In short

ISO 37301 certification in Austria at a glance

Verbandsverantwortlichkeitsgesetz (VbVG), BGBl. I Nr. 151/2005 is the instrument itself: it applies to the organisations within its scope, and buyers and partners in Austria ask for evidence that you meet it.

Austrian organisations rarely face one compliance regime; they face several at once. The NISG 2026, DORA, the GDPR through the Datenschutzgesetz and sector rules overlap, employers with 50 or more staff must operate an internal reporting channel, and corporate liability under the VbVG depends on whether management took the care the circumstances required. ISO 37301 organises these into one certified compliance management system with an obligations register, risk assessment, controls, monitoring and review, though no Austrian law names it. Certification is a decision for an accredited certification body, accredited by Akkreditierung Austria or a recognised equivalent; Sterling never issues it. Sterling's Frankfurt office builds the register, controls and internal audit with your team, and Effivity and Sterling Academy are included with the engagement. Austrian-specific questions are answered below.

The need

Who needs ISO 37301 in Austria, and what happens without it

In Austria the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Regulated groups managing several compliance obligationsNISG 2026, DORA, GDPR and sector rules overlap, and a compliance management system gives one structure for obligations, owners and evidence.
  • Employers required to run a reporting systemThe HSchG requires an internal reporting system for enterprises with 50 or more employees.
  • Companies concerned about entity liabilityThe VbVG looks at whether decision-makers took the care circumstances required, including organisational measures.
  • Suppliers answering customer compliance questionnairesLarge customers ask for evidence of a functioning compliance system.

Requirements

ISO 37301 requirements in Austria

Strip away the vocabulary and ISO 37301 requires a company to prove six things about how it meets its legal and other obligations.

You know your obligationsObligations from laws, regulators, contracts and voluntary commitments are identified and kept current.
The governing body and management leadThe governing body and top management set the compliance policy and support a culture in which compliance is expected.
A compliance function has authorityA compliance function is resourced, independent enough to act and has direct access to the governing body.
Compliance risks are assessedRisks of failing to meet obligations are assessed, and controls are designed in proportion to them.
Concerns are raised and handledPeople can raise concerns without fear of retaliation, and suspected breaches are investigated and corrected.
You monitor and reportCompliance performance is monitored, reported to leadership, audited and reviewed so the system improves.

In Austria these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37301 explained →

How Sterling gets an Austrian company certified

How to get ISO 37301 certified in Austria

One team from the Frankfurt office carries the work from scoping to certificate. Clients in Austria are served from Sterling's Frankfurt office, on-site where the work needs it and remotely otherwise.

    1. Discovery call and scopeEntities, locations, regulators and target date, agreed before any proposal.
    2. Gap assessment against ISO 37301 and the Austrian requirements that apply to youControls you already run for your regulators and customers are reused, not rebuilt.
    3. Your system built with your team in EffivityRisks, controls, evidence, incidents and reviews in one live system the auditor can see.
    4. Internal audit, management review and corrective actionsYour internal auditors trained by Sterling; the evidence proven before the certification body arrives.
    5. Certification body stage 1 and stage 2, then surveillanceAn accredited body audits and decides. Sterling supports the audits and the three-year cycle.
    Included in every engagement
    • End to end, from one team
    • Effivity ISO & GRC software
    • Preferential Sterling Academy access, with complimentary awareness training for your people
    • Internal auditor training for your audit team, as applicable to your standard
    • Vulnerability assessment on ISMS engagements

The Sterling Promise: 100% on-time completion, 100% success, 8,100+ client engagements.Sterling does not certify. Certification decisions stay with independent bodies.

      Time

How long does ISO 37301 certification take in Austria?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Austria these are the factors that set the timeline.

      • Number of compliance obligations and entities in scope
      • Maturity of the obligations register and controls
      • Reporting channel and investigation process
      • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

      Cost

How much does ISO 37301 certification cost in Austria?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Austria these factors move both.

      • Scope and number of legal entities
      • Remediation of controls and monitoring
      • Certification body audit fees, quoted separately
      • Training and awareness activity

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

        Choosing a partner

ISO 37301 consultants and certification bodies in Austria

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

        • Check that the body’s accreditation or approval covers ISO 37301 and your sector, and that its certificates can be verified online.
        • Ask the consultant how the local requirements in Austria are mapped into the same system, so nothing runs twice.
        • Ask for client references in your sector; Sterling’s client letters are available on request.
        • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37301 in Austria (4)

          InstrumentHow it treats the standard
Verbandsverantwortlichkeitsgesetz (VbVG), BGBl. I Nr. 151/2005The instrument itself
Corporate liability turns on whether decision-makers took due care, notably the technical, organisational and personnel measures needed to prevent staff offences; a documented compliance management system is a way to evidence that care, though the Act names no standard.
HinweisgeberInnenschutzgesetz (HSchG), BGBl. I Nr. 6/2023The instrument itself
An internal reporting system is compulsory for enterprises and public-sector entities with 50 or more employees and must respect data protection; in a compliance management system it becomes the speak-up channel, but the Act names no ISO standard.
Akkreditierung Austria as the Austrian national accreditation bodyRegulator page
Akkreditierung Austria, set up as a department of the economy ministry, accredits Austrian conformity assessment bodies, including bodies certifying compliance management systems where their scope covers it.
EA directory entry for Akkreditierung AustriaRecognition
As an EA MLA signatory with management system certification in scope, Akkreditierung Austria grants accreditations that are recognised across Europe.

Accreditation, audit language and remote audits in Austria

Fewer certification bodies hold accreditation for ISO 37301 than for ISO 9001, so confirm early that the body's scope names compliance management. Accept accreditation from Akkreditierung Austria or another accreditation body in the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Audit language

Austrian legal obligations are written in German, so the obligations register usually carries German source titles even where a group reports in English. Agree with the certification body which language the audit, the register and controlled documents will use.

          Remote and on-site

Audits are normally on-site with remote interviews at the certification body's discretion.

ISO 37301 in Austria: questions clients ask

Is ISO 37301 required in Austria?

No. Neither the Verbandsverantwortlichkeitsgesetz nor the HinweisgeberInnenschutzgesetz names ISO 37301. They set legal duties on liability and reporting channels, and the standard is a voluntary way to organise obligations, risks, controls and monitoring. A certificate documents the system rather than satisfying either law. Confirm your obligations with counsel.

How does ISO 37301 relate to the Austrian whistleblowing law?

It expects a way to raise concerns and a process to handle them, which the HSchG already requires of enterprises with 50 or more employees in the form of an internal reporting system. Building one channel to meet both avoids duplication. The Act's rules on confidentiality and data protection still apply to the channel you design.

What does a compliance management system add beyond individual legal checklists?

Structure and evidence. Austrian organisations often track NIS2, DORA, GDPR and sector rules separately; ISO 37301 links them through an obligations register, risk assessment, controls, monitoring and management review. That makes gaps visible and reuses evidence. It does not replace legal advice on what each law requires.

Who certifies ISO 37301 in Austria?

An accredited certification body, never Sterling. Choose one accredited for this standard by Akkreditierung Austria or an equivalent body and read the scope. Sterling prepares the compliance management system from the Frankfurt office, with Effivity and Sterling Academy included, and rehearses the internal audit before the certification audits.
