ISO and GRC certification in Venezuela at a glance

Venezuela writes its quality system into law: the Ley del Sistema Venezolano para la Calidad, published in Gaceta Oficial N° 37.555 on 23 October 2002, sets six subsystems, and SENCAMER coordinates them through a Dirección de Acreditación that accredits conformity assessment bodies. Sector rules add their own demand. The banking regulator SUDEBAN issued Resolución 641.10 on electronic banking, which lets institutions use PCI DSS as a reference, and Resolución 001.21 on financial technology firms, which expects information security, backup and tested contingency plans. SACS handles sanitary registration of foods, beverages, medicines and medical equipment, INSAI issues the health certificates that agricultural exporters need, and the environment ministry publishes the laws industrial operators work under. SUSCERTE accredits electronic certification providers and runs the national information security system. Certificates come from accredited certification bodies, never from Sterling. Sterling's New York office serves clients in Venezuela, bringing 20+ years and 8,100+ client engagements in 60+ countries, with Effivity and Sterling Academy included with the engagement. Audits and consulting are delivered remotely, or on site where it is practical and safe to do so.

Regulators and laws that drive certification in Venezuela (9)

Law or regulatorWhat it asks forStandards it cites
Constitution of Venezuela, article 28 (access to personal information and data)
The competent court (tribunal competente), to which the article lets a person apply to have data updated, rectified or destroyed.
Article 28 gives every person the right to access information and data about themselves or their property held in official or private records, with the exceptions the law sets, to know how the data are used and for what purpose, and to ask the competent court to update, rectify or destroy data that are wrong or unlawfully affect their rights. It also covers access to documents of public interest and keeps the secrecy of journalistic sources. It names no ISO standard and creates no certificate.
SENCAMER (Servicio Desconcentrado de Normalización, Calidad, Metrología y Reglamentos Técnicos), attached to the Ministerio de Industrias y Comercio Nacional
Quality infrastructure, accreditation and conformity assessment (all sectors)
Ley del Sistema Venezolano para la Calidad, Gaceta Oficial N° 37.555 of 23 October 2002. Article 1 builds the system on six subsystems: standardisation, metrology, accreditation, certification, technical regulations and testing; article 2 has the Ley regulate the compulsory field covering health, safety, the environment and practices that could mislead consumers, and coordinate the voluntary field. SENCAMER describes itself as the coordinating body of the system and its Dirección de Acreditación as the unit that accredits conformity assessment bodies against ISO/IEC 17011.
Superintendencia de las Instituciones del Sector Bancario (SUDEBAN)
Banks and other institutions of the banking sector
SUDEBAN publishes its binding prudential rules in one index. For technology it lists Resolución N° 641.10 of 23 December 2010 (Gaceta Oficial N° 39.597 of 19 January 2011) on electronic banking services, a 2008 circular on information technology and dematerialised financial services, circulars on technology change controls and on notifying failures in electronic payment channels, and Resolución N° 136.03 on integrated risk management (Gaceta Oficial N° 37.703 of 3 June 2003). Article 30 of Resolución 641.10 says the management of security, contingencies and communications must follow the 2008 circular and that institutions may also use the payment card industry data security standard, PCI DSS, as a reference; article 23 limits how long card operators may store sensitive card data.PCI DSS
Superintendencia de las Instituciones del Sector Bancario (SUDEBAN)
Financial technology firms of the banking sector
Resolución N° 001.21 on financial technology services (published in Gaceta Oficial N° 42.162 of 6 July 2021). The application file for authorisation includes the firm's information security measures and policies, a description of its technology platform, data backup and recovery policies and technology contingency plans; authorised firms must monitor their services continuously, keep dated transaction records, hold technology contingency plans that are reviewed and tested, run redundant equipment for critical services, keep service agreements for security and technology incidents and hold incident response plans. The resolution names no ISO standard.
Superintendencia de Servicios de Certificación Electrónica (SUSCERTE), under the science and technology ministry
Electronic certification and national information security
SUSCERTE was created by the Decreto con Rango y Fuerza de Ley de Mensajes de Datos y Firmas Electrónicas (Decreto N° 1.204, Gaceta Oficial N° 37.148 of 28 February 2001), which recognises the legal value of electronic signatures and data messages and regulates certification service providers. SUSCERTE states that the Ley de Infogobierno (Gaceta Oficial N° 40.274 of 17 October 2013, article 54) makes it the competent body for information security and responsible for the Sistema Nacional de Seguridad Informática, and that it runs the national incident-management team, VenCERT, for public administration systems. Its rules list includes Norma 009 on classification and handling of information in the public administration and Norma 043 on procedures for audits in the information and communication technology field.
Servicio Autónomo de Contraloría Sanitaria (SACS), attached to the Ministerio del Poder Popular para la Salud
Food, beverages, medicines, cosmetics and medical equipment
SACS was created as a service without legal personality by the organic regulation of the health ministry (Decreto N° 5.077, Gaceta Oficial N° 38.591 of 26 December 2006). It describes its mission as a national system of regulation, registration, authorisation, inspection, surveillance and enforcement covering food and beverage establishments, processes and products, medicines, drugs, cosmetics and medical equipment and materials. Its food page lists the documents for sanitary registration of national, imported and artisanal foods and alcoholic beverages, renewals and changes, and filings on good manufacturing practices for industry, microenterprises, artisanal producers and products for export. The page does not name HACCP or ISO 22000.
Instituto Nacional de Salud Agrícola Integral (INSAI)
Agricultural, animal and plant health, including export certificates
INSAI states that its mission is to prevent, control and monitor pests and diseases affecting animals, plants and their products, and to oversee the quality and safety of agricultural inputs. Its legal compendium begins with the Decreto con Rango, Valor y Fuerza de Ley de Salud Agrícola Integral (Decreto N° 6.129, Gaceta Oficial N° 5.890 of 31 July 2008), and its certificates page describes import and export certificates as documents that guarantee products meet the sanitary and phytosanitary requirements of the destination country. The pages name no ISO standard.
Ministerio del Poder Popular para el Ecosocialismo (MINEC)
Environment and industrial operations
MINEC's legal-framework page lists the Ley Orgánica del Ambiente (Gaceta Oficial N° 5.833 Extraordinario of 22 December 2006), the Ley Penal del Ambiente (Gaceta Oficial N° 39.913 of 2 May 2012), the Ley N° 55 on hazardous substances, materials and waste (Gaceta Oficial N° 5.554 Extraordinario of 13 November 2001), the Ley de Gestión Integral de la Basura (Gaceta Oficial N° 6.017 Extraordinario of 30 December 2010) and the Ley de Aguas. The Asamblea Nacional states that the Ley Orgánica del Ambiente sets the provisions and guiding principles for environmental management within sustainable development. None of the pages names ISO 14001.
The national bodies and institutions established under the Ley Orgánica de Prevención, Condiciones y Medio Ambiente de Trabajo
Occupational safety and health (all employers)
Article 87 of the Constitution requires every employer to guarantee workers adequate conditions of safety, hygiene and working environment, and has the State create institutions to control and promote them. The Asamblea Nacional states that the Ley Orgánica de Prevención, Condiciones y Medio Ambiente de Trabajo (Gaceta Oficial N° 38.236 of 26 July 2005) sets the institutions, norms and policy guidelines that secure safety, health and well-being for workers in a suitable working environment through the promotion of safe and healthy work. The pages name no ISO standard.

Accreditation and recognition

  • SENCAMER — Dirección de Acreditación: National accreditation service; SENCAMER states that the Dirección de Acreditación administers the accreditation subsystem of the Ley del Sistema Venezolano para la Calidad and formally recognises the technical competence of conformity assessment bodies, working to ISO/IEC 17011.

Look for a certification body whose accreditation scope covers your standard and sector, from a national accreditation body recognised under the international arrangements of Global ACI (Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Sterling does not certify.

Questions Venezuela clients ask

Which body accredits certification bodies and laboratories in Venezuela?

SENCAMER, the Servicio Desconcentrado de Normalización, Calidad, Metrología y Reglamentos Técnicos, through its Dirección de Acreditación. Its site lists schemes for testing and calibration laboratories, clinical laboratories, inspection bodies, management system certification bodies, product and process certification bodies and certification bodies for persons. Its pages state no recognition under the international arrangements, so ask any certification body which accreditation stands behind its certificates.

Are certification audits in Venezuela conducted in English?

Often, where the client is a multinational or serves overseas customers, although Spanish is the official language and the language of statutes and regulator filings. At application, agree the audit language, any interpreter and the language of controlled documents with the certification body, and flag early any shop-floor interviews that will be held in Spanish.

Does Venezuelan bank regulation mention PCI DSS?

Yes, as an optional reference. SUDEBAN's Resolución 641.10 on electronic banking says security, contingency and communications management must follow its 2008 information technology circular, and that institutions may also use the PCI DSS card industry standard as a reference. It separately limits how long card operators may store sensitive card data. Read the resolution with your bank's compliance team.

Who handles sanitary registration of food and beverages in Venezuela?

The Servicio Autónomo de Contraloría Sanitaria, known as SACS, which is attached to the health ministry. Its food page lists the documents for sanitary registration of national, imported and artisanal foods and alcoholic beverages, renewals, and good manufacturing practice filings. That page does not name HACCP or ISO 22000, so buyers and your certification body set those expectations.

What health certificates do agricultural exporters get from INSAI?

INSAI, the Instituto Nacional de Salud Agrícola Integral, issues import and export certificates for agricultural and animal products. It describes them as documents guaranteeing that products meet the sanitary and phytosanitary requirements of the destination country. Its legal compendium starts from the Ley de Salud Agrícola Integral, published in Gaceta Oficial N° 5.890. Check the destination market's own rules as well.

Can audits and consulting for Venezuelan sites be delivered remotely?

Partly. Clients in Venezuela are served from Sterling's New York office, and the engagement follows one rule: audits and consulting are delivered remotely, or on site where it is practical and safe to do so. Which audit elements may be remote is the accredited certification body's decision, so settle site access, shift patterns and the remote share when work starts.
