ISO and GRC certification in Micronesia at a glance

Fish exports from the Federated States of Micronesia are predominantly frozen whole fish, according to the National Oceanic Fisheries Investment Policy 2024–2029, which sets an objective of promoting processed and value-added exports and directs support for the work of setting up a Competent Authority for FSM. That is the clearest food-safety pull in a country of 75,817 people at the 2023 census, spread across Chuuk, Pohnpei, Yap and Kosrae. Food importers and exporters are licensed under the National Food Safety Act, banks answer to the Banking Board under the FSM Bank Act of 1980, and insurers to the Insurance Board under the Insurance Act of 2006. National Government contracts follow the Public Contracts Act. The Asia Pacific Accreditation Cooperation lists no accreditation body for Micronesia, so certificates usually carry accreditation from another economy, and certification always comes from an accredited body, never from Sterling. Sterling's Sydney office serves Micronesia, drawing on 8,100+ client engagements in 60+ countries, 20+ years of practice, and Effivity and Sterling Academy included with every engagement.

Food businesses, importers and seafood exporters
National Food Safety Act (chapter 10 of title 41 of the FSM Code). The Secretary may license persons to import, export, prepare, pack, store or transport food, and exporting or preparing food for export without a valid licence is a national crime. The Act also lets a food inspector, on application by a commercial packer of seafood, inspect seafood for export and attach a certification mark where it complies. The Department's policies page lists DHS Regulations No. 1 to No. 7, covering food inspectors and analysts, general principles of food hygiene, licensing for import, export and inter-state commerce, low-acid canned foods, labelling of packaged foods, quick-frozen fish fillet blocks and food safety standards.
National Oceanic Resource Management Authority (NORMA), established by the Marine Resources Act of 2002 (subtitle I of title 24 of the FSM Code) with responsibility for overseeing the FSM exclusive economic zone
Tuna and other fishing, and fish exporters
Marine Resources Act of 2002. No commercial fishing or related activity is allowed in the exclusive economic zone without a valid permit issued by NORMA, whose licensing page lists foreign fishing, domestic fishing, support, flag and research permits and the documents each needs. The National Oceanic Fisheries Investment Policy 2024–2029 says fish exports are predominantly frozen whole fish, has an objective of promoting processed and value-added exports, and has a policy directive that ongoing work with regional partners on setting up a Competent Authority for FSM must be supported, with NORMA, the Department of Justice and Health collaborating.HACCP
Secretary of Resources and Development, who issues plant and animal quarantines under chapter 4 of title 22 and administers copra export licensing under chapter 3; the FSM Coconut Development Authority under chapter 2
Agriculture, copra and coconut products
Title 22 of the FSM Code (Agriculture and Livestock). A licence is required to purchase copra for export, quarantines are issued with the approval of the President to keep injurious insects, pests and diseases out, and the Coconut Development Authority may process, market and export coconut products and inspect and improve their quality. None of these chapters names an ISO standard.
Secretary of Health and Social Affairs and the Pharmaceutical Unit of the Department of Health and Social Affairs
Medicines and pharmacies
FSM Safe Pharmaceutical Act of 2022, codified as chapter 13 of title 41 of the FSM Code. The Department's FSM Pharmaceutical Product Registration Regulations, issued by the Secretary under that Act, set a quality-assessment and registration process for pharmaceutical products imported for distribution, sale or use in FSM. The Department's policies page also lists the FSM Pharmaceutical Import Control Act. The regulations do not name ISO 13485.
Banking Board, three members appointed by the President with the advice and consent of Congress, with a Banking Commissioner
Banks
Federated States of Micronesia Bank Act of 1980 (subtitle I of title 29 of the FSM Code). Section 202 gives the Board the principal purposes of licensing and supervising banks, protecting depositors and promoting the soundness, stability and development of the banking system, and section 203 lets it issue directives to give effect to the Act. Chapter 6 covers regulation, examination and reports of banks. The Act does not name an information security standard.
Insurance Board, three members appointed by the President with the advice and consent of Congress, and the Insurance Commissioner
Insurers and insurance intermediaries
Insurance Act of 2006 (subtitle I of title 37 of the FSM Code, enacted as PL 14-66). Chapter 2 establishes the Board and Commissioner; the Commissioner may demand information and may examine the affairs of any person licensed or registered under the Act, and the Act's own record-keeping provision is in chapter 1.
Department of Justice, which subchapter II of chapter 9 of title 11 gives authority over money laundering offences
Financial institutions and cash dealers
Money Laundering and Proceeds of Crime (chapter 9 of title 11 of the FSM Code, part of the Revised Criminal Code Act). Financial institutions and cash dealers must verify customers' identity, establish and maintain customer records, report suspicious transactions and establish internal reporting procedures (sections 913 to 916), and further preventive measures may be required (section 917).
Director of the Office of Environment and Emergency Management, as the FSM Environmental Protection Act names the Director (the Executive Branch now lists a Department of Environment, Climate Change and Emergency Management)
Developers, fishing and processing operators and any activity that may significantly affect the environment
FSM Environmental Protection Act (subtitle I of title 25 of the FSM Code). Before taking an action that may significantly affect the quality of the environment within the exclusive economic zone or within the National Capital Complex at Palikir, a person must submit an environmental impact statement to the Director in accordance with the Director's regulations (section 302).ISO 14001
Department of Resources and Development, which the Foreign Investment Act of 1997 names as the Department
Foreign investors and joint ventures
Foreign Investment Act of 1997 (chapter 2 of title 32 of the FSM Code). Its stated purpose is to encourage foreign investment in a manner that serves the economic, social and cultural interests of citizens; the Act defines the Foreign Investment Permit and defines engaging in business to include operating a factory, processing plant or warehouse. The National Oceanic Fisheries Investment Policy 2024–2029 refers to a proposed amendment of the 1997 Act that Congress had not yet endorsed when the policy was drafted.
the national criminal law in title 11 of the FSM Code

Telecommunications and radio communication users
Federated States of Micronesia Radio Communication Act of 1991 (chapter 1 of title 21 of the FSM Code). Section 105 prohibits a person receiving, transmitting or assisting with a foreign or interstate radio communication from divulging or publishing its existence, contents or meaning except through authorised channels, and prohibits interception without the sender's authority.
Department of Transportation, Communications and Infrastructure (TC&I)

TC&I's own site states its mandate includes ensuring that capital projects meet construction safety standards and are cost effective, and the department posts requests for expressions of interest and bidding notices for its projects, including works funded through Compact sector grants for infrastructure. The Employment Service function in section 152 of title 51 of the FSM Code covers oversight of the health, safety, lodging and working conditions of non-resident workers.ISO 45001

Accreditation and recognition

  • Asia Pacific Accreditation Cooperation (APAC): Regional cooperation of accreditation bodies whose published membership list shows no accreditation body for Micronesia.

Look for a certification body whose accreditation scope covers your standard and sector, from a national accreditation body recognised under the international arrangements of Global ACI (Global Accreditation Cooperation Incorporated, formerly the IAF MLA). Sterling does not certify.

Tenders and procurement

  • Public Contracts Act (chapter 4 of title 55 of the FSM Code) (National Government agencies through their contracting officers; the Department of Finance and Administration lists procurement services and donor-funded projects on its site): Contracts for construction projects or purchases of personal property above the Act's thresholds are let by sealed competitive bidding to the lowest responsible bidder, with a citizen-bidder preference, bonding and insurance provisions and a notice period before bid opening. Before a bidder may submit a bid, the contracting officer must be satisfied of its financial ability and of its experience and competence in similar work. The Act does not ask for an ISO certificate, so read the conditions of each invitation. The Department of Finance and Administration's site lists World Bank, Asian Development Bank and Green Climate Fund projects under its opportunities, and each donor's terms apply to those.

Questions Micronesia clients ask

Does Micronesia have its own accreditation body?

No national accreditation body appears on the membership list of the Asia Pacific Accreditation Cooperation for Micronesia. Organisations here therefore rely on certification bodies accredited elsewhere, and the useful check is the accreditation certificate and scope printed on the body's own documents. Your buyer or funder has the final say on which accreditation it will accept

Who licenses food importers and exporters in Micronesia?

The Secretary of Health and Social Affairs may license people to import, export, prepare, pack, store or transport food under the National Food Safety Act, and exporting without a valid licence is a national crime. Food inspectors can also inspect seafood for export on a packer's application. The Department publishes DHS Regulations No. 1 to No. 7 on food, so ask it which apply to you.

What does Micronesia's fisheries investment policy say about exports?

The National Oceanic Fisheries Investment Policy 2024–2029 says fish exports are predominantly frozen whole fish and aims to promote processed and value-added exports. One policy directive says the ongoing work with regional partners on setting up a Competent Authority for FSM must be supported. The policy names NORMA, the Department of Justice and Health as collaborators.

Which body supervises banks in Micronesia?

The Banking Board does. The FSM Bank Act of 1980 gives it the purposes of licensing and supervising banks, protecting depositors and promoting the soundness of the banking system, and it may issue directives to give effect to the Act. Its three members are appointed by the President with the advice and consent of Congress, and a Banking Commissioner assists. Ask the Board which directives apply to your bank.

How are national government contracts awarded in Micronesia?

Under the Public Contracts Act, contracts above the Act's thresholds are let by sealed competitive bidding to the lowest responsible bidder, with a citizen-bidder preference. A contracting officer must first be satisfied of the bidder's financial ability, experience and competence. The Act does not ask for an ISO certificate, so read each invitation for its own conditions.

Are certification audits in Micronesia conducted in English?

Usually, yes. The FSM Code and the public laws of Congress are written in English, and the National Food Safety Act requires imported food to carry English labels, so documents and tenders are normally in English. Staff interviews can be held in the local language of Chuuk, Kosrae, Pohnpei or Yap if that suits people; settle the interpreter question with the certification body when you apply
