ISO 37001 certification in Canada at a glance
One Canadian instrument bears on ISO 37001. It does not name the standard. So why do buyers in Canada keep asking for the certificate?
Bribing a foreign public official to obtain or keep a business advantage is an offence under Canada's Corruption of Foreign Public Officials Act, and so is keeping off-book accounts or unrecorded transactions to bribe or to hide bribery. For exporters, engineering and resources firms, and any business working through agents or joint-venture partners abroad, that makes controls over third parties, payments and records a board-level issue. ISO 37001 does not appear in the Act and certification is no legal defence, but the standard gives a recognised structure for a proportionate anti-bribery programme: risk assessment, due diligence on business associates, financial and non-financial controls, training, reporting channels and investigation. An accredited certification body audits it and issues the certificate, giving lenders, partners and public buyers independent evidence. Sterling's Toronto office designs and implements the programme, drawing on 20+ years of compliance work, with Effivity and Sterling Academy included. Questions from Canadian exporters follow.
Who needs ISO 37001 in Canada, and what happens without it
In Canada the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.
- Exporters and companies operating abroadThe Corruption of Foreign Public Officials Act creates bribery and books-and-records offences.
- Suppliers to the Government of Canada
- Engineering, construction and resources firms with agents and intermediariesThird-party due diligence is central to bribery risk.

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.
In Canada these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

How long does ISO 37001 certification take in Canada?
There is no standard duration: it depends on your scope and on how much of the system already runs. In Canada these are the factors that set the timeline.
- Number of countries and business units in scope
- Volume of agents, intermediaries and joint ventures needing due diligence
- Time to evidence controls, training and investigations
Sterling agrees a dated plan with you on the discovery call, once the scope is known.
How much does ISO 37001 certification cost in Canada?
The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Canada these factors move both.
- Number of countries and third parties in scope
- Existing compliance function maturity
- Certification body audit fees quoted separately from consulting
Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.
ISO 37001 consultants and certification bodies in Canada
Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.
- Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
- Ask the consultant how the local requirements in Canada are mapped into the same system, so nothing runs twice.
- Ask for client references in your sector; Sterling’s client letters are available on request.
- Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.
Laws and regulations that drive ISO 37001 in Canada (1)
| Instrument | How it treats the standard |
|---|---|
| Corruption of Foreign Public Officials Act | Does not name the standard Creates offences for bribing a foreign public official and for related books-and-records practices. |
Accreditation, audit language and remote audits in Canada
Use a certification body accredited for this standard by the Standards Council of Canada or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37001 hub →
Audit language
Audits are commonly conducted in English, or in French where the certification body offers it; agree the audit and document language at application.
Remote and on-site
Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.
ISO 37001 in Canada: questions clients ask
Is ISO 37001 required by Canadian law?
No. The Corruption of Foreign Public Officials Act does not cite ISO 37001, so certification is not a legal requirement. Whether to certify is your decision, perhaps prompted by customers. Your obligations under the Act apply regardless, so confirm them with your counsel.
Does certification protect us from prosecution?
No. Certification is evidence of a managed anti-bribery programme, not a legal defence. It may show that an organisation takes the risk seriously, but it does not shield anyone from prosecution. Take legal advice on your own exposure from your counsel.
What about books and records?
The Corruption of Foreign Public Officials Act includes offences for off-book accounts and unrecorded transactions used to bribe or to hide bribery. Accurate books and records are therefore part of the picture, and an anti-bribery programme should deal with them. Ask your counsel how the Act applies to your business.
