In short

ISO 37001 certification in Australia at a glance

One Australian instrument bears on ISO 37001. It does not name the standard. So why do buyers in Australia keep asking for the certificate?

Failing to prevent foreign bribery is now a corporate offence in Australia, introduced by the Crimes Legislation Amendment (Combatting Foreign Bribery) Act 2024. The Attorney-General's Department has published guidance on the adequate procedures a company can put in place to prevent the commission of foreign bribery by its associates. That guidance does not mention ISO 37001, and certification is not a legal safe harbour, but the standard's requirements map closely to what adequate procedures involve: top-level commitment, bribery risk assessment, due diligence on agents and partners, financial and non-financial controls, reporting channels and investigation. JASANZ reports an anti-bribery management system accreditation programme based on ISO 37001, so certificates are available from accredited certification bodies in Australia. Resources, construction and infrastructure companies with overseas projects are the most exposed. Sterling builds the anti-bribery system from its Sydney office, drawing on 20+ years of management system practice.

The need

Who needs ISO 37001 in Australia, and what happens without it

In Australia the question rarely comes from a law. It comes from the buyer, the regulator or the partner that wants proof before it signs. These are the organisations that get asked.

  • Australian corporations with foreign dealingsThe failure to prevent foreign bribery offence makes adequate procedures central.
  • Contractors, resources and infrastructure companies operating overseasAgent, joint-venture and government interactions carry bribery risk.
  • Suppliers to multinationals with anti-bribery due diligenceCustomers ask for evidence of an anti-bribery management system.

ISO 37001 requirements in Australia

Strip away the vocabulary and ISO 37001 requires a company to prove six things about how it prevents, detects and responds to bribery.

Leadership says no to briberyTop management and the governing body set an anti-bribery policy and show visible, consistent commitment to it.
Someone independent oversees complianceAn anti-bribery compliance function has the authority and independence to oversee the system.
You assessed your bribery risksBribery risks across activities, locations, business partners and transactions are assessed and kept up to date.
People and partners are checkedDue diligence covers relevant staff, business partners and projects, with controls on gifts, hospitality and donations.
Financial and other controls workFinancial and non-financial controls make it hard to pay or receive a bribe without it being noticed.
Concerns can be raised and investigatedStaff can report concerns in confidence without retaliation, and suspected bribery is investigated and acted on.

In Australia these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: ISO 37001 explained →

Time

How long does ISO 37001 certification take in Australia?

There is no standard duration: it depends on your scope and on how much of the system already runs. In Australia these are the factors that set the timeline.

  • Number of countries, agents and intermediaries in scope
  • Maturity of due diligence and gifts and hospitality controls
  • Certification body scheduling

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

Cost

How much does ISO 37001 certification cost in Australia?

The cost has two parts: the consulting work to build and prove the system, and the certification body’s audit fees, which are quoted separately. In Australia these factors move both.

  • Geographic spread and bribery risk profile
  • Third-party due diligence volume
  • Certification body audit fees quoted separately from consulting

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

Choosing a partner

ISO 37001 consultants and certification bodies in Australia

Two different organisations are involved. A consultant helps you build the system and prove it works; an accredited certification body then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

  • Check that the body’s accreditation or approval covers ISO 37001 and your sector, and that its certificates can be verified online.
  • Ask the consultant how the local requirements in Australia are mapped into the same system, so nothing runs twice.
  • Ask for client references in your sector; Sterling’s client letters are available on request.
  • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Laws and regulations that drive ISO 37001 in Australia (2)

    InstrumentHow it treats the standard
Crimes Legislation Amendment (Combatting Foreign Bribery) Act 2024Expected in practice
Corporate offence of failing to prevent foreign bribery; Attorney-General's Department guidance on adequate procedures does not mention ISO 37001.
JASANZ Anti-Bribery Management System (ABMS) accreditation programmeAccreditation

"Expected in practice" means the instrument asks for the outcomes ISO 37001 covers without naming a standard, and ISO 37001 is what buyers and regulators commonly accept as evidence of them.

Accreditation, audit language and remote audits in Australia

Use a certification body accredited for this standard by JASANZ or by another accreditation body within the international mutual recognition arrangements (Global ACI — Global Accreditation Cooperation Incorporated, formerly the IAF MLA); check that the accreditation scope covers the standard and your sector. No body is named here unless its accreditation scope has been verified. Edition and transition details: ISO 37001 hub →

    Audit language

Audits are conducted in English; agree the audit and document language with the certification body at application.

    Remote and on-site

Remote audit elements are at the certification body's discretion under its accreditation rules; operational sites are normally visited on-site.

ISO 37001 in Australia: questions clients ask

Does ISO 37001 certification provide a defence to failure to prevent foreign bribery?

No. Certification is evidence of a system, not a legal safe harbour. The defence under the foreign bribery Act turns on adequate procedures, and the Attorney-General's Department guidance on them makes no mention of ISO 37001. A certified system can help demonstrate procedures, but take advice from your counsel on how it would be viewed.

Who issues ISO 37001 certificates in Australia?

ISO 37001 certificates come from certification bodies accredited for the standard. JASANZ reports an Anti-Bribery Management System accreditation programme based on ISO 37001, so ask any body you consider whether it is accredited under it, and that its scope covers your sector. No body is named here.

Do we need ISO 37001 to show adequate procedures?

No, the standard is not a prerequisite. The department's published guidance on adequate procedures never mentions it. A certified system is one way to evidence the procedures you have in place, but ask your counsel what would be enough in your circumstances.
