In short

HIPAA compliance in the Philippines at a glance

HIPAA Rules is the instrument itself: it applies to the organisations within its scope, and buyers and partners in the Philippines ask for evidence that you meet it.

HIPAA is a United States law, yet a large share of the work it governs is done in the Philippines: medical billing, claims processing, coding and patient support for American healthcare organisations. Under the HIPAA rules, a person who creates, receives, maintains or transmits protected health information on behalf of a covered entity, for functions such as claims processing, billing or data analysis, is a business associate, and the Security Rule applies to business associates as well as covered entities. A Philippine BPO therefore signs a business associate agreement and must show safeguards for electronic protected health information. The same records are personal information under the Data Privacy Act of 2012, enforced by the National Privacy Commission. There is no HIPAA certificate; compliance is evidenced through risk analysis, policies, training and audit trails, and the US regulator enforces it. Sterling's Manila office runs HIPAA readiness for outsourcing teams alongside Data Privacy Act compliance, with Effivity and Sterling Academy included.

The need

Who needs HIPAA in the Philippines, and what happens without it

These are the organisations in the Philippines that most often need to show HIPAA.

  • Philippine BPOs doing medical billing, claims processing and coding for US healthcare organisationsThey act as business associates and must protect protected health information.
  • Healthcare contact centres and patient-support teamsCreating, receiving, maintaining or transmitting PHI on behalf of a covered entity makes them business associates.
  • Subcontractors of business associates (IT, hosting, transcription)Business associate contracts must flow requirements to subcontractors handling electronic PHI.
  • Any of the above processing personal information in the PhilippinesThe Data Privacy Act applies in parallel.

HIPAA requirements in the Philippines

Strip away the vocabulary and HIPAA requires covered entities and business associates to comply in six areas protecting health information.

You know where health information sitsElectronic protected health information is identified wherever it is created, received, kept or transmitted.
Risk analysis is real and currentAn accurate and thorough risk analysis is carried out, and the risks it finds are reduced to a reasonable level.
Safeguards are in place on three frontsAdministrative, physical and technical safeguards cover workforce training, facility access, access control, audit logs and encryption where appropriate.
Use and disclosure follow the Privacy RuleHealth information is used and disclosed only as the Privacy Rule permits, limited to the minimum necessary.
Business associates are under contractBusiness associate agreements bind those who handle health information for you to protect it.
Breaches are assessed and notifiedBreaches of unsecured health information are assessed and notified as the Breach Notification Rule requires.

In the Philippines these six sit alongside the local laws and regulations listed under drivers below; one system can evidence both. The detail is on the global hub: HIPAA explained →

How Sterling gets a Philippine company compliant with HIPAA

    Time

How long does HIPAA compliance take in the Philippines?

There is no standard duration: it depends on your scope and on how much of the system already runs. In the Philippines these are the factors that set the timeline.

    • Number of client programmes and covered entities served
    • Maturity of risk analysis and access controls for electronic PHI
    • Alignment with each client's business associate agreement

Sterling agrees a dated plan with you on the discovery call, once the scope is known.

    Cost

How much does HIPAA compliance cost in the Philippines?

The cost has two parts: the consulting work to build and prove the system, and any external assessor’s fees, which are quoted separately. In the Philippines these factors move both.

    • Number of sites, systems and client programmes handling PHI
    • Independent assessment or penetration testing fees, separate from consulting
    • Training volume across shifts

Sterling gives one customised, all-inclusive proposal after the discovery call, never before the scope is agreed.

    Choosing a partner

HIPAA consultants and assessors in the Philippines

Two different organisations are involved. A consultant helps you build the system and prove it works; your regulators, customers and auditors then audits or assesses it and decides. Keeping the two separate is what makes the result credible to buyers and regulators.

    • Check that the body’s accreditation or approval covers HIPAA and your sector, and that its certificates can be verified online.
    • Ask the consultant how the local requirements in the Philippines are mapped into the same system, so nothing runs twice.
    • Ask for client references in your sector; Sterling’s client letters are available on request.
    • Agree who owns the evidence and the tool after the engagement; with Sterling the system stays yours, in Effivity.

Accreditation, audit language and remote audits in the Philippines

HIPAA is a United States law, not a certification. There is no HIPAA certificate; compliance is shown through risk analysis, safeguards, business associate agreements, training and records, and is enforced by the US Department of Health and Human Services. No assessor is named here. Edition and transition details: HIPAA hub →

      Audit language

Documentation and client assessments are in English.

      Remote and on-site

Client and third-party assessments are commonly remote, with site visits when the covered entity requires them.

HIPAA in the Philippines: questions clients ask

Does HIPAA apply to a company in the Philippines?

It can, through your relationship with a US covered entity. The HIPAA definition of a business associate covers a person who creates, receives, maintains or transmits protected health information for functions such as claims processing, billing or data analysis. A Philippine BPO doing that work for a US client falls within it. Confirm your position with US counsel.

      Is there a HIPAA certification?

No. HIPAA is a United States law, not a certification, so no assessor can issue a HIPAA certificate. Compliance is evidenced through risk analysis, safeguards, business associate agreements, training and records, and the US Department of Health and Human Services enforces it. Be wary of anyone selling a certificate.

Do we also need to comply with the Data Privacy Act?

Yes, in parallel. The Data Privacy Act applies to processing of personal information in the Philippines, and the National Privacy Commission oversees it. HIPAA and the Act are separate regimes that can cover the same data. Meeting one does not discharge the other, so ask your counsel to map both.
