HIPAA compliance in New York at a glance

New York health systems rarely ask a vendor whether it is HIPAA compliant in the abstract. They send a business associate agreement, a security questionnaire and a request for the latest risk analysis. Vendors that answer those requests range from billing firms and analytics start-ups to laboratories and device makers who share a campus with clinical partners at the Brooklyn Navy Yard. Sterling's New York office carries out the gap assessment and risk analysis against the Security Rule, writes the policies and breach procedures, trains the workforce through Sterling Academy and tracks remediation in Effivity. No government body certifies HIPAA, so evidence has to be your own, well kept and current. The national rule is on the United States page; local questions follow.

HIPAA in New York: questions clients ask

Does a New York software vendor to hospitals count as a business associate?

Usually yes, if it creates, receives, maintains or transmits protected health information on behalf of a hospital or plan. That brings direct Security Rule duties and a written business associate agreement. The hospital's contract will often add questionnaires or SOC 2 requests; whether you are covered is a question for your counsel.

Is there a HIPAA certificate a New York vendor can show?

No. HHS does not certify or approve HIPAA compliance programmes, so any badge is a private assessment. A vendor shows compliance through a documented risk analysis, policies, training and signed agreements, often supported by ISO/IEC 27001 or a SOC 2 report that hospital buyers can read.
