta and British Columbia. PIPEDA still applies to cross-border flows and to federally regulated organisations. Confirm which applies to you with counsel.

When must a breach be reported?

A breach of security safeguards must be reported where it is reasonable to believe it creates a real risk of significant harm. The report goes to the Commissioner, and affected individuals must be notified. Your counsel can confirm whether a particular incident meets that test.

          Is there a PIPEDA certificate?

No. There is no PIPEDA certificate. Compliance is evidenced through your policies, safeguards and records, and ISO/IEC 27701 certification is optional supporting evidence. Neither amounts to a ruling that you comply, and neither replaces your duties under the Act, so confirm your position with your counsel before relying on either.

          Who oversees PIPEDA?

The Office of the Privacy Commissioner of Canada (OPC) oversees PIPEDA. It is the body to which the Act's breach reports go, and the one to approach with questions about the Act. Which regulator matters to you depends on where you operate, so confirm with your counsel.
